No.7159\/2010 (s)\n             22\/06\/2010:\n                   Shri Praveen Verma, learned counsel for the petitioner.\n\n                   Shri Rajesh Tiwari, learned Government Advocate on\n             advance notice for the respondents.<\/pre>\n<p>                   Challenging the order dated 19.2.2010 passed by the<br \/>\n             Chief Executive Officer, Janpad Panchayat, Pushparajgarh,<br \/>\n             District Shahdol, withdrawing the powers of Panchayat<br \/>\n             Secretary, petitioner has filed this writ petition. It is common<br \/>\n             ground that in the case of Gram Panchayat Bamrol Vs.<br \/>\n             Jagdish Singh Rawat and others &#8211; 2008(4) MPHT 132 after<br \/>\n             placing reliance on the Circular dated 22.9.93 and provisions<br \/>\n             of Section 69(1) of M.P. Panchayat Raj Avam Gram Swaraj<br \/>\n             Adhniyam, 1993, has held that it is only the Collector who is<br \/>\n             empowered to remove or denotify a Panchyat Secretary from<br \/>\n             the post and Chief Executive Officer does not have any power.\n<\/p>\n<p>                   Considering the aforesaid, this application is allowed.<br \/>\n             Order dated 19.2.2010 is quashed and liberty is granted to the<br \/>\n             Collector or competent authority to proceed further in<br \/>\n             accordance with law.\n<\/p>\n<p>                   Petition stands disposed of with the aforesaid.\n<\/p>\n<p>                   c.c. as per rules.\n<\/p>\n<p>                                                     (Rajendra Menon)<br \/>\n                                                         Judge<br \/>\nMrs.mishra\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Veeran Singh vs The State Of Madhya Pradesh on 22 June, 2010 W.P.
