Justice R.BASANT\n\n Dated :13\/12\/2007\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                       B.A.No.7664 of 2007\n                      -------------------------------------\n            Dated this the 13th day of December, 2007\n\n                                  ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioner faces allegations<\/p>\n<p>in a crime registered under Section 393 I.P.C. The crux of the<\/p>\n<p>allegation against the petitioner is that he attempted to snatch<\/p>\n<p>away the bag containing currency notes which the defacto<\/p>\n<p>complainant, a pygmy deposit collector of a bank, a woman, was<\/p>\n<p>carrying with her. The alleged incident took place on the evening<\/p>\n<p>of 10.11.07. Complaint was lodged on the next day before the<\/p>\n<p>police. Crime has been registered. Investigation is in progress.<\/p>\n<p>The petitioner apprehends imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is absolutely innocent.            False allegations have been<\/p>\n<p>raised against the petitioner because of political animosity, it is<\/p>\n<p>urged.\n<\/p>\n<p>      3.   The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor submits that the materials show<\/p>\n<p>that there was an attempt to snatch away the bag containing<\/p>\n<p><span class=\"hidden_text\">B.A.No.7664 of 2007             2<\/span><\/p>\n<p>currency notes of the defacto complainant, a woman. She was<\/p>\n<p>able to identify the miscreant, who was known to her, when she<\/p>\n<p>lighted a torch. No independent eye witness has been traced so<\/p>\n<p>far. But there is nothing to doubt or suspect the version of the<\/p>\n<p>defacto complainant. In these circumstances, the petitioner may<\/p>\n<p>not, at any rate, be granted anticipatory bail.       He may be<\/p>\n<p>directed to surrender before the Investigating Officer or the<\/p>\n<p>learned Magistrate having jurisdiction and then seek regular bail,<\/p>\n<p>submits the learned Public Prosecutor.\n<\/p>\n<p>      4.   A contention raised by the learned counsel for the<\/p>\n<p>petitioner is that political animosity is prompting the defacto<\/p>\n<p>complainant to make false allegations against the petitioner. In<\/p>\n<p>fact, I have gone through the petition. There is not even an<\/p>\n<p>assertion that the petitioner belongs to or he is an active worker<\/p>\n<p>of any political party. Admittedly the defacto complainant lady<\/p>\n<p>has no political leadings. Her husband is alleged to be a political<\/p>\n<p>worker. There is nothing to show that the husband of the defacto<\/p>\n<p>complainant or the petitioner is such an important political<\/p>\n<p>functionary as to justify the contention that a totally false and<\/p>\n<p><span class=\"hidden_text\">B.A.No.7664 of 2007             3<\/span><\/p>\n<p>vexatious allegation is being invented against the petitioner to<\/p>\n<p>vex and harass the petitioner. I am not satisfied that there are<\/p>\n<p>any circumstances in this case which can justify or warrant the<\/p>\n<p>invocation of the extraordinary equitable discretion under Section<\/p>\n<p>438 Cr.P.C. This, I am satisfied, is a fit case where the petitioner<\/p>\n<p>must appear before the learned Magistrate having jurisdiction or<\/p>\n<p>the Investigating Officer and then seek bail in the regular and<\/p>\n<p>ordinary course.\n<\/p>\n<p>     5.
