Justice ANTONY DOMINIC\n\n Dated :25\/06\/2008\n\n O R D E R\n                          ANTONY DOMINIC, J.\n\n                        ===============\n                     W.P.(C) NO. 17152 OF 2008 - P\n                    ====================\n\n                 Dated this the 25th day of June, 2008\n\n                             J U D G M E N T\n<\/pre>\n<p>       Petitioner submits that he has defaulted payments to the 3rd<\/p>\n<p>respondent and for realising the amount due. Recovery proceedings were<\/p>\n<p>initiated. While the proceedings were pending, the 3rd respondent<\/p>\n<p>announced a One Time Settlement Scheme and the petitioner&#8217;s request for<\/p>\n<p>extending the benefit of scheme was accepted by the 3rd respondent.<\/p>\n<p>Accordingly, terms for settlement were informed to the petitioner and the<\/p>\n<p>petitioner paid the entire amount due. However, for non payment of the<\/p>\n<p>collection charges due under the Revenue Recovery Act, the 2nd<\/p>\n<p>respondent is not issuing an NOC in order to enable the 3rd respondent to<\/p>\n<p>release the documents of title deposited by the petitioner. When the<\/p>\n<p>petitioner made a request to the 3rd respondent for releasing the title<\/p>\n<p>deeds, he was informed that it was because of the non issuance of NOC<\/p>\n<p>they could not release the title deeds. It is in such circumstances, writ<\/p>\n<p>petition has been filed.\n<\/p>\n<p>       2.    It is true that as the petitioner was a defaulter, recovery<\/p>\n<p>proceedings were initiated, but then it was otherwise than in the course of<\/p>\n<p>WPC No.17152\/08<\/p>\n<p><span class=\"hidden_text\">                                      : 2 :<\/span><\/p>\n<p>recovery proceedings that the liability was settled. In such circumstances,<\/p>\n<p>in view of the judgment rendered by this court in <a href=\"\/doc\/1658487\/\">Bhaskaran v. Sub<\/p>\n<p>Registrar<\/a> (2005(3) KLT 150) , collection charges cannot be realised.<\/p>\n<p>       3.    Since the petitioner has settled the liability availing of the<\/p>\n<p>benefit of One Time Settlement Scheme, collection charges is not payable<\/p>\n<p>and the insistence of the 2nd respondent for payment of the collection<\/p>\n<p>charges for issuing NOC is illegal.        For this reason, I direct the 3rd<\/p>\n<p>respondent to release the title deeds deposited by the petitioner without<\/p>\n<p>insisting on an NOC from the 2nd respondent.\n<\/p>\n<p>       Writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                               ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.C.
