(ORAL)\n<\/pre>\n<p>              Present petition has been filed by Lajpat Rai. Petitioner was<\/p>\n<p>running a shop, when on 16th September, 1986 at 9.00 a.m., Food<\/p>\n<p>Inspector visited the premises of the petitioner and bought the sample of<\/p>\n<p>Haldi Sabut. The sample was sent to the public analyst. As per the report<\/p>\n<p>of public analyst, the sample was not in accordance with the<\/p>\n<p>specifications laid in the Prevention of Food Adulteration Act and Rules.<\/p>\n<p>On 2nd May, 1997, Additional Chief Judicial Magistrate, Hisar had<\/p>\n<p>convicted and sentenced the petitioner to undergo rigorous imprisonment<\/p>\n<p>for six months and to pay fine of Rs.1000, in default of payment of fine to<\/p>\n<p>further undergo one month.\n<\/p>\n<p><span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                        2<\/span><\/p>\n<p>             Aggrieved against the same, petitioner had filed an appeal.<\/p>\n<p>The appellate Court upheld the findings of the trial Court and had<\/p>\n<p>maintained the conviction and sentence.\n<\/p>\n<\/p>\n<p>             Mr. S.K. Garg Narwana has very fairly stated that he will not<\/p>\n<p>be in a position to assail the conviction of the petitioner in view of the<\/p>\n<p>findings of conviction recorded by two courts below. Mr. Garg has<\/p>\n<p>however, stated that he is conscious that this Court cannot re-appreciate<\/p>\n<p>and do re-appraisal of the evidence. Mr. Garg has stated that petitioner<\/p>\n<p>has undergone six days of actual sentence. He has further submitted<\/p>\n<p>that in the present case, sample was drawn on 16th September, 1986,<\/p>\n<p>therefore, about 22 years are going to elapse and the right of speedy<\/p>\n<p>trial vest in the petitioner under Article 21 of the Constitution of India. It<\/p>\n<p>has further been submitted that petitioner is in the corridors of Court<\/p>\n<p>since last 22 years and he has suffered a protracted trial. He has relied<\/p>\n<p>upon a single Bench judgment of this Court in Mahavir vs. State<\/p>\n<p>through Govt. Food Inspector, 2000(4) RCR (Criminal) 208, wherein it<\/p>\n<p>was held as under:\n<\/p>\n<blockquote><p>             &#8220;6. Learned counsel for the petitioner, however,<br \/>\n      further contends that the occurrence in this case pertains to<br \/>\n      the year 1984, to be precise, February 17, 1984 and a<br \/>\n      period of 16 years has already gone by. Petitioner has<br \/>\n      already suffered the agony of protracted trial, spanning over<br \/>\n      a period of one and half decades. Petitioner was 40 years of<br \/>\n      age at the time of occurrence and further that he was<br \/>\n      already undergone sentence for a period of 25 days. For the<br \/>\n      contention that petitioner should be dealt with leniently in<br \/>\n      these circumstances his counsel relies upon <a href=\"\/doc\/816764\/\">Manoj Kumar<br \/>\n      v. State of Haryana,<\/a> 1998(1) RCR 563. Learned State<br \/>\n      counsel has, of course, been able to defend this case on<br \/>\n      merits but practically has nothing to say insofar as reduction<br \/>\n      of sentence imposed upon the petitioner is concerned.<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                             3<\/span><\/p>\n<blockquote><p>             7. In totality of the facts and circumstances of this<br \/>\n      case, the Court is of the view that ends of justice would be<br \/>\n      met if sentence imposed upon the petitioner is reduced to<br \/>\n      the one already undergone by him. So ordered. Order of<br \/>\n      payment of fine and so also consequences in default thereof<br \/>\n      are, however, maintained. Learned counsel for the petitioner<br \/>\n      informs the Court that fine has already been paid.