Balasubramanyan\n\nJUDGMENT:\n<\/pre>\n<p>JUDGMENT<br \/>\nO R D E R<\/p>\n<p>1.\tActing on a letter written by the petitioner, Rubabbuddin<br \/>\nSheikh, to the Chief Justice of India about the killing of his brother,<br \/>\nSohrabuddin Sheikh in a fake encounter and disappearance of his<br \/>\nsister-in-law Kausarbi at the hands of the Anti Terrorist Squad (ATS)<br \/>\nPolice Gujarat and Rajasthan Special Task Force (STF), this Court<br \/>\nforwarded the letter to the Director General of Police, Gujarat to take<br \/>\naction. This letter of the Registry of this Court was issued on 21st<br \/>\nJanuary, 2007.  After about six months and after reminders the<br \/>\nDirector General, Police, Gujarat, directed Mrs. Geetha Johri,<br \/>\nInspector General, Police (Crime), to inquire about the facts stated in<br \/>\nthe letter. A case was registered as Enquiry No. 66\/06. Be it<br \/>\nmentioned herein that about 6 months were taken to direct<br \/>\ninvestigation into the matter. From 1st September, 2006 to 22nd<br \/>\nJanuary, 2007 four Interim Reports were submitted by one V.L.<br \/>\nSolanki, Police Inspector, working under Mrs. Geetha Johri. Out of<br \/>\nthese four interim reports, it appears only one report was submitted<br \/>\ninitially in this Court. It was only on 16th May 2007 that the other<br \/>\nthree reports have been submitted.\n<\/p>\n<p>2.\tIn the report of Mrs. Johri dated 12th May, 2007, it has been<br \/>\nstated as follows:\n<\/p>\n<p>&#8220;However, based on the statement of various<br \/>\nwitnesses and subsequent identification of the<br \/>\nphotographs of Sohrabuddin and Kausarbi taken by<br \/>\nInquiry Team of CID Crime there appears to be some<br \/>\ndiscrepancy regarding the presence of Sohrabuddin and<br \/>\nKausarbi at Hyderabad and Ahmedabad which needs to<br \/>\nbe further enquired into. Further enquiry also needs to<br \/>\nbe conducted with regards (1) who were the persons who<br \/>\nclaimed to be police who picked up the three passengers<br \/>\nnamely Sohrabuddin, Kausarbi and third unknown<br \/>\nperson. (2) what happened to Kausarbi after 22.11.2005<br \/>\nwhen the so-called police personnel took her off the<br \/>\nbus.&#8221;\n<\/p>\n<p>3.\tIn the same report, Mrs. Johri sought permission to interrogate<br \/>\none Tulsiram who was at that time in Rajasthan Jail. From the record<br \/>\nit appears that on 27th \/28th  December, 2006, an FIR was lodged in<br \/>\nwhich it was stated that when Tulsiram was sent on transit remand<br \/>\nfrom Rajasthan to Gujarat, two armed persons rescued him at gun<br \/>\npoint and fled with Tulsiram. In the said FIR it has been alleged that<br \/>\nwhile search was on for Tulsiram early in the next morning, he, along<br \/>\nwith two other persons, was spotted on a highway trying to stop a<br \/>\nmatador. It has also been alleged, that one of the police officers who<br \/>\nwas following the matador in which Tulsiram was traveling, accosted<br \/>\nhim, upon which Tulsiram was said to have fired at the Police officer<br \/>\nand the bullet was said to have hit the mudguard of the vehicle. The<br \/>\nPolice Officers were said to have fired at Tulsiram in self-defence,<br \/>\nkilling him. However, the other two persons somehow managed to<br \/>\nescape in the darkness.\n<\/p>\n<p>4.\tIt appears from the records of this case that one Mr. Raigar,<br \/>\nAdditional Director General of Police and Head of CID Gujarat police<br \/>\nwho was in-charge of the investigation on the incident of death of<br \/>\nSohrabuddin and disappearance of Kausarbi was replaced by one<br \/>\nMr. O.P. Mathur, Additional Director General of Police (prison) who<br \/>\nwas given an additional charge as Head of CID.