Whether the judgment should be reported in the Digest?\n\n\nHEMANT GUPTA, J.\n<\/pre>\n<p>             The challenge in the present writ petition, filed on behalf of<\/p>\n<p>the employees of the Food Corporation of India, is to the retrospective<\/p>\n<p>effect given to Explanation-1 added to Section 17(2)(ii) of the Income Tax<\/p>\n<p>Act, 1961 (for short `the Act&#8217;) inserted by Section 11 of Finance Act, 2007<\/p>\n<p>with effect from 1.4.2002.\n<\/p>\n<p>             Section 17(2)(ii) of the Act, before its amendment was to the<\/p>\n<p>following effect:-\n<\/p>\n<blockquote><p>                     &#8220;17. For the purposes of Sections 15 and 16 and of this<br \/>\n                     Section,<br \/>\n                                  xx                xx              xx<br \/>\n                     (2)    perquisite includes,\n<\/p><\/blockquote>\n<blockquote><p>                      (i)   the value   of rent-free accommodation provided<br \/>\n                     to the assessee by his employer.\n<\/p><\/blockquote>\n<blockquote><p>                     (ii)   the value   of any concession        in the matter of<br \/>\n                     rent respecting any accommodation provided to the<br \/>\n                     assessee by his employer.&#8221;\n<\/p><\/blockquote>\n<blockquote><p> CWP No. 16446 of 2007                                        (2)<\/p>\n<p>             The said provisions became subject matter of challenge<\/p>\n<p>before different High Courts, but attained finality with the judgment of<\/p>\n<p>the Hon&#8217;ble Supreme Court reported         as Arun Kumar and others v.\n<\/p><\/blockquote>\n<p>Union of India and others, (2006) 286 ITR 89 (SC).                 Rule 3 of the<\/p>\n<p>Income Tax Rules, 1962, was amended in the year 2001. The method of<\/p>\n<p>valuation of perquisite on the basis of the population of the city was<\/p>\n<p>substituted.   The argument raised before the Hon&#8217;ble Supreme Court in<\/p>\n<p>the said case was that liability to pay tax will arise only if a concession<\/p>\n<p>shown in the matter of rent in respect of accommodation, is a perquisite<\/p>\n<p>under the Act and that the authority must come to the conclusion that<\/p>\n<p>Section 17(2)(ii) is attracted. Considering the said argument, the Hon&#8217;ble<\/p>\n<p>Supreme Court found that Section 17(2)(ii) of the Act, would apply only<\/p>\n<p>if there is a concession in respect of accommodation. The definition of<\/p>\n<p>perquisite is inclusive in nature and takes         within    its sweep several<\/p>\n<p>matters enumerated in clauses (i) to (vii). Section 17(2)(ii) declares that<\/p>\n<p>the value of any &#8220;concession&#8221; in the matter of rent respecting                any<\/p>\n<p>accommodation provided to the employee by his employer would be a<\/p>\n<p>&#8220;perquisite&#8221;. Nevertheless it must be a &#8220;concession&#8221; in the matter of rent<\/p>\n<p>respecting     any accommodation provided by the employer to his<\/p>\n<p>employee. After finding so, the Court proceeded to hold as under:-<\/p>\n<blockquote><p>                        &#8220;The word &#8220;concession&#8221; has neither been defined<br \/>\n                        in the Act nor in the rules. According             to the<br \/>\n                        Concise Oxford English Dictionary, &#8220;concession&#8221;<br \/>\n                        is &#8220;a thing that is conceded&#8221;; &#8220;a gesture made<br \/>\n                        in   recognition   of   a    demand        or   prevailing<br \/>\n                        standard&#8221;, &#8221; a reduction        in price for a certain<br \/>\n                        category of person&#8221;.        It is a &#8220;grant; ordinarily<br \/>\n                        applied to a grant of specific privileges by<br \/>\n                        Government, a special privilege            granted by a<br \/>\n                        Government, Corporation or other authority&#8221;<br \/>\n                        (P.R. Aiyer, Advanced Law Lexican, 2005; Vol.I;<\/p><\/blockquote>\n<p>                        page 944). It is &#8220;an act of yielding or conceding<br \/>\n CWP No. 16446 of 2007                                         (3)<\/p>\n<p>                    as   to   a    demand           or   argument;      something<br \/>\n                    conceded; usually employing a demand; claim or<br \/>\n                    request&#8221;,      &#8220;a thing yielded&#8221;,           &#8220;a grant&#8221; [<a href=\"\/doc\/104511\/\">Indian<br \/>\n                    Aluminium       Co.        