Heard  learned  counsel for the parties.\tThe  special<br \/>\nleave is granted.\n<\/p>\n<p>2.   The  appellant was appointed as a social worker  on  ad<br \/>\nhoc  basis  in 1981.  In the year 1987, he was\tdeclared  to<br \/>\nhave  acquired\tquasi-permanent status.\t His  services\twere<br \/>\nterminated  by\tan order passed simpliciter on\tDecember  3,<br \/>\n1991.\tHe filed a departmental appeal which was  ultimately<br \/>\ndismissed.   He\t thereafter  challenged\t the  order  of\t his<br \/>\ntermination by filing a suit which was later transferred  to<br \/>\nthe  Administrative Tribunal.  The  Administrative  Tribunal<br \/>\ndismissed  the\tsuit on several grounds\t including  that  of<br \/>\nlimitation.  The judgment of the Tribunal is under challenge<br \/>\nbefore us in the present appeal.\n<\/p>\n<p>+ Arising out of SLP No. 1417 of 1992<br \/>\n<span class=\"hidden_text\">74<\/span>\n<\/p>\n<p>3.   It is the admitted position before us that the  appeal,<br \/>\nwhich\thad  been  filed  before  the  department  and\t was<br \/>\nultimately dismissed, was a statutory one.  But the Tribunal<br \/>\nhas  not correctly appreciated the position and has  assumed<br \/>\nthat there was no right of appeal under the statute and that<br \/>\nthe   so-called\t appeal\t of  the  appellant  was  merely   a<br \/>\nrepresentation.\t It therefore held that the transferred suit<br \/>\nwas  barred  by rule of limitation.  If\t the  limitation  is<br \/>\ncalculated from the date when the appeal was dismissed,\t the<br \/>\nsuit was admittedly within time.  We, therefore, reverse the<br \/>\nfinding\t of the Tribunal recorded against the  appellant  on<br \/>\nthe plea of limitation.\n<\/p>\n<p>4.   On\t merits the Tribunal has dismissed the suit  holding<br \/>\nthat  the  Civil  Surgeon who had  initially  appointed\t the<br \/>\nappellant  did\tnot  have any power to do  so.\tThe  learned<br \/>\ncounsel\t for  the respondent has placed\t before\t us  certain<br \/>\nadministrative\t instructions  indicating  that\t the   Civil<br \/>\nSurgeon\t was  subsequently  vested with the  power  in\tthis<br \/>\nregard.\t  Subsequent to this date the Civil Surgeon made  an<br \/>\norder  granting\t quasi-permanent status\t to  the  appellant.<br \/>\nSince,\tthis  order was passed when the\t Civil\tSurgeon\t was<br \/>\nfully  empowered to do so, it is futile to suggest that\t the<br \/>\nappellant cannot be treated to be a quasi-permanent  servant<br \/>\nunder  the State.  Consequently, the order  terminating\t his<br \/>\nservices without holding an inquiry cannot be sustained.  We<br \/>\nare,  therefore, of the view that the appellant is  entitled<br \/>\nto succeed in the suit.\n<\/p>\n<p>5.   The  question now arises as to the relief which  should<br \/>\nbe granted to the appellant at this stage.  We have examined<br \/>\nthe service record of the appellant produced before us,\t and<br \/>\nreferred  to in the order of Tribunal, which indicates\tthat<br \/>\nhe  was\t negligent and repeatedly remained absent  for\tlong<br \/>\nperiods without leave.\tHis services were otherwise also not<br \/>\nsatisfactory.\tThese were the reasons which  compelled\t the<br \/>\nauthorities  concerned\tto take steps  for  terminating\t his<br \/>\nservices.   Although, the manner in which his services\twere<br \/>\nterminated was not in accordance with law, it is clear\tthat<br \/>\nthe  authorities  which\t took  decision\t to  terminate\t his<br \/>\nservices  were acting bona fide and there was  justification<br \/>\nfor  them  to have taken up the question as to\twhether\t the<br \/>\nappellant should be permitted to continue in the service  or<br \/>\nnot.  As, we are interfering in the present matter purely on<br \/>\na technical ground, we are of the view that the appellant is<br \/>\nnot  entitled to the salary for the past  period.   However,<br \/>\nsince  he  has been involved in this litigation,  we  direct<br \/>\nthat  a sum of Rs 5000 (rupees five thousand only) shall  be<br \/>\npaid  to  the appellant as consolidated amount\tagainst\t his<br \/>\ndues  for the back period.  Subject to this, he will not  be<br \/>\nentitled to claim anything for the past period.\n<\/p>\n<p>6.   For the reasons stated above, we allow the appeal,\t set<br \/>\naside the impugned judgment and direct the  respondent-State<br \/>\nto reinstate the appellant with effect from February 1, 1993<br \/>\nand  pay the aforesaid amount of Rs 5000 within\t two  months<br \/>\nfrom  today.
