Garg, Counsel for petitioner\nShri Mahipal Vishnoi, PP for the State\n                       ####\n\nBy the Court:<\/pre>\n<p>      Heard learned counsel for petitioner as well<br \/>\nas   learned    Public       Prosecutor        and      perused    the<br \/>\nmaterial made available to me during the arguments<br \/>\nof the case.\n<\/p>\n<p>      It is contended on behalf of petitioner that<br \/>\non   the   basis    of     &#8216;parcha       bayan&#8217;   of    injured    Ram<br \/>\nKumar, the present F.I.R. was registered wherein<br \/>\nhe named five persons and allegation was levelled<br \/>\nthat all the five persons inflicted injuries on<br \/>\nhis person; however, after investigation of the<br \/>\ncase, the prosecution came to a conclusion that<br \/>\nonly two persons were involved and consequently<br \/>\nfiled a charge-sheet against two persons, namely,<br \/>\nDarshan Singh and present-petitioner Sukhvinder @<br \/>\nSukhvinder Singh; investigation in the matter is<br \/>\ncomplete,     now    nothing       is     to   be      recovered    or<br \/>\ninvestigated        from     the     accused-petitioner;           the<br \/>\npetitioner is in judicial custody since 30th April,<br \/>\n                                     \/\/ 2 \/\/<br \/>\n2009;        the    co-accused         Darshan    has    already        been<br \/>\nreleased           on     bail,        therefore,        the     present<br \/>\npetitioner be also released on bail.\n<\/p>\n<p>        After considering the submissions of learned<br \/>\ncounsel for the parties, examining the record and<br \/>\nthe    facts        and    circumstances         of    the     case,     but<br \/>\nwithout expressing any opinion on its merits and<br \/>\ndemerits, I think it fit and proper to allow this<br \/>\napplication under Section 439, Cr.P.C.\n<\/p>\n<p>        Hence, it is directed that accused-petitioner<br \/>\nSukhvinder @ Sukhvinder Singh S\/o Jeet Ram, R\/o<br \/>\nManniwalla,             Tehsil    Sadulshahar,          District        Sri<br \/>\nGanganagar (presently lodged at District Jail Sri<br \/>\nGanganagar) be released on bail under Section 439<br \/>\nCr.P.C.,           in    F.I.R.