\n<\/p>\n<p>5.\tHowever, Mrs. Geetha Johri was replaced by  Mr. Rajnish Rai,<br \/>\nDeputy Inspector General, as an Investigating Officer in respect of the<br \/>\nfake encounter relating to the incident of Sohrabuddin&#8217;s case and<br \/>\ndisappearance of Kausarbi. We may take note of the fact that this<br \/>\npetition under Article 32 of the Constitution was moved in this Court<br \/>\non          22nd January, 2007 when notice was issued only to<br \/>\nrespondent No.11, Union of India, and Mr. Gopal Subramanium,<br \/>\nlearned Additional Solicitor General, who was present in Court was<br \/>\nrequested by this Court to take instruction in the matter.\n<\/p>\n<p>6.\tSubsequently, on 19th March, 2007 the matter came up before<br \/>\nthis Court and this time a Bench of this Court issued notice to the<br \/>\nState of Gujarat which was made returnable on 23rd of March, 2007.<br \/>\nLater, on   23rd March, 2007 when the matter was placed before this<br \/>\nCourt, three weeks&#8217;time was granted to the State to file a report in a<br \/>\nsealed cover and on that date a report was submitted by the Addl.<br \/>\nSolicitor General of India which was also kept in a sealed cover. An<br \/>\ninterim report was submitted by Mr. K.T.S. Tulsi, learned senior<br \/>\ncounsel appearing on behalf of the State of Gujarat, on 27th April,<br \/>\n2007 in which the State made an interim report on the investigation<br \/>\nconducted by them in consonance with the different orders of this<br \/>\nCourt. Mr. Tulsi learned senior counsel for the State of Gujarat sought<br \/>\nmore time on 3rd May, 2007 so that a comprehensive status report or<br \/>\nAction Taken Report could be submitted before this Court. Status<br \/>\nReport or the Action Taken Report No.4 was thereafter filed in this<br \/>\nCourt by the learned senior counsel for the State of Gujarat. Learned<br \/>\nAttorney General for India who appeared for the Union of India<br \/>\nsubmitted that in view of the serious nature of the offence in which<br \/>\nsome highly placed police officials of the State of Gujarat were<br \/>\nalleged to have been involved, directions may be given to the Central<br \/>\nBureau of Investigation (CBI) to take charge of the investigation and<br \/>\nsubmit a report to this Court. After perusing the interim report and<br \/>\nother materials on record and considering the submission of the<br \/>\nlearned senior counsel for the State of Gujarat that the investigation<br \/>\nwas at the final stage, we granted some time to the State of Gujarat to<br \/>\nfile a final status report within two weeks from that date by order<br \/>\ndated 3rd May, 2007. However, from the order dated 3rd May, 2007 it<br \/>\nappears that Mr. Tulsi submitted that &#8220;body of Kausarbi was disposed<br \/>\nof by burning it in Village Illol, Sabarkanta Distt.&#8221; which fact was<br \/>\nbrought on record in the Action Taken Report No.3 submitted on 30th<br \/>\nApril, 2007. In view of this statement made by the State of Gujarat<br \/>\nbefore us and brought on record in the Action Taken Report No.3, we<br \/>\nrefrained ourselves from issuing a formal writ of Habeas Corpus<br \/>\ndirecting the State of Gujarat to produce Kausarbi in Court. We also<br \/>\nsought an explanation from the State of Gujarat as to the reason why<br \/>\nMrs. Geetha Johri was taken off the investigation relating to the<br \/>\nincident regarding the death of Sohrabuddin and disappearance of his<br \/>\nwife Kausarbi. The matter was placed for hearing again on 15th May,<br \/>\n2007.\n<\/p>\n<p>7.