Petitioner-Insurance Company was opposite party before the District Forum. It had insured Maruti Car of the respondent-complainant for Rs. 1.00 lakh. During the currency of the policy the vehicle met with accident on 7.5.1999. On 9.6.1999 Insurance Company paid Rs. 64,000\/-to the complainant in full and final settlement of his claim. This was not accepted by the complainant who filed a complaint before the District Forum complaining deficiency in service.\n<\/p>\n<p>2. District Forum held that the complainant did not unconditionally settled his claim as alleged by the Insurance Company. After examining the whole matter and referring to the decision of the Supreme Court in the case of <a href=\"\/doc\/1711990\/\">Modern Insulators Ltd. v. Oriental Insurance Co. Ltd., I<\/a> (2000) CPJ 1 (SC)-II (2000) SLT 323, District Forum upheld the claim of the complainant and held against the Insurance Company that the receipt given by the complainant was not in full discharge of his claim. District Forum, therefore, directed the Insurance Company to pay Rs. 36,000\/- to the complainant with interest @ 12% per annum w.e.f. 9.6.1999, the date on which the amount of Rs. 64,0007- was paid to the complainant. Costs of Rs. 1,100\/- which also included harassment undergone by the complainant was also awarded.\n<\/p>\n<p>3. Insurance Company went in appeal before the State Commission challenging the order of the District Forum. State Commission in a detailed order running into 12 pages after examining the whole aspect of the matter arrived at the similar conclusion that the complainant did not give the receipt for discharge in full and final settlement of his claim. However, State Commission modified the order of the District Forum to the extent that the award of interest was reduced from 12% to 9%. Rest of the order of the District Forum was upheld. There is thus a concurrent finding that settlement allegedly arrived at between the parties and as contended by the Insurance Company was not correct.\n<\/p>\n<p>4. We do not find any jurisdictional error in the order either of the District Forum or of the State Commission for us to exercise our jurisdiction under Clause (b) of Section 21 of the Consumer Protection Act, 1986.
