Justice A.K.BASHEER\n\n Dated :16\/07\/2008\n\n O R D E R\n                  H.L.Dattu, C.J. &amp; A.K.Basheer, J.\n                  ----------------------------------------------\n                       W.P.(C).No.17115 of 2008-S\n                  ----------------------------------------------\n                   Dated, this the 16th day of July, 2008\n\n                                JUDGMENT\n<\/pre>\n<p>H.L.Dattu,C.J.\n<\/p>\n<p>              The petitioner is a Society, registered under the provisions<\/p>\n<p>of the Travancore-Cochin Literary, Scientific &amp; Charitable Societies Act,<\/p>\n<p>1955. The petitioner Society is formed by a group of public spirited<\/p>\n<p>citizens in Peruvanthanam Village of Peermedu Taluk in Idukki District,<\/p>\n<p>with the object of rendering assistance to the public in respect of their<\/p>\n<p>common grievances and problems, to fight against anti-social activities, to<\/p>\n<p>prevent corruption, etc.<\/p>\n<p>              2. It is the grievance of the petitioner in this petition filed<\/p>\n<p>under Article 226 of the Constitution, that, the 3rd respondent, viz., Kerala<\/p>\n<p>Water Authortiy, represented by its Managing Director, has not taken<\/p>\n<p>effective steps in completing the Haileyburia Water Supply Scheme in<\/p>\n<p>Idukki District.\n<\/p>\n<p>              3. The main prayer made in the writ petition is to direct the<\/p>\n<p>respondents to complete the aforesaid water supply scheme in Idukki<\/p>\n<p>District within the time limit prescribed, by monitoring the same till its<\/p>\n<p>completion and commissioning.\n<\/p>\n<p>W.P.(C).No.17115 of 2008\n<\/p>\n<p>                                           &#8211; 2 &#8211;\n<\/p>\n<\/p>\n<p>              4. The Kerala Water Authority has filed its counter affidavit<\/p>\n<p>before this Court. In that, at paragraph 4, they have stated the steps that<\/p>\n<p>they have taken between 2001 and 2006 for redressal of the grievances of<\/p>\n<p>the petitioner. Further, at paragraph 5, they have stated that due to the<\/p>\n<p>delay in getting land from Tyford Estate, construction of Master Tank and<\/p>\n<p>Booster Tank were delayed and there is some delay in completing the<\/p>\n<p>project\/scheme in question. In paragraph 6 of the counter affidavit, they<\/p>\n<p>have stated that they are doing all their best to complete the scheme as<\/p>\n<p>early as possible. It is also stated that they require another two years&#8217; time<\/p>\n<p>to complete the project\/scheme. The affidavit filed by the respondents is<\/p>\n<p>as under:\n<\/p>\n<blockquote><p>                 &#8220;5. Due to the delay in getting land from Tyford<\/p>\n<p>          Estate, construction of Master Tank and Booster Tank<\/p>\n<p>          were delayed. The estimate of pumping main are under<\/p>\n<p>          scrutiny at Chief Engineer&#8217;s (CR) Office, Kochi, except<\/p>\n<p>          Raw Water pumping main. The works related to Raw<\/p>\n<p>          Water Pumping main already tendered and tender<\/p>\n<p>          under scrutiny. The construction of Master Tank and 3<\/p>\n<p>          Nos. of Booster Tank were already tendered and the<\/p>\n<p>          tenders under scrutiny.<\/p><\/blockquote>\n<p>                 6. The petition argument is untrue. The project<\/p>\n<p>          work under this office are in good progress. We made<\/p>\n<p>          our best for the completion of the works. The officials<\/p>\n<p>          of Kerala Water Authority and the political parties are<\/p>\n<p>          very much interested for the completion of the scheme<\/p>\n<p>W.P.(C).No.17115 of 2008\n<\/p>\n<p>                                           &#8211; 3 &#8211;\n<\/p>\n<p>\n           and expected to complete scheme within two years. But<\/p>\n<p>           due to unexpected reason, the          completion of the<\/p>\n<p>           scheme delayed. The war foot steps are already taken<\/p>\n<p>           for the completion of the work in time by Kerala Water<\/p>\n<p>           Authority.     No negligence has occurred from the<\/p>\n<p>           Government of Kerala as Kerala Water Authority for<\/p>\n<p>           the completion of the work.         But some unexpected<\/p>\n<p>           reason, the work delayed.&#8221;\n<\/p>\n<p>               5. The main grievance of the petitioner, as we have already<\/p>\n<p>stated, is that there is lethargic attitude on the part of the 3rd respondent in<\/p>\n<p>completing the Haileyburia Water Supply Scheme in Idukki District. The<\/p>\n<p>delay in completing the project is properly explained by the contesting<\/p>\n<p>respondents.     In our view, we need to only accept           the explanation<\/p>\n<p>offered.    Since     the contesting respondent, namely, Kerala Water<\/p>\n<p>Authority, has undertaken before this Court that this project will be<\/p>\n<p>completed as early as possible, it may not be necessary to continue to keep<\/p>\n<p>this file on the board..\n<\/p>\n<p>               6. In view of the above, keeping in view the urgency of the<\/p>\n<p>project canvassed by the petitioner-Society, in our opinion, if one year&#8217;s<\/p>\n<p>time is granted from today to complete the project\/scheme, it will not<\/p>\n<p>cause any prejudice to the respondent &#8211; Kerala Water Authority.<\/p>\n<p>Accordingly, we grant one year time from today to complete the<\/p>\n<p>project\/scheme.\n<\/p>\n<p>W.P.(C).No.17115 of 2008\n<\/p>\n<p>                                       &#8211; 4 &#8211;\n<\/p>\n<\/p>\n<p>            7.