Ltd.      v.   Thane        Municipal<br \/>\n                    Corporation<\/a>       [1992]          Supp      1     SCC      480].\n<\/p>\n<p>                    &#8220;Concession&#8221;          is    a     form    of    &#8220;privilege&#8221;     [V.\n<\/p>\n<p>                    Pechimuthu v. Gowammal [2001] 7 SCC 617].\n<\/p>\n<p>                          It is, therefore clear that before section 17<br \/>\n                    (2)(ii) can be invoked or pressed into service and<br \/>\n                    before calculation of concession as per rule 3 is<br \/>\n                    made, the authority exercising power must come<br \/>\n                    to a positive conclusion that it is a concession.\n<\/p>\n<p>                    &#8220;Concession&#8221;,         in our judgment is, thus a<br \/>\n                    foundational, functional or jurisdictional fact.&#8221;\n<\/p>\n<pre>                                   xxx                xxx            xxx\n                          In our opinion, the submission of Mr.\n                    Salve is well founded                and deserves         to be\n<\/pre>\n<p>                    accepted that &#8220;concession&#8221; under sub-clause (ii)<br \/>\n                    of clause (2) of section 17 of the Act is a<br \/>\n                    &#8220;jurisdictional fact&#8221;.          It is only when there is a<br \/>\n                    &#8220;concession&#8221;      in the          matter of rent respecting<br \/>\n                    any accommodation provided by an employer to<br \/>\n                    his employee that the mode, method or manner<br \/>\n                    as to how such concession can be computed<br \/>\n                    arises.   In    other      words,          concession      is    a<br \/>\n                    &#8220;jurisdictional fact&#8221;;          the method of fixation of<br \/>\n                    amount is a &#8220;fact in issue&#8221; or &#8220;adjudicatory fact&#8221;.\n<\/p>\n<pre>                    If the assessee contends                  that there is no\n                    \"concession\", the authority has to decide                       the\n<\/pre>\n<p>                    said question and record a finding as to whether<br \/>\n                    there is a &#8220;concession&#8221; and               the case is covered<br \/>\n                    by Section 17(2)(ii) of the Act. Only thereafter<br \/>\n                    may the authority proceed                   to calculate the<br \/>\n                    liability of the assessee under the rules. In our<br \/>\n                    considered opinion, therefore, inspite of the legal<br \/>\n                    position that rule 3 is intra vires, valid and is not<br \/>\n                    inconsistent with the provisions of the parent Act<br \/>\n                    under Section 17(2)(ii) of the Act, it is still open<br \/>\n                    to the assessee to contend that there is no<br \/>\n CWP No. 16446 of 2007                                          (4)<\/p>\n<p>                          &#8220;concession&#8221; in the matter of accommodation<br \/>\n                          provided by the employer to the employee and<br \/>\n                          hence the case did not fall within the mischief of<br \/>\n                          section 17(2)(ii) of the Act.