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>             He has also placed reliance upon another single Bench<\/p>\n<p>judgment <a href=\"\/doc\/789477\/\">Des Raj vs. State of Haryana,<\/a> 1995(XXII) Criminal Law Times<\/p>\n<p>(482), which reads as under:\n<\/p><\/blockquote>\n<blockquote><p>      &#8220;9. Now, it is well settled that the right to speedy and<br \/>\n      expeditious trial is one of the most valuable and cherished<br \/>\n      rights guaranteed under the Constitution. Fundamental<br \/>\n      rights are not a teasing illusion to be mocked at. These are<br \/>\n      meant to be enforced and made a reality. Fair, just and<br \/>\n      reasonable     procedure       implicit   in   Article   21   of   the<br \/>\n      Constitution creates a right in the accused to be tried<br \/>\n      speedily. Right to speedy trial is the right of the accused.<br \/>\n      The fact that a speedy trial is also in public interest or that it<br \/>\n      serves the social interest also, does not make it any-the-<br \/>\n      less right of the accused. Right to speedy trial flowing from<br \/>\n      Article 21 encompasses all the stages, namely the stage of<br \/>\n      investigation, inquiry, trial, appeal, revision and retrial. This<br \/>\n      is how the courts shall understand this right; and have gone<br \/>\n      to the extent of quashing the prosecution after such<br \/>\n      inordinate delay in concluding the trial of an accused<br \/>\n      keeping in view the facts and circumstances of the case.<br \/>\n      Keeping a person in suspended animation for 8 years or<br \/>\n      more without any case at all cannot be with the spirit of the<br \/>\n      procedure established by law. It is correct that although<br \/>\n      minimum sentence to be imposed upon a convict is<br \/>\n      prescribed by the statute yet keeping in view the provisions<br \/>\n      of Article 21 of the Constitution of India and the<br \/>\n      interpretation thereof qua the right of an accused to a<br \/>\n      speedy trial, judicial compassion can play a role and a<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                     4<\/span><\/p>\n<p>      convict can be compensated for the mental agony which he<br \/>\n      undergoes on account of protracted trial due to the fault of<br \/>\n      the prosecution by this Court in the exercise of its extra-<br \/>\n      ordinary jurisdiction.\n<\/p><\/blockquote>\n<blockquote><p>      10.    An identical question had arisen before the apex<br \/>\n      Court in Braham Dass&#8217;s case (supra), wherein their lordship<br \/>\n      were pleased to observe as under:\n<\/p><\/blockquote>\n<blockquote><p>             &#8216;Coming to the question of sentence, we find that the<br \/>\n      appellant had been acquitted by the trial Court and High<br \/>\n      Court while reversing the judgment of acquittal made by the<br \/>\n      appellate Judge has not made clear reference to clause (f).<br \/>\n      The occurrence took place about more than 8 years back.<br \/>\n      Records show that the appellant has already suffered a part<br \/>\n      of the imprisonment. We do not find any useful purpose<br \/>\n      would be served in sending the appellant to jail at this point<br \/>\n      of time for undergoing the remaining period of the sentence,<br \/>\n      though ordinarily in an anti-social offence punishable under<br \/>\n      the Prevention of Food Adulteration Act the Court should<br \/>\n      take strict view of such matter.&#8217;<br \/>\n             This view was followed by this Court in <a href=\"\/doc\/1750928\/\">Nand Lal v.<br \/>\n      State of Haryana, and Ishwar Singh&#8217;s<\/a> case (supra). The<br \/>\n      present case is fully covered by the view expressed by the<br \/>\n      apex Court and by this Court in the judgments cited above<br \/>\n      and I have no reason to differ therewith.\n<\/p><\/blockquote>\n<blockquote><p>      11.    For the reasons mentioned above, the conviction of<br \/>\n      the petitioner for an offence under Section 16(1)(a)(i) read<br \/>\n      with Section 7 of the Act is hereby maintained. However,<br \/>\n      keeping in view the facts and circumstances of the case and<br \/>\n      the fact that the petitioner has already faced the agony of<br \/>\n      the protracted prosecution and suffered mental harassment<br \/>\n      for a long period of eight years, his sentence is reduced to<br \/>\n      the period of sentence already undergone. Sentence of fine<br \/>\n      is, however maintained along with its default clause.