JUSTICE DINESH MAHESHWARI\n\n    Mr.Manoj Bohra,for the petitioner.\n    Mr.B.L.Bhati,for the respondents.\n                              ....\n\n    BY THE COURT<\/pre>\n<p>          This writ petition was filed on 17.03.2006 with the<\/p>\n<p>    submissions that the petitioner was a student of 10th standard<\/p>\n<p>    studying in the respondent No.2 school and he filled up the<\/p>\n<p>    examination form whereupon the respondent No.1 Board sent<\/p>\n<p>    the admission card having the petitioner&#8217;s roll number<\/p>\n<p>    0443973. The petitioner stated the grievance that the<\/p>\n<p>    admission card was illegally detained by the respondent No.2<\/p>\n<p>    and, though permitted to appear in the Secondary School<\/p>\n<p>    Examination 2006 on 9th and 10th March 2006, he was not<\/p>\n<p>    allowed to appear thereafter in other appers.<\/p>\n<p>          The submissions and contentions on the part of the<\/p>\n<p>    petitioner were noticed by this Court on 20.03.2006 and, while<\/p>\n<p>    issuing notices, by way of an interim order, the petitioner was<\/p>\n<p>    permitted to take examination of the remaining papers at the<\/p>\n<p>    centre and on the roll number on which he was permitted to<\/p>\n<p>    take two papers earlier subject, of course, to the final decision<\/p>\n<p>    of this writ petition. This Court observed and ordered thus:<br \/>\n<span class=\"hidden_text\">                                                                  2<\/span><\/p>\n<p>               &#8220;Learned counsel for the petitioner contends<br \/>\n       that the petitioner was earlier issued admission card<br \/>\n       for taking Secondary School Examination conducted<br \/>\n       by the respondent No.1, however, the School<br \/>\n       concerned [respondent No.2] is alleged to have<br \/>\n       returned the admission card on the allegation of the<br \/>\n       petitioner not fulfilling the requirements of the<br \/>\n       minimum attendance.\n<\/p>\n<p>               Learned counsel for the petitioner contends<br \/>\n       that in the first place the School concerned had<br \/>\n       informed the Board about the completion of the<br \/>\n       attendance requirements and the school authorities<br \/>\n       then informed the guardian of the petitioner that he<br \/>\n       was being deprived of appearing in examination<br \/>\n       because of his poor performance that might lead to<br \/>\n       adverse result. Learned counsel informs that the<br \/>\n       petitioner has already taken two papers of the<br \/>\n       examination and if deprived of his chance to appear<br \/>\n       in remaining papers, he would suffer irreparable<br \/>\n       injury.\n<\/p>\n<p>             Issue notice to the respondents to show<br \/>\n       cause as to why this petition be not admitted.<\/p>\n<p>               In the meanwhile and until further orders,<br \/>\n       petitioner shall not be prevented from taking the<br \/>\n       examination of the remaining papers at the centre<br \/>\n       and on the roll number on which he had been<br \/>\n       permitted to take two earlier papers. However, it is<br \/>\n       made clear that this shall only be an interim<br \/>\n       arrangement and shall remain subject to the final<br \/>\n       decision of this writ petition and shall not invest the<br \/>\n       petitioner with any additional right.&#8221;\n<\/p>\n<p>\n      It appears that the petitioner could not take three papers<\/p>\n<p>i.e., Sanskrit, Science-I, and Science-II that were held prior to<\/p>\n<p>the interim order passed by this Court and he moved a second<\/p>\n<p>stay application on 22.07.2006 seeking directions against the<\/p>\n<p>respondents that he may be permitted to take such papers in<\/p>\n<p>supplementary examination. This Court, however, proceeded<\/p>\n<p>to reject the second stay application          on 01.08.2006; and<\/p>\n<p>declined the relief with the observations that the petitioner<\/p>\n<p>having not completed the attendance, no permission could be<br \/>\n<span class=\"hidden_text\">                                                                         3<\/span><\/p>\n<p>         given him to appear in the supplementary examination.<\/p>\n<p>               Even though this matter has remained pending for<\/p>\n<p>         service on the respondent No.3 (the District Education Officer,<\/p>\n<p>         Jodhpur) but a reply to the show cause notice has been filed<\/p>\n<p>         on behalf of the respondent No.1 and it has categorically been<\/p>\n<p>         stated that the petitioner&#8217;s was a case of unreasonable<\/p>\n<p>         shortage of attendance inasmuch as he attended only 162 out<\/p>\n<p>         of 316 meetings. It is submitted that the petitioner&#8217;s attendance<\/p>\n<p>         at 51.26% had been well below the required minimum<\/p>\n<p>         attendance at 75% and hence, he was not eligible to appear in<\/p>\n<p>         the examination and in fact, he was never permitted to take<\/p>\n<p>         the said examination.\n<\/p>\n<p>               The facts as stated in detail by the respondents about<\/p>\n<p>         shortage of the attendance of the petitioner have not been<\/p>\n<p>         controverted and in view of      such   facts, the petitioner is<\/p>\n<p>         obviously not entitled to any relief and there appears no<\/p>\n<p>         reason to keep this writ petition pending for service of the<\/p>\n<p>         respondent No.3.\n<\/p>\n<p>               Accordingly, this petition stands dismissed.<\/p>\n<p>                                         (DINESH MAHESHWARI), J.\n<\/p>\n<p>s.soni\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Poosa Ram Saini vs Board Of Secondary Education &amp; Ors on 28 January, 2009 1 4 S.B.
