No.1162 of 2011\n                   Mukesh Kumar Ray, son of Nalendu Kumar Ray, resident of\n           village- Perhap, P.S.- Sahar, District- Bhojpur (Arrah).\n                                                                ..........Petitioner\n                                                Versus\n                                       The State of Bihar\n                                                          ...........Opposite Party\n                                              -----------\n<\/pre>\n<p>2.   27.09.2011                The accused petitioner has preferred this<\/p>\n<p>                   revision application under Section 53 of the Juvenile<\/p>\n<p>                   Justice (Care and Protection of Children) Act, 2000<\/p>\n<p>                   against the order dated 27.05.2011 passed by the learned<\/p>\n<p>                   Sessions Judge, Patna in Cr. Appeal No.126\/2011 by<\/p>\n<p>                   which the order dated 16.04.2011 passed by the learned<\/p>\n<p>                   Juvenile Justice Board, Patna in J.J.B. Case No.33\/11<\/p>\n<p>                   arising out of Patrakarnagar P.S. Case No.248\/10 under<\/p>\n<p>                   Section 377 of the I.P.C. has been confirmed and the<\/p>\n<p>                   prayer of the petitioner for grant of bail has been rejected.<\/p>\n<p>                               Heard Mr. Mahendra Thakur, the learned<\/p>\n<p>                   counsel for the petitioner and Mr. Anand Kishore<\/p>\n<p>                   Chaudhary, learned counsel for the State.<\/p>\n<p>                               The main contention of the learned counsel for<\/p>\n<p>                   the petitioner is that the petitioner has been declared a<\/p>\n<p>                   juvenile by the learned Juvenile Justice Board vide order<\/p>\n<p>                   dated 26.02.2011. His prayer for bail was rejected by the<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>Juvenile Justice Board vide order dated 16.04.2011.<\/p>\n<p>Against the said order, the petitioner preferred Cr. Appeal<\/p>\n<p>No.126\/11, which has been dismissed by the impugned<\/p>\n<p>order on the ground that the petitioner has committed<\/p>\n<p>unnatural offence. There is no material on record to show<\/p>\n<p>the release of the petitioner will bring him into association<\/p>\n<p>with known criminal and expose him to moral, physical<\/p>\n<p>and psychological danger and his release would defeat the<\/p>\n<p>ends of justice. He has further submitted that the petitioner<\/p>\n<p>has been in custody since 3.12.2010.\n<\/p>\n<p>            Learned counsel for the State could not<\/p>\n<p>controvert the contention of the petitioner while opposing<\/p>\n<p>the prayer of the petitioner.\n<\/p>\n<p>            After hearing the learned counsel for both the<\/p>\n<p>parties and on perusal of the materials on record, it appears<\/p>\n<p>that the contention of the learned counsel for the petitioner<\/p>\n<p>is correct. It also appears from the report dated 20.09.2011<\/p>\n<p>at flag &#8216;A&#8217;, which has been received from the Probation<\/p>\n<p>Officer through the Juvenile Justice Board, Patna that the<\/p>\n<p>petitioner has no criminal antecedent. There is no material<\/p>\n<p>on record to show that the release of the petitioner will<\/p>\n<p>bring him into association with known criminal and<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>expose him to moral, physical and psychological danger<\/p>\n<p>and his release would defeat the ends of justice.<\/p>\n<p>            Considering the facts and circumstances stated<\/p>\n<p>above, in my opinion, the impugned order is not fit to be<\/p>\n<p>sustained. The impugned order is set aside. The petitioner<\/p>\n<p>above-named is directed to be released on bail on<\/p>\n<p>furnishing bail bond of Rs.10,000\/-with two sureties of the<\/p>\n<p>like amount each to the satisfaction of learned Juvenile<\/p>\n<p>Justice Board, Patna in connection with Patrakarnagar P.S.<\/p>\n<p>Case No.248\/10, G.R. No.5976\/10 on the following terms<\/p>\n<p>and conditions :\n<\/p>\n<p>            (i)            One of the bailors will be the<\/p>\n<p>                           father of the petitioner.\n<\/p>\n<p>            (ii)           Father of the petitioner will<\/p>\n<p>                           produce the petitioner in the<\/p>\n<p>                           court if and when required.\n<\/p>\n<p>            (iii)          The petitioner will not indulge<\/p>\n<p>                           in similar or in any other<\/p>\n<p>                           offence.\n<\/p>\n<p>            (iv)           In case of his absence for two<\/p>\n<p>                           consecutive dates or in case of<\/p>\n<p>                           violation of the terms of the<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>                                    bail, his bail bond will be liable<\/p>\n<p>                                    to be cancelled by the learned<\/p>\n<p>                                    Juvenile Justice Board and he<\/p>\n<p>                                    will be taken into custody.\n<\/p>\n<p>              In the result, this application is allowed.<\/p>\n<pre>V.K.