&#8221;<\/p><\/blockquote>\n<blockquote><p>             He has further brought to my notice a judgment by another<\/p>\n<p>Single Bench of this Court in <a href=\"\/doc\/135697259\/\">Mahabir vs. State of Haryana,<\/a> 1997(3)<\/p>\n<p>RCC (469), wherein following view was taken:\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                      5<\/span><\/p>\n<blockquote><p>             &#8220;The facts indicate that incident pertains to more than<br \/>\n      14 years ago. The short question that thus arises for<br \/>\n      consideration is as to whether it would be appropriate to<br \/>\n      direct the petitioner to undergo the rest of the sentence.<br \/>\n      There is no over-emphasizing the fact that speedy trial<br \/>\n      which is the essence of justice has been lost. A reference of<br \/>\n      some of the precedents in this regard would make the<br \/>\n      position clear. In the case of Manjit Singh vs. The State of<br \/>\n      Punjab, 1993(2) Prevention of Food Adulteration Cases, 67,<br \/>\n      11 years had expired before the revision petition was<br \/>\n      decided. Keeping in view the inordinate delay, the sentence<br \/>\n      was reduced to the one already undergone. The same<br \/>\n      question again was considered by this Court in the case of<br \/>\n      Pardeep Kumar vs. State (U.T.) Chandigarh, 1994 (1),<br \/>\n      Chandigarh Criminal Cases 58. Therein the sample had<br \/>\n      been taken in the year 1984. 9 years had expired by the<br \/>\n      time the revision petition was heard. Once again the<br \/>\n      sentence was reduced to the one already undergone. The<br \/>\n      view point of the Delhi High Court is the same in the case of<br \/>\n      Vir Singh Chauhan vs. State (Delhi), 1994(2) Chandigarh<br \/>\n      Criminal Cases 253. When the revision came up for<br \/>\n      hearing, 7 years had expired. Learned Single Judge of the<br \/>\n      said Court reduced the sentence to the one already<br \/>\n      undergone. Before the Madhya Pradesh High Court in the<br \/>\n      case of Jamnalal vs. The State of M.P., 1995(1) Prevention<br \/>\n      of Adulteration Cases 78, the same view prevailed.\n<\/p><\/blockquote>\n<blockquote><p>      8.     All these decisions are based in the judgment of the<br \/>\n      Supreme Court in the case of <a href=\"\/doc\/1930672\/\">Braham Dass vs. State of<br \/>\n      Himachal Pradesh, AIR<\/a> 1988 SC 1789. Threin the accused<br \/>\n      had been convicted for selling masur whole. The accused<br \/>\n      had been acquitted by the trial Court, but High Court held<br \/>\n      him guilty. 8 years were lost. Part of the sentence had been<br \/>\n      undergone. The Supreme Court reduced the sentence to<br \/>\n      the one already undergone.\n<\/p><\/blockquote>\n<blockquote><p>      9.     The position in the present case is not different. As<br \/>\n      already noted above, 14 long years have expired, when the<br \/>\n      sample was taken. The petitioner has already undergone a<br \/>\n      part of the sentence. In these circumstances, it will not be in<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                       6<\/span><\/p>\n<p>      the ends of justice that petitioner again to undergo the rest<br \/>\n      of the sentence. Consequently, the sentence must be<br \/>\n      reduced to the one already undergone.\n<\/p><\/blockquote>\n<blockquote><p>      10.    For these reasons, revision petition fails and is<br \/>\n      dismissed, but the sentence is reduced to the one already<br \/>\n      undergone.&#8221;<\/p><\/blockquote>\n<blockquote><p>             Again, reliance has been placed upon a judgment of this<\/p>\n<p>Court in <a href=\"\/doc\/300674\/\">Mohinder Singh vs. State (Chandigarh Administration),<\/a><\/p>\n<p>1997-1 Vol.CXV (Punjab Law Reporter) 623, wherein it has been held as<\/p>\n<p>under:\n<\/p><\/blockquote>\n<blockquote><p>             &#8220;8. The last submission made in this regard was<br \/>\n      pertaining to the sentence. It was argued that incident<br \/>\n      pertains to the year 1980 and the petitioner is facing the<br \/>\n      agony of a prolonged trial and thereafter appeal and the<br \/>\n      revision, 16 years have elapsed. The decision in the