&#8221;\n<\/p>\n<p>              The Hon&#8217;ble Supreme Court further found that Section 17<\/p>\n<p>(2)(ii) does not contain any deeming clause that once it is established<\/p>\n<p>that an employee is paying rent less than 10% of his salary in cities<\/p>\n<p>having population of 4 lacs and 7.5 per cent, in other cities, it should<\/p>\n<p>be deemed      to be a &#8220;concession&#8221; within the meaning of the Act. The<\/p>\n<p>Hon&#8217;ble Supreme Court concluded that Rule 3 would apply only to<\/p>\n<p>those cases where a &#8220;concession&#8221; has been shown by the employer in<\/p>\n<p>favour   of   an   employee     in   the      matter   of   rent     respecting   any<\/p>\n<p>accommodation. The argument that Rule 3 is discriminatory creating<\/p>\n<p>distinction between the employees of the Central Government and the<\/p>\n<p>State Governments and other employees i.e. employees of companies;<\/p>\n<p>corporations and other undertakings, did not find favour with the<\/p>\n<p>Hon&#8217;ble Supreme Court. The Court found the aforesaid classification to<\/p>\n<p>be a reasonable classification based on Intelligible Differentia. The same<\/p>\n<p>was found to have reasonable rational nexus with the object sought to<\/p>\n<p>be achieved and, thus, it was found that such provision cannot be held<\/p>\n<p>ultra-vires to Article 14 of the Constitution of India.<\/p>\n<p>              By virtue of Section 11 of the Finance Act, 2007, an<\/p>\n<p>explanation has been added giving deemed meaning to the word<\/p>\n<p>&#8220;concession&#8221;. Such explanation has been incorporated with effect from<\/p>\n<p>1.4.2002 i.e. to cover the period in respect of amended Rule 3 of the<\/p>\n<p>Rules. Section 11(b) of the Finance Act, 2007 reads as under:-<\/p>\n<blockquote><p>                   &#8220;11.   In Section 17 of the Income Tax,<br \/>\n                            xxx         xxx        xxx\n<\/p><\/blockquote>\n<blockquote><p>                   (b)    in clause (2),<br \/>\n                          (A) after sub-clause (ii),\n<\/p><\/blockquote>\n<blockquote><p>                          (i)     the    following       Explanations     shall    be<br \/>\n CWP No. 16446 of 2007                                    (5)<\/p>\n<p>                     inserted and shall be deemed to have been<br \/>\n                     inserted with effect from 1st day of April, 2002,<br \/>\n                     namely:-\n<\/p><\/blockquote>\n<blockquote><p>                     Explanation 1.        For the purposes of this sub-<br \/>\n                     clause, concession in the matter of rent shall be<br \/>\n                     deemed to have been provided if,\n<\/p><\/blockquote>\n<blockquote><p>                     (a)   in     a   case       where    an      unfurnished<br \/>\n                     accommodation is provided by any employer<br \/>\n                     other than the Central Government or any State<br \/>\n                     Government and\n<\/p><\/blockquote>\n<blockquote><p>                           (i)    the accommodation is owned by the<br \/>\n                           employer, the value of the accommodation<br \/>\n                           determined at the rate of ten per cent of<br \/>\n                           salary     in    cities       having    population<br \/>\n                           exceeding four lakhs as per 1991 census<br \/>\n                           and seven and one-half per cent of salary<br \/>\n                           in other cities, in respect of the period<br \/>\n                           during which the said accommodation was<br \/>\n                           occupied        by   the   assessee    during   the<br \/>\n                           previous year, exceeds the rent recoverable<br \/>\n                           from, or payable by, the assessee;<\/p><\/blockquote>\n<blockquote><p>                           (ii)   the accommodation is taken on lease<br \/>\n                           or rent by the employer, the value of the<br \/>\n                           accommodation being the actual amount<br \/>\n                           of lease rental paid or payable by the<br \/>\n                           employer or ten             per cent of salary,<br \/>\n                           whichever is lower, in respect of the period<br \/>\n                           during which the said accommodation was<br \/>\n                           occupied        by   the   assessee    during   the<br \/>\n                           previous         year,     exceeds      the     rent<br \/>\n                           recoverable from, or payable              by, the<br \/>\n                           assessee;<\/p><\/blockquote>\n<p>               (b)   In a case where a furnished accommodation is<br \/>\n               provided by the Central Government or any State<br \/>\n               Government, the licence fee determined by the Central<br \/>\n               Government or any State Government in respect of the<br \/>\n               accommodation in accordance with the rules framed<br \/>\n               by such Government as increased by the value of<br \/>\n               furniture and fixtures in respect of the period during<br \/>\n CWP No. 16446 of 2007                                               (6)<\/p>\n<p>               which the said accommodation was occupied by the<br \/>\n               assessee       during       the    previous         year,    exceeds      the<br \/>\n               aggregate of the rent recoverable from, or payable by,<br \/>\n               the assessee and any charges paid or payable for the<br \/>\n               furniture and fixtures by the assessee;\n<\/p>\n<p>               (c) in a case where a furnished accommodation is<br \/>\n               provided       by     an    employer           other        than     Central<br \/>\n               Government or any State Government and\n<\/p>\n<p>                      (i)      the     accommodation               is     owned    by    the<br \/>\n                      employer,        the       value   of    the        accommodation<br \/>\n                      determined under sub-clause (i) of clause (a) as<br \/>\n                      increased           by the value of the furniture                  and<br \/>\n                      fixtures in respect of the period during which the<br \/>\n                      said     accommodation             was        occupied       by    the<br \/>\n                      assessee during the previous year, exceeds the<br \/>\n                      rent     recoverable         from,      or        payable    by,   the<br \/>\n                      assessee;<\/p>\n<pre>\n                      (ii)     the accommodation is taken on lease or\n                      rent     by     the        employer,     the         value    of   the\n<\/pre>\n<p>                      accommodation determined under sub-clause (ii)<br \/>\n                      of clause (a)          as increased by the value of the<br \/>\n                      furniture and fixtures               in respect of the period<br \/>\n                      during which the said accommodation was<br \/>\n                      occupied        by the assessee during the previous<br \/>\n                      year, exceeds the rent recoverable from, or<br \/>\n                      payable by, the assessee;\n<\/p>\n<p>               (d)    in a case where the accommodation is provided<br \/>\n               by the employer in a hotel (except where the assessee<br \/>\n               is provided such accommodation for a period not<br \/>\n               exceeding in          aggregate fifteen days               on his transfer<br \/>\n               from     one    place       to     another),        the     value    of   the<br \/>\n               accommodation determined at the rate of twenty-four<br \/>\n               per cent       of salary paid         or payable for the previous<br \/>\n               year or the actual charges paid or payable to such<br \/>\n               hotel, whichever is lower, for the period during which<br \/>\n               such accommodation is provided, exceeds                             the rent<br \/>\n               recoverable from, or payable by the assessee.&#8221;<\/p>\n<p>          Learned counsel for the petitioners has vehemently argued<br \/>\n CWP No. 16446 of 2007                                    (7)<\/p>\n<p>that by inserting the aforesaid explanation, the judgment of the Hon&#8217;ble<\/p>\n<p>Supreme Court in Arun Kumar&#8217;s case, is sought to be set at naught and<\/p>\n<p>therefore, the amendment       is illegal. It is also contended that such<\/p>\n<p>amendment creates     liability of tax   with retrospective effect and   thus,<\/p>\n<p>affects the rights of the petitioner adversely and, therefore, cannot be given<\/p>\n<p>effect to.   In support of his contention, the learned counsel for the<\/p>\n<p>petitioners has relied upon <a href=\"\/doc\/1945591\/\">Lohia Machines Ltd. and others v. Union of<\/p>\n<p>India and others<\/a>, (1985) 152 ITR 308 (SC); Kardicoppal Estate v. State of<\/p>\n<p>Karnataka and another, (2004) 266 ITR 20 (KARN); <a href=\"\/doc\/1053542\/\">D. Cawasji and Co. v.