(J)\n\nCITATION:\n 1996 SCC  (7) 531\t  JT 1996 (3)\t 35\n 1996 SCALE  (2)213\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t       O R D E R<br \/>\n     This appeal  by  special  leave  arises  from  the<br \/>\njudgment and order of the Division Bench of the Gujarat<br \/>\nHigh Court  made on  February 12, 1976 in LPA No.67\/74.<br \/>\nIn Jamnagar alias Nawanagar in Saurashtra Region of the<br \/>\nGujarat State,\tthere  are  four  sets\tof  Muslims  by<br \/>\nname,Gujarati  Aab,   Sidi  and\t Patni.\t The  appellant<br \/>\nrepresenting  Patni   Jamat  made   an\tapplication  on<br \/>\n12.11.1951 to  the Mamlatdar  for  grant  of  occupancy<br \/>\ncertificate in support of Survey Nos.314 and 316 of the<br \/>\nland for  use of  Kabristan etc.  The Mamlatdar granted<br \/>\nthe certificate.  Subsequently, on  representation made<br \/>\nby other  Jamats, their\t names also came to be included<br \/>\nand that  had given  rise  to  the  endless  litigation<br \/>\nculminating in\tthis case.  The\t trial\tCourt  in  Suit<br \/>\nNo.151\/66 decreed  the suit  granting declaration  that<br \/>\nall the Jamats are jointly entitled to use the property<br \/>\nfor Kabristan  etc. Perpetual  injunction  was\tgranted<br \/>\nagainst the  appellant for  interfering with the common<br \/>\nuse. On\t appeal and  second  appeal,  the  trial  Court<br \/>\ndecree stood reversed. In LPA, the Division Bench under<br \/>\nthe impugned judgment, restored the decree of the trial<br \/>\nCourt. Thus, this controversy.\n<\/p>\n<p>     It is  contended  that  the  civil\t Court\thas  no<br \/>\njurisdiction over  the matters\ton which  the Mamlatdar<br \/>\nhad power  to grant  occupancy certificates  and  that,<br \/>\ntherefore,  the\t  Division  Bench   was\t not  right  in<br \/>\nreversing the decree of the appellate Court and that of<br \/>\nthe learned  single Judge  and restoring  the decree of<br \/>\nthe trial Judge. The High Court has noted thus:\n<\/p>\n<blockquote><p>     &#8220;We however,  do not  propose to go<br \/>\n     to the extent of declaring that the<br \/>\n     occupancy\tcertificate  granted  to<br \/>\n     the defendant-jamat  in respect  of<br \/>\n     the suit lands was void because the<br \/>\n     suit lands were not governed by the<br \/>\n     Saurashtra Barkhali  Abolition Act,<br \/>\n     1951.  It\tis  sufficient\tfor  the<br \/>\n     purpose of\t the present case to say<br \/>\n     that  the\tthree  Jamats  whom  the<br \/>\n     plaintiffs\t  represent   were   not<br \/>\n     parties\tto     the     occupancy<br \/>\n     certificate proceedings  and  that,<br \/>\n     therefore,\t     the       occupancy<br \/>\n     certificate does  not bind them nor<br \/>\n     does it  is any  manner  whatsoever<br \/>\n     injure, harm  or  adversely  affect<br \/>\n     their rights to the suit lands.<\/p><\/blockquote>\n<p>     In view  of this  finding the necessary conclusion<br \/>\nis  that   the\toccupancy  certificate\tissued\ton  the<br \/>\napplication dated  November 12,\t 1951 does not bind the<br \/>\nrespondent. It\tis not\tin dispute  that  in  1947  the<br \/>\napplication was\t moved jointly\tby all\tthe Jamats  and<br \/>\nsanad was  given by  the erstwhile  Maharaja for common<br \/>\nuse by all the four Jamats. In that view of the matter,<br \/>\nthe finding  recorded by the High Court. as referred to<br \/>\nearlier, is  perfectly legal  and  does\t not  call  for<br \/>\ninterference.\n<\/p>\n<p>     The High Court further held&#8217;that:<br \/>\n     &#8220;Firstly, the  plaint filed  in the<br \/>\n     earlier suit, Ex.43, was based upon<br \/>\n     the plaintiffs&#8217;  joint title to the<br \/>\n     suit lands\t which thy  derived from<br \/>\n     the Sanad granted to the plaintiffs<br \/>\n     and the  defendant by  the Maharaja<br \/>\n     of Navanagar  on 14th  April, 1928.<br \/>\n     That is  what has\tbeen  stated  in<br \/>\n     that plaint.  The present\tsuit  is<br \/>\n     not based\tupon that  Sanad. It  is<br \/>\n     based  upon  the  subsequent  Sanad<br \/>\n     which  the\t Maharaja  of  Navanagar<br \/>\n     granted to\t the plaintiffs\t and the<br \/>\n     defendant on  10th July,  1947.  We<br \/>\n     are of  the  view\tthat  the  Sanad<br \/>\n     Ex.37, conferred upon the parties a<br \/>\n     fresh title  to the  suit lands  on<br \/>\n     10th July\t1947 and that, therefore<br \/>\n     what  had\t happened  earlier   was<br \/>\n     completely obliterated.  The  joint<br \/>\n     title to  the  suit  lands\t flowing<br \/>\n     from the Sanad, Ex.37, commenced on<br \/>\n     a clean slate with effect from 10th<br \/>\n     July, 1947\t when the Sanand Ex. 37,<br \/>\n     was granted,  the earlier\tsuit was<br \/>\n     instituted on 17th June, 1943, that<br \/>\n     is to say prior to the grant of the<br \/>\n     present   Sanand\t Ex.   37.   The<br \/>\n     plaintiffs&#8217; cause of action for the<br \/>\n     present  suit  is\tbased  upon  the<br \/>\n     Sanad Ex. 37 which represents fresh<br \/>\n     acquisition of  joint title  to the<br \/>\n     suit lands\t for them. What happened<br \/>\n     in\t the  earlier  suit,  therefore,<br \/>\n     cannot   affect   in   any\t  manner<br \/>\n     whatsoever the  joint  title  which<br \/>\n     was conferred upon the plaintiff.&#8221;<br \/>\n     In the  light of the above finding, the contention that<br \/>\nthe earlier  suit which\t was to\t be  allowed  but  had\tbeen<br \/>\ndismissed for  non-prosecution operate\tas a  res  judicata,<br \/>\nbears title  force. Thus,  we hold  that the doctrine of res<br \/>\njudicata does not apply to the facts of this case.\n<\/p>\n<p>     There is  no illegality  committed by  the\t High  Court<br \/>\nwarranting   interference.   The   appeal   is\t accordingly<br \/>\ndismissed.