case of<br \/>\n      Hyssainara Khatoon and others v. Home Secretary, State of<br \/>\n      Bihar, AIR 1979 SC 1360 had set the law into motion. The<br \/>\n      scope of Article 21 was extended and it was held that<br \/>\n      expeditious disposal of the cases was an integral and<br \/>\n      essential part of the fundamental right to life and liberty. In<br \/>\n      paragraph 5 it was held:\n<\/p><\/blockquote>\n<blockquote><p>             &#8216;Now obviously procedure prescribed by law for<br \/>\n      depriving a person of his liberty cannot be &#8216;reasonable, fair<br \/>\n      and just&#8217; unless that procedure ensures a speedy trial for<br \/>\n      determination of the guilt of such person. No procedure<br \/>\n      which does not ensure a reasonably quick trial can be<br \/>\n      regarded as &#8216;reasonable, fair or just&#8217; and it would fall foul of<br \/>\n      Article 21. There can, therefore, be no doubt that speedy<br \/>\n      trial and by speedy trial, is an integral and essential part of<br \/>\n      the fundamental right to life and liberty enshrined in Article\n<\/p><\/blockquote>\n<blockquote><p>      21.&#8217;<br \/>\n             The same question was considered by a Bench of the<br \/>\n      Patna High Court in State of Bihar v. Ramdaras Ahir and<br \/>\n      others, 1985 Crl. L.J. 584. It was concluded that the word<br \/>\n      &#8216;trial&#8217; would bring within its sweep, the appeal that would be<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                           7<\/span><\/p>\n<p>      pending against such an order. In paragraph 17 the Court<br \/>\n      had held:\n<\/p><\/blockquote>\n<blockquote><p>             &#8216;Therefore, there seems to be no option, but to hold<br \/>\n      that the word &#8216;trial&#8217; in the context of the constitutional<br \/>\n      guarantee of a speedy trial includes within its sweep a<br \/>\n      substantive appeal provided by the Code to the High Court\n<\/p><\/blockquote>\n<blockquote><p>      &#8211; whether against conviction or against acquittal. Thus, it<br \/>\n      would follow that the constitutional right of speedy trial<br \/>\n      envisaged        an   equally    expeditious    conclusion    of   a<br \/>\n      substantive appeal and not merely a technical completion of<br \/>\n      the proceedings in the original Court alone.&#8217;<br \/>\n             Subsequently, the Full Bench of Patna High Court in<br \/>\n      Anurag Baitha v. State of Bihar AIR 1987 Patna 274<br \/>\n      reiterated the same view and in paragraph 11 it was held:<br \/>\n      &#8216;If Art.21 and the right to speedy public trial is not merely a<br \/>\n      twinkling star in the high heavens to be worshipped and<br \/>\n      rendered vociferous lip-service only but in deed is an<br \/>\n      actually meaningful protective provision, then a fortiori<br \/>\n      expeditious      hearing    of    substantive    appeals     against<br \/>\n      convictions is fairly and squarely within the mandate of the<br \/>\n      said Article.&#8217;\n<\/p><\/blockquote>\n<blockquote><p>      9.     Reverting back to the fact of the present case as<br \/>\n      already mentioned above, the incident pertains to a period<br \/>\n      of more than 16 years ago. The petitioner had already<br \/>\n      undergone nearly 2 months of the sentence. As pointed out<br \/>\n      above, fair, just and reasonable procedure is implicit in<br \/>\n      Article 21 of the Constitution. After such a prolonged period,<br \/>\n      though the petition is without merit, it would be inappropriate<br \/>\n      to insist that petitioner can well be sent to undergo the rest<br \/>\n      of the sentence. It would be unfair. Article 21 of the<br \/>\n      Constitution would bring within its sweep, not only<br \/>\n      expeditious trial but disposal of appeals and revisions. The<br \/>\n      fairness to the accused petitioner, therefore, demands in the<br \/>\n      peculiar facts of this case that giving predominance to the<br \/>\n      said article, the sentence should be reduced to the one<br \/>\n      already undergone. Order is made accordingly.