\tLearned Attorney General for India has seriously submitted that<br \/>\nthis is a fit case where this Court should pass an order directing<br \/>\nhanding over the investigation from the State Investigating Agency to<br \/>\nCBI as the investigation would not only be made in the State of<br \/>\nGujarat but also in the State of Andhra Pradesh and Rajasthan and for<br \/>\nsuch investigation, cooperation of the State of Rajasthan and State of<br \/>\nAndhra Pradesh and their high police officials may be required.<br \/>\nTherefore, according to Attorney General for India, it would be<br \/>\ndifficult for the Investigating Agency of the State of Gujarat to make<br \/>\nproper and thorough enquiry and submit a report to this Court. Mr.<br \/>\nAhmadi appearing on behalf of the petitioner, drawing our attention to<br \/>\nthe factual aspect of the matter, argued that in the facts and<br \/>\ncircumstances of the case and in view of the serious nature of the<br \/>\nsame this Court may direct the CBI to take over but at the same time<br \/>\npermit Mrs.Geetha Johri and Mr. Rajnish Rai to make the<br \/>\ninvestigation jointly and submit a report to this Court.\n<\/p>\n<p>8.\tMr. Gopal Subramanium, learned Addl. Solicitor General for<br \/>\nIndia also submitted that it was a fit case for handing over the<br \/>\ninvestigation to CBI from State of Gujarat. Mr. Gopal Subramanium<br \/>\nfurther submitted that although it has been accepted by the State of<br \/>\nGujarat that there were four preliminary reports even than only one<br \/>\ninterim preliminary report has been filed in this Court. Therefore,<br \/>\ndirection may be given to the State of Gujarat to submit the other<br \/>\nthree interim reports before this Court. So far as this grievance of Mr.<br \/>\nGopal Subramanium is concerned, we find from the record that on<br \/>\n16th May, 2007 three interim reports have been submitted. Mr. K.T.S.<br \/>\nTulsi, learned senior counsel for the State of Gujarat, however,<br \/>\nsubmitted that the final report would be submitted to this Court within<br \/>\n4 to 6 weeks&#8217; time from today.\n<\/p>\n<p>9.\tFrom the Action Taken Report No.4 which has been submitted<br \/>\nbefore this Court on 14th May, 2007 we find that the Assistance of<br \/>\nDirectorate of Forensic Science, Gujarat State, and  BJ Medical<br \/>\nCollege, Ahmedabad has been sought to obtain advice on the exhibits<br \/>\ncollected from the scene of offence. Permission of the Court has also<br \/>\nbeen sought for narcoanalysis and other related tests in case of the<br \/>\naccused namely,  (1) Shri D.B.Vanzara, IPS, Ex-DIG of Police,<br \/>\nBorder Range, Kutch-Bhuj, (2) Shri Rajkumar Pandyan, Ex-SP, CID,<br \/>\nIB and (3) Shri Dinesh MN, IPS, SP, Alwar, Rajasthan. However, the<br \/>\nCourt has fixed the hearing on the application on 28th May, 2007. In<br \/>\nthe said Action Taken Report No.4 it has also been stated that efforts<br \/>\nare being made to arrest remaining accused officers and men against<br \/>\nwhom there is prima facie evidence. As noted herein earlier, efforts<br \/>\nhave been made to trace remains of Kausarbi. A well where reportedly<br \/>\nthe remains of Kausarbi have been dispersed has been dug up and<br \/>\nsamples collected have been sent to Forensic Science Laboratory,<br \/>\nGandhinagar for further analysis for comparison with the soil samples<br \/>\ntaken from the scene where the body of Kausarbi was allowed to have<br \/>\nbeen disposed of by burning at Illol, Sabarkanta District. From the<br \/>\nAction Taken Report No.4 it appears the following investigations are<br \/>\nstill pending :\n<\/p>\n<p>a.