<\/p>\n<p>State of Mysore and others<\/a>, (1984)150 ITR 648 (SC); <a href=\"\/doc\/994554\/\">State of Punjab v.<\/p>\n<p>Nestle India Ltd. and<\/a> another, (2004) 269 ITR 97 (SC); <a href=\"\/doc\/1269046\/\">K. Veeraswami v.<\/p>\n<p>Union of India,<\/a> (1991) 3 SCC 655; Voltas India Ltd. v. Union of India,<\/p>\n<p>AIR 1995 SC 1881 and Radha Krishna Punchithaya v. H. Sanjeeva Rao,<\/p>\n<p>AIR 1963 KER 348.\n<\/p>\n<p>             We have heard learned counsel for the parties at length, but<\/p>\n<p>do not find any merit in the present petition.\n<\/p>\n<p>             The Hon&#8217;ble Supreme Court in Arun Kumar&#8217;s case (supra),<\/p>\n<p>has categorically noticed that the word &#8220;concession&#8221; has not been defined<\/p>\n<p>under the Act. Since     an omission was found        in the statute by the<\/p>\n<p>Hon&#8217;ble Supreme Court, the said omission was rectified by inserting<\/p>\n<p>explanation in question with retrospective effect. It is well settled that<\/p>\n<p>the legislative power either to introduce enactment for the first time or to<\/p>\n<p>amend the enacted law with retrospective effect, is not only subject to<\/p>\n<p>competence, but also subject to several judicially recognised limitations.<\/p>\n<p>The first is that amendment must provide or clearly imply retrospective<\/p>\n<p>operation. Keeping in view the specific language of Section 11 of the<\/p>\n<p>amending Act, the first test      in respect of retrospective effect of the<\/p>\n<p>explanation is satisfied. Another test is      that where the legislative is<\/p>\n<p>intending to overcome a judicial decision, the power cannot be used to<\/p>\n<p>subvert the decision without removing the basis of the decision. The<br \/>\n CWP No. 16446 of 2007                                      (8)<\/p>\n<p>Hon&#8217;ble Supreme Court in Arun Kumar&#8217;s case (supra), has categorically<\/p>\n<p>and clearly found that the word &#8220;concession&#8221; has not been defined and it<\/p>\n<p>does not contain any deeming clause. The said deficiency has been met<\/p>\n<p>by an insertion of Explanation-I. The insertion of explanation is not to<\/p>\n<p>subvert the decision of the Court, but to meet out the deficiency pointed<\/p>\n<p>out by the Court.    Therefore, it cannot be said that the amendment is to<\/p>\n<p>subvert the judicial decision.\n<\/p>\n<p>              In Goodricke Group Ltd. v. State of West Bengal and<\/p>\n<p>others, 1995 Supl. (1) SCC 707, it was held by the Hon&#8217;ble Supreme<\/p>\n<p>Court that once the defect pointed out is rectified and remedied in the<\/p>\n<p>impugned enactment, it can certainly be given retrospective effect           to<\/p>\n<p>cover the period covered by the earlier enactment which is not only a well<\/p>\n<p>known but a frequently adopted measure by all the legislatures. It was<\/p>\n<p>held to the following effect:-\n<\/p>\n<blockquote><p>                          &#8220;Lastly, the learned counsel for the petitioners<br \/>\n                          questioned the validity of the retrospective effect<br \/>\n                          given to the impugned enactment. We fail to see<br \/>\n                          any substance in this submission. If the Act is<br \/>\n                          good,   it   is    good   both   prospectively    and<br \/>\n                          retrospectively.    Retrospective effect is given for<br \/>\n                          the period covered by the anterior provisions<br \/>\n                          which were struck down in Buxa Dooars Tea Co.<br \/>\n                          Ltd. v. State of W.B., (1989) 3 SCC 211. Once we<br \/>\n                          hold that the defect pointed out in Buxa Dooars<br \/>\n                          is rectified and remedied         in the impugned<br \/>\n                          enactment, it can certainly be given retrospective<br \/>\n                          effect to cover the period covered by the earlier<br \/>\n                          enactment which is not only a well known but a<br \/>\n                          frequently      adopted   measure      by   all   the<br \/>\n                          legislatures.