Justice V.GIRI\n\n Dated :14\/07\/2009\n\n O R D E R\n                        V.GIRI, J.\n         ----------------------------------------\n               W.P.(C).No.11129 of 2009\n         ----------------------------------------\n          Dated this the 14th day of July, 2009.\n\n\n                      JUDGMENT\n<\/pre>\n<p>        The marriage between the petitioner and the<\/p>\n<p>6th respondent, solemnised on 28.12.2001, was<\/p>\n<p>ultimately dissolved. But the 6th respondent-husband<\/p>\n<p>is an accused in a criminal case registered for offences<\/p>\n<p>under Section 498A of the Indian Penal Code and<\/p>\n<p>Sections 3 and 4 of the Dowry Prohibition Act, as also<\/p>\n<p>for offences under Sections 323, 506(i) and 294 read<\/p>\n<p>with Section 34 of the Indian Penal Code.           The<\/p>\n<p>petitioner is the de facto complainant in all those<\/p>\n<p>cases. However, the 6th respondent has been enlarged<\/p>\n<p>on bail. The petitioner has sought for impounding of<\/p>\n<p>the passport of the 6th respondent.<\/p>\n<p>        2.   A memo has been filed by the counsel<\/p>\n<p>appearing for the 6th respondent, producing an order<\/p>\n<p>passed by the Judicial Magistrate of the First Class-I,<\/p>\n<p>Ettumanoor permitting the passport surrendered by<\/p>\n<p>the accused to be returned to him.<\/p>\n<p>W.P.(C).No.11129 of 2009<\/p>\n<p>                          :: 2 ::\n<\/p>\n<\/p>\n<p>        3.