\tAP Police Personnel who helped the ATS, Gujarat in picking<br \/>\nup the accused are yet to be identified. Cooperation of DGP &amp;<br \/>\nIGP, AP has been enlisted in this regard.\n<\/p>\n<p>b.\tApprehension of accused of Rajasthan for which help of DGP<br \/>\n&amp; IGP Rajasthan is been enlisted.\n<\/p>\n<p>c.\tReports from Directorate of Forensic Science, Gujarat State.<br \/>\nd.\tIdentification of the farm house to which Kausarbi was shifted<br \/>\nand method by which she may have died and those involved in<br \/>\nthe crime if any.\n<\/p>\n<p>10.\tFrom the said report, it also appears that the charge sheet shall<br \/>\nbe filed as soon as the evidence comes on record.\n<\/p>\n<p>11.\tHaving heard the learned counsel appearing for the parties and<br \/>\nafter examining the interim reports as well as Action Taken Reports<br \/>\nfiled by the State, it is difficult for us to come to a conclusion at this<br \/>\nstage that the investigation are not proceeding towards correct<br \/>\ndirection.\n<\/p>\n<p>12.\tMr. Tulsi learned senior counsel appearing for the state of<br \/>\nGujarat submitted as noted herein earlier, that the final report shall be<br \/>\nsubmitted within four to six weeks from 15th May, 2007. In this view<br \/>\nof the matter and in view of our discussions made herein above, we<br \/>\nare of the view that at this stage we do not find any reason to hand<br \/>\nover the investigation to the CBI from the State of Gujarat, nor we<br \/>\nfeel it appropriate to direct the State of Gujarat at this stage to include<br \/>\nMr. Raigar with Mrs. Johri for completing the investigation.<br \/>\nAccordingly we pass the following orders:-\n<\/p>\n<p>a)\tState of Gujarat is directed to submit its final report on<br \/>\n3rd July, 2007.\n<\/p>\n<p>b)\tIn the Action Taken Report No.4 it has been stated that<br \/>\nthe investigation is still pending in respect of four items which<br \/>\nhave been enlisted herein earlier. Accordingly, we direct the<br \/>\nState of Gujarat to submit the final report on such investigation<br \/>\non or before the next date of hearing.\n<\/p>\n<p>c)\tWe also direct the State of Gujarat to file an appropriate<br \/>\naffidavit stating all facts relating to the investigation which<br \/>\nhave been brought to our notice by Status\/Action Taken<br \/>\nReports in this Court.\n<\/p>\n<p>d)\tConsidering the fact that the motive for committing the<br \/>\nmurder is yet to be known and in order to establish motive,<br \/>\ninvestigation may have to be conducted also in two other<br \/>\ndifferent States, namely, State of Rajasthan and State of Andhra<br \/>\nPradesh, we direct the State of Andhra Pradesh and the State of<br \/>\nRajasthan and their high police officials to cooperate with the<br \/>\nInvestigating Agency of the State of Gujarat.\n<\/p>\n<p>e) \tThe Investigating Agency shall submit a report on the<br \/>\ninvestigation to this Court only and there is no necessity for the<br \/>\nInvestigating Agency to take permission from the Director<br \/>\nGeneral of Police, Gujarat in the matter of investigation nor the<br \/>\nDGP shall interfere with such investigation to be conducted by<br \/>\nthe Investigating Agency.\n<\/p>\n<p>13.\tBefore parting with this order, we may keep it in mind that under the<br \/>\nlaw, there is a presumption that if the dead body is not found or the<br \/>\nperson concerned is not found for a period of seven years, only then<br \/>\nthe said person can be presumed to be dead. From the record, till<br \/>\ntoday no proof of death of Kausarbi has been brought on record. We<br \/>\nwill take up this issue on the next date of hearing when the reports as<br \/>\ndirected shall be placed before us.\n<\/p>\n<p>14.