<\/p><\/blockquote>\n<p>              In American Remedies Pvt. Ltd. and another v. Govt. of<\/p>\n<p>Andhra Pradesh and another, (1999)2 SCC 117, an argument was<\/p>\n<p>raised that    since assessee has not collected the amount of sales tax<br \/>\n CWP No. 16446 of 2007                                         (9)<\/p>\n<p>from the consumers, therefore, the retrospective effect given to a statute<\/p>\n<p>raising liability to pay the differential amount of tax, is not tenable. It<\/p>\n<p>was held by the Hon&#8217;ble Supreme Court that merely because the<\/p>\n<p>assessee has not collected the tax from the consumers is not a ground<\/p>\n<p>to escape the liability of tax, in respect of retrospective effect to a statute.<\/p>\n<p>             In    National       Agricultural     Cooperative             Marketing<\/p>\n<p>Federation of India Ltd. and another v. Union of India and others,<\/p>\n<p>(2003)5 SCC 23, the Hon&#8217;ble Supreme Court has examined the scope of<\/p>\n<p>legislative powers    in giving retrospective effect to the statutes. It was<\/p>\n<p>held to the following effect:-\n<\/p>\n<blockquote><p>                     &#8220;15. The     legislative   power     either      to    introduce<br \/>\n                     enactments for the first time or to amend the enacted<br \/>\n                     law with retrospective effect, is not only subject to the<br \/>\n                     question of competence but is also subject to several<br \/>\n                     judicially recognised limitations with some of which we<br \/>\n                     are at present concerned. The first is the requirement<br \/>\n                     that the words used must expressly provide or clearly<br \/>\n                     imply retrospective operation. The second is that the<br \/>\n                     retrospectively must be reasonable and not excessive<br \/>\n                     or harsh, otherwise it runs        the risk of being struck<br \/>\n                     down as unconstitutional. The third is apposite where<br \/>\n                     the legislation is introduced to overcome a judicial<br \/>\n                     decision. Here the power cannot be used to subvert the<br \/>\n                     decision without removing the statutory basis of the<br \/>\n                     decision.\n<\/p><\/blockquote>\n<pre>                           xxx           xxx            xxx\n\n                     20.   As    has been held in <a href=\"\/doc\/194832\/\">Ujagar Prints v. Union of\n                     India,<\/a> (1989) 3 SCC 488:-\n<\/pre>\n<blockquote><p>                           &#8220;A competent legislature can always validate a<br \/>\n                           law which has been declared by courts to be<br \/>\n                           invalid, provided the        infirmities   and vitiating<br \/>\n                           infractors noticed in the declaratory judgment<br \/>\n                           are removed or cured. Such a validating law can<br \/>\n                           also be made retrospective.         If in the light     of<br \/>\n                           such validating and curative exercise made by<br \/>\n CWP No. 16446 of 2007                                    (10)<\/p>\n<p>                         the legislature-granting legislative competence &#8211;<\/p><\/blockquote>\n<pre>\n                         the earlier judgment becomes irrelevant            and\n                         unenforceable,    that    cannot       be called an\n                         unenforceable    legislative   overruling    of    the\n<\/pre>\n<blockquote><p>                         judicial decision. All that the legislature does is<br \/>\n                         to usher in a valid law with retrospective effect<br \/>\n                         in the light of which earlier judgment becomes<br \/>\n                         irrelevant.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                               xxx         xxx           xxx<\/p>\n<\/blockquote>\n<blockquote><p>                         22.   Once the circumstances are altered by<\/p>\n<p>                         legislation, it may neutralise the effect of the<\/p>\n<p>                         earlier decision of the Court which becomes<\/p>\n<p>                         ineffective after the change of the law.