&#8221;<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                      8<\/span><\/p>\n<blockquote><p>             In Bihari lal vs. State of (U.T.) Chandigarh 2000(1) RCR<\/p>\n<p>(Criminal) 222, a single Judge of this Court also reiterated the same view<\/p>\n<p>and held as under:\n<\/p><\/blockquote>\n<blockquote><p>             &#8220;5. Section 16 of the Prevention of Food Adulteration<br \/>\n      Act provides that the person found guilty of the offence shall<br \/>\n      be punishable with imprisonment for a term which shall not<br \/>\n      be less than six months but which may extend to three<br \/>\n      years and with fine which shall not be less than one<br \/>\n      thousand rupees. The proviso further provides that in cases<br \/>\n      covered by Clauses (i) and (ii) to Section 15(1) of the Act,<br \/>\n      for adequate and special reasons to be mentioned in the<br \/>\n      judgement,     the   Court     may   impose   a   sentence   of<br \/>\n      imprisonment for a term which shall not be less than three<br \/>\n      months but which may extend to two years and with fine<br \/>\n      which shall not be less than five hundred rupees. Fair, just<br \/>\n      and reasonable procedure implicit in Article 21 of the<br \/>\n      Constitution of India, creates a right in the accused to be<br \/>\n      tried speedily. It is now well settled that the right to speedy<br \/>\n      and expeditious trial is one of the most valuable and<br \/>\n      cherished rights guaranteed under the Constitution. Right<br \/>\n      to speedy trial following from Article 21 encompasses all the<br \/>\n      stages, namely the stage of investigation, inquiry, trial,<br \/>\n      appeal, revision and retrial.\n<\/p><\/blockquote>\n<blockquote><p>             6. <a href=\"\/doc\/531743\/\">In Chander Bhan V. State of Haryana,<\/a> 1996(1)<br \/>\n      Recent Criminal Reports 125, it has been held by this<br \/>\n      Court as under:-\n<\/p><\/blockquote>\n<blockquote><p>          &#8221; It is correct that although minimum sentence to be<br \/>\n          imposed upon a convict is prescribed by the statute yet<br \/>\n          keeping in view the provisions of Article 21 of the<br \/>\n          Constitution of India and the interpretation thereof qua<br \/>\n          the right of an accused to a speedy trial, judicial<br \/>\n          compassion can play a role and a convict can             be<br \/>\n          compensated for the mental agony which he undergoes<br \/>\n          on account of a protracted trial due to the fault of the<br \/>\n          prosecution by this Court in the exercise of its extra-<br \/>\n          ordinary jurisdiction.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                        9<\/span><\/p>\n<blockquote><p>             7. <a href=\"\/doc\/1325692\/\">In Municipal Corporation of Delhi V. Tek Chand<br \/>\n      Bhatia, AIR<\/a> 1980 Supreme Court 380, the Apex Court held<br \/>\n      as under:-\n<\/p><\/blockquote>\n<blockquote><p>          &#8220;Though adulteration of an article of food is a serious<br \/>\n          anti-social offence which must be visited with exemplary<br \/>\n          punishment, it will be rather harsh to pass a sentence of<br \/>\n          imprisonment in the facts and circumstances of the<br \/>\n          instant case.      Under Section 16 as in force at the<br \/>\n          material time, the Court had the discretion for special and<br \/>\n          adequate reasons under proviso to sub-section (1) of<br \/>\n          Section 16 not to pass a sentence of imprisonment. In<br \/>\n          the instant case, the accused is a man aged 75 years.<br \/>\n          The offence was committed more than 11 years ago.<br \/>\n          The order of acquittal was based on the decision of the<br \/>\n          High Court. The samples were taken from sealed tins.<br \/>\n          These are mitigating circumstances.             Accordingly,<br \/>\n          instead     of   passing   a    substantive   sentence     of<br \/>\n          imprisonment, the accused could be sentenced to period<br \/>\n          already undergo and directed to pay a fine.