Godara, for the appellant.\n\n\n        Heard learned counsel for the appellant.\n\n\n        Learned   counsel     for   the     appellant    submits   that   he\napologizes for the wrong statement made before the Court for\nfiling the requisites. In our view, due to the fault of the lawyer,\nthe appellant should not suffer. The learned Single Judge has\ntaken    too   technical view       while    dismissing the restoration\napplication for making wrong statement. The ends of justice\nwould meet, if the parties are given adequate opportunities to\ncontest the revision on merits. The restoration application was\ndismissed without giving notice to the respondent, therefore, we\ndeem it just and proper to allow this special appeal without\nserving notice to the respondent.\n\n\n        Accordingly,   this   special     appeal   is   allowed    and    the\nimpugned order dated 13.04.2009 passed by the learned Single\nJudge in S.B. Civil Restoration Application No.16\/2009 is set\naside and the S.B. Civil Sales Tax Revision Petition No.266\/2003\nis restored to its original number and be listed within 15 days\nbefore the appropriate Bench.\n\n\n\n(DEO NARAYAN THANVI), J.