&#8221;<\/p><\/blockquote>\n<p>              <a href=\"\/doc\/1611825\/\">In   S.S. Bola and others v. B.D. Sardana and others<\/a>,<\/p>\n<p>(1997)8 SCC 522, it was held that what is really prohibited is that the<\/p>\n<p>legislature cannot in exercise of its plenary power under Articles 245 and<\/p>\n<p>246 of the Constitution merely declare a decision of a court of law to be<\/p>\n<p>invalid or to be inoperative in which case it would be held to be an<\/p>\n<p>exercise of judicial power. It was further held that undoubtedly under the<\/p>\n<p>scheme of the Constitution, the legislature does not possess the same.<\/p>\n<p>              Keeping in mind the aforesaid principles,         the act of the<\/p>\n<p>legislature   having   given deemed meaning to the word &#8220;concession&#8221;,<\/p>\n<p>cannot be said to be invalid. Thus, we are of the opinion            that   the<\/p>\n<p>provisions of the amending Act, inserting Explanation-I to Section 17(2)<\/p>\n<p>(ii) giving deemed meaning to the word &#8220;concession&#8221; with retrospective<\/p>\n<p>effect falls within the legislative competence of the Parliament. Such<\/p>\n<p>amendment does not declare a judicial decision to be invalid, but meets<\/p>\n<p>out the deficiency pointed out by the Hon&#8217;ble Supreme Court.<\/p>\n<p>              The argument that the amendment is discriminatory or has<\/p>\n<p>caused onerous financial burden on the petitioner, is again not<\/p>\n<p>sustainable in law.    The argument in respect of discrimination raised on<br \/>\n CWP No. 16446 of 2007                                     (11)<\/p>\n<p>the basis of Rule 3 has been dealt with by the Hon&#8217;ble Supreme Court<\/p>\n<p>in Arun Kumar&#8217;s case (supra). In fact the basis of determination of<\/p>\n<p>concession contained in Rule 3 has been made part of the substantive<\/p>\n<p>provision by inserting      Explanation-I.   The    said explanation      deals<\/p>\n<p>separately   with     the   cases     of   assessee,    where    unfurnished<\/p>\n<p>accommodation is provided        by any employer other than the Central<\/p>\n<p>Government or the State Governments and in respect of furnished<\/p>\n<p>accommodation provided by the Central Government or the State<\/p>\n<p>Governments. Similarly, where the furnished accommodation is provided<\/p>\n<p>by the employer other than the Central Government, the process of<\/p>\n<p>determining concession has been explained.\n<\/p>\n<p>             For the reasons recorded by the Hon&#8217;ble Supreme Court in<\/p>\n<p>Arun Kumar&#8217;s case (supra) holding that the provisions of Rule 3 are not<\/p>\n<p>discriminatory or violative of Article 14 of the Constitution, we also do<\/p>\n<p>not find any merit in the argument raised by the learned counsel for the<\/p>\n<p>petitioner that the provisions of Explanation-I are discriminatory and<\/p>\n<p>thus, violative of Article 14 of the Constitution of India.<\/p>\n<p>             The argument that the petitioner has to meet out the<\/p>\n<p>financial burden with the retrospective effect on account of the<\/p>\n<p>amendment, is again not tenable. In fact, a circular was issued by the<\/p>\n<p>Food Corporation of India      on 31.12.2001 to maintain status quo on<\/p>\n<p>valuation of perquisite for computing income tax charges under the<\/p>\n<p>salary   head   for    residential   accommodation     consequent    to    the<\/p>\n<p>amendment of Rule 3 with effect from 25.9.2001. It appears that Rule 3<\/p>\n<p>was amended to deal with the mode of computation of valuation of<\/p>\n<p>perquisite. The said Rule came to be interpreted before the Hon&#8217;ble<\/p>\n<p>Supreme Court         and it was held that in the absence of any deemed<\/p>\n<p>meaning of word &#8220;concession&#8221;, Rule (3) cannot be applied.          Therefore,<\/p>\n<p>the question of applicability of Rule 3       was pending before the High<br \/>\n CWP No. 16446 of 2007                                 (12)<\/p>\n<p>Courts, which came to be concluded by the judgment of the Hon&#8217;ble<\/p>\n<p>Supreme Court in Arun Kumar&#8217;s case (supra). The issue raised          was<\/p>\n<p>subject to interpretation by the Courts.
