JUSTICE R.M.DOSHIT)<\/p>\n<p>\t\tThis<br \/>\nAppeal preferred under Clause 15 of the Letters Patent arises from<br \/>\nthe judgment and order dated 3rd August 2007 passed by the<br \/>\nlearned Single Judge in the above Special Civil Application No.5287<br \/>\nof 2007.\n<\/p>\n<p>\t\tThe<br \/>\nrespondent Ranjanben Ghanshyambhai Gadhvi is the wife of<br \/>\nGhanshyambhai Gadhvi-City Civil Judge, Ahmedabad (hereinafter<br \/>\nreferred to as  the late Shri Gadhvi ).\n<\/p>\n<p> The late Shri Gadhvi passed away on 31st March 2006.  The<br \/>\ndispute is in respect of entitlement of the respondent to family<br \/>\npension as the widow of a deceased City Civil Judge.\n<\/p>\n<p>\t\tThe<br \/>\nlate Shri Gadhvi, while practicing as a lawyer at Mehsana, had<br \/>\naccepted the employment as a Part Time Lecturer in S.M.Patel Law<br \/>\nCollege at Mehsana.  Having served as Part Time Lecturer for two<br \/>\nyears, in the year 1988 he joined the said Law College as Full Time<br \/>\nLecturer.  He served as Full Time Lecturer from 28th<br \/>\nNovember 1988 to 4th April 2000.  On 4th April<br \/>\n2000, he resigned from the service and started legal practice.  For<br \/>\nthe service rendered by him as a teacher in the Law College, he was<br \/>\nreceiving certain pension.  After the practice of around two years,<br \/>\nhe was selected and appointed as a City Civil Judge on 27th<br \/>\nSeptember 2002. While in service as a City Civil Judge, he passed<br \/>\naway on 31st March 2006.  On his passing away, the<br \/>\nrespondent claimed family pension as the widow of a deceased City<br \/>\nCivil Judge.\n<\/p>\n<p>\t\tWhile<br \/>\nher claim was under process, she was sanctioned family pension on the<br \/>\nbasis of the pension received by the late Shri Gadhvi for his service<br \/>\nas a teacher in the law college.  At first, the sanctioning authority<br \/>\nwas skeptical.  On 15th June 2006, a query was raised<br \/>\nregarding legality of the appointment of the late Shri Gadhvi as a<br \/>\nCity Civil Judge.  The officer was of the opinion that having<br \/>\nresigned from one Government service, the late Shri  Gadhvi could not<br \/>\nhave been appointed to another Government service or to any other<br \/>\nservice for which he would be paid out of the Government treasury.<br \/>\nThe officer was also of the opinion that in view of Rules 168 and 169<br \/>\nof the Gujarat Civil Services (Pension) Rules, 2002 (hereinafter<br \/>\nreferred to as  the Rules of 2002 ), late Shri Gadhvi was<br \/>\nnot entitled to the second pension.\n<\/p>\n<p>\t\tFeeling<br \/>\naggrieved, the respondent filed the above Special Civil Application<br \/>\nNo.5287 of 2007 before this Court under Article 226 of the<br \/>\nConstitution.\n<\/p>\n<p>\t\tWe<br \/>\nare informed that pending the petition, the petitioner&#8217;s claim for<br \/>\nfamily pension as the widow of a deceased City Civil Judge with<br \/>\neffect from 1st April 2006 is granted.  Thus, the<br \/>\ngrievance of the respondent stood substantially redressed.  However,<br \/>\nas disclosed in the counter affidavit made by the Deputy Director of<br \/>\nPension and Provident Fund; while paying the amount of family pension<br \/>\nand gratuity a sum of Rs.2,15,464\/- was deducted and a sum of<br \/>\nRs.62,071\/-   the amount of family pension paid to the respondent<br \/>\nsince 1st April 2006 was adjusted.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above development, the controversy now relates to the<br \/>\ndeduction of Rs.2,15,464\/- from the amount of family pension and<br \/>\ngratuity. The respondent does not dispute that she is not entitled to<br \/>\ntwo family pensions; one as the widow of the deceased teacher and the<br \/>\nother as the widow of the deceased Judicial Officer.  She has no<br \/>\ngrievance in respect of the sum of Rs.62,071\/- adjusted against the<br \/>\namount of arrears of family pension payable to her.  As recorded<br \/>\nhereinabove, the controversy now centers around the deduction of the<br \/>\nabove referred sum of Rs.2,15,464\/-.\n<\/p>\n<p>\t\tAccording<br \/>\nto the State Government that was the amount paid to late Shri Gadhvi<br \/>\nby way of pension and gratuity since his resignation from service as<br \/>\na teacher.  According to the State Government, late Shri Gadhvi was<br \/>\nnot entitled to the pension and, therefore, the aforesaid amount was<br \/>\nrequired to be deducted. The defense did not find favour with the<br \/>\nlearned Single Judge.  The learned Single Judge has allowed the<br \/>\npetition to the extent the appellants are directed to pay to the<br \/>\nrespondent the aforesaid sum of Rs.2,15,464\/-.  We are informed that<br \/>\npending the Appeal, the said amount has been paid to the respondent.\n<\/p>\n<p>\t\tLearned<br \/>\nAGP Ms.Nair has appeared for the appellants.  She has relied upon<br \/>\nRule 168 of the Rules of 2002.  Rule 168 of the Rules of 2002<br \/>\nprovides, inter alia,  a Government employee who has received a<br \/>\npension on retirement shall not, if re-employed in Government<br \/>\nservice, be permitted to count his new service as qualifying for<br \/>\nsecond pension.  If the new service is pensionable, it must be<br \/>\ncombined for the purpose of calculating pension with the service<br \/>\npreviously rendered and the whole service period be treated as one<br \/>\nservice.\n<\/p>\n<p>\t\tWe<br \/>\nare of the opinion that fallacy lies in reliance placed on the<br \/>\naforesaid Rule 168 of the Rules of 2002.  The rule specifically<br \/>\napplies to a case of reemployment of retired Government servant.  In<br \/>\nthe present matter, neither late Shri Gadhvi had retired from service<br \/>\nas a teacher in the law school nor his appointment as a Judge, City<br \/>\nCivil Court was reemployment.  The question of claim for second<br \/>\npension, therefore, did not arise.  We see no justification in<br \/>\nrecovery of the amount of pension paid to late Shri Gadhvi during his<br \/>\nlifetime.\n<\/p>\n<p>\t\tNo<br \/>\nother contention is raised before us. We are of the opinion that the<br \/>\nAppeal is devoid of any merit.  The Appeal is dismissed.