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>             8. <a href=\"\/doc\/1930672\/\">In Braham Dass v. State of Himachal Pradesh,<\/a><br \/>\n      1988 (4) SCC 130, the Supreme Court held as under:-<br \/>\n          &#8220;Coming to the question of sentence, we find that the<br \/>\n          appellant had been acquitted by the trial Court and the<br \/>\n          High Court while reversing the judgement of acquittal<br \/>\n          made by the appellate Judge has not made clear<br \/>\n          reference to clauses (f).      The occurrence took place<br \/>\n          about more than 8 years back. Records show that the<br \/>\n          appellant    has    already    suffered   a   part   of   the<br \/>\n          imprisonment. We do not find any useful purpose would<br \/>\n          be served in sending the appellant to jail at this point of<br \/>\n          time for undergoing period of the sentence, though<br \/>\n          ordinarily in an anti-social offence punishable under the<br \/>\n          Prevention of Food Adulteration Act, the court should<br \/>\n          take strict view of such matter.\n<\/p><\/blockquote>\n<blockquote><p>          While dismissing the appeal, we would, however, limit<br \/>\n          the sentence of imprisonment to be period already<br \/>\n          undergone and sustain the fine along with the default<br \/>\n          sentence.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                      10<\/span><\/p>\n<blockquote><p>             9. All the three cases cited above were under the<br \/>\n      Prevention of Food Adulteration Act.\n<\/p><\/blockquote>\n<blockquote><p>             10. The mitigating circumstance in this case is that<br \/>\n      the petitioner is undergoing the agony of this protracted trial<br \/>\n      for the last more than 15 years and he can be compensated<br \/>\n      suitably by reducing the substance sentence imposed upon<br \/>\n      by him to the one already undergone by him.\n<\/p><\/blockquote>\n<blockquote><p>             11. For the fore-going reasons I reduce the<br \/>\n      substantive sentence of the petitioner to the one already<br \/>\n      undergone by him.       However, the sentence of fine shall<br \/>\n      remain unaltered.&#8221;<\/p><\/blockquote>\n<blockquote><p>             Same view has been reiterated in <a href=\"\/doc\/89093495\/\">Sat Pal vs. State of<\/p>\n<p>Haryana<\/a> 1998(1) RCR (Criminal) 75; <a href=\"\/doc\/595020\/\">Ram Kishan vs. State of<\/p>\n<p>Haryana<\/a> 2000(1) RCR (Criminal) 196; <a href=\"\/doc\/717693\/\">Krishan Kumar Narang vs.<\/p>\n<p>State (U.T.) Chandigarh<\/a> 2005(3)RCR 592 and <a href=\"\/doc\/707961\/\">Tirath Ram vs. State of<\/p>\n<p>Punjab,<\/a> 2007(4) RCR (Criminal) (69), relevant portion of which reads<\/p>\n<p>as under:\n<\/p><\/blockquote>\n<blockquote><p>             &#8220;19. However, keeping in view the fact that the<br \/>\n      petitioner was 50 years of age at the time of recording of his<br \/>\n      statement under Section 313 of the Cr.P.C. and he would<br \/>\n      be, by now, fairly advanced in the age, as also the fact that<br \/>\n      he has faced the agony of criminal proceedings for the last<br \/>\n      more than 16-1\/2 years, I am of the opinion that the<br \/>\n      sentence awarded to him deserves to be reduced to that of<br \/>\n      fine. For this view, I draw support from a judgment of the<br \/>\n      Supreme Court in Sri Krishan Gopal Sharma and another<br \/>\n      v. Government of N.C.T. of Delhi, 1996(2) RCR (Criminal<br \/>\n      591: 1996(1)F.A.C. 258 (SC) and also from the judgment of<br \/>\n      Allahabad High Court in Bhageloo v. State of U.P. and<br \/>\n      another, 1996(2) F.A.C. 199&#8221;<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>             Since in the present case, petitioner has suffered a<\/p>\n<p>protracted trial of 22 years and has undergone about 6 days, I find that<br \/>\n<span class=\"hidden_text\"> Criminal Revision No. 1380 of 1999                                     11<\/span><\/p>\n<p>petitioner is also entitled to the benefit of the consistent view taken by<\/p>\n<p>this Court. Therefore, sentence of the petitioner is reduced to already<\/p>\n<p>undergone. However, sentence of fine is enhanced to Rs.10000\/-.
