neaidi. Perused the records.\n<\/p>\n
   The present appeal is filed by the injured claimant<\/p>\n
seeking enhancement of Compensation awarded by the<\/p>\n
M A’ “Tribunal in Iv1.V.C.I82\/03. We have gone through the<\/p>\n
evidence and records. So far as involvement of the<\/p>\n
vehicles is concerned, i.e. Maruti car and the niotoiicycle<\/p>\n
on which the appellant was proceeding,__\u00a7_:thore=..:<\/p>\n
dispute. A complaint came tomlne lodgev’d.::f_aga.inst <\/p>\n
driver of the Maruti-car and char :;’*sheet_wa’s also filed.<\/p>\n
Based on the evidence of \u00b0t_he~…injured andfxpolicve”records,”<\/p>\n
the trial court concluded  accidstnt Vvias due to
\nrash and negligent  of Maruti car.\n<\/p>\n
Even othervvise,v._ so far as such<\/p>\n
3.   _’ question of quantum of
\ncompensation,’recoi’ds=–rleveal that the claimant sustained<\/p>\n
fra.g\u20ac;tum3 of  tibia and ‘even after taking treatment,<\/p>\n
.A :accor_ding:to,him, he is not able to do his normal work as<\/p>\n
if   agriculturist, as he gets pain in the right<\/p>\n
leg’    a long distance or stands for a long time.<\/p>\n
2   cannot lift heavy articles and therefore, there is<\/p>\n
‘loss of future income.\n<\/p>\n

4. PW2~doctor has opined that there is 12% disability<\/p>\n
so far as the right lower limb is concerned and ‘there is<\/p>\n
restriction of movement. However, he does.w.’indioate_<\/p>\n
in the form of answer that the >_app_elianf,’_\u00bb, goiild  <\/p>\n
indulge in any agricultural or c’0ntractua1_ op:erati’or1fi,l1e<\/p>\n
only says he may feel pain”‘~when”-\n<\/p>\n
motorcycle by kicking,   that the
\nappellant is totally  a two wheeler.\n<\/p>\n
Taking into_,  the learned
\nsingle \u00ab as general and<\/p>\n

5.  ilearriedl’singlealudge has not awarded any<\/p>\n
confi_pe11.sation’~ towards loss of income during the laid–up<\/p>\n
f  awarded only Rs. 10,000 \/ — towards injury,<\/p>\n
pain anfc’_l–._ suffering. Taking into consideration his<\/p>\n
avolcationvthat he may have to stand for long hours both<\/p>\n
if  firikzontract work and agricultural work, definitely there<\/p>\n
will be lot of discomfort, if not loss of future income in<\/p>\n
carrying out his work efficiently. Taking into<\/p>\n

\nconsideration all the facts and circumstances of the case,
\nwe are of the opinion another Rs.20,000\/a deserves to be<\/p>\n
enhanced to meet the ends of justice.<\/p>\n
6. Accordingly the appeal is <\/p>\n
enhancing compensation by Rs.\u00a72.0,QQO ‘ . <\/p>\n
the rate of 6% pa. from the date  <\/p>\n
Six weeks time is granted to -t\ufb01heV\u00bb31′<1hrespond_ent"to"deposit
