HEMA, J.\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 7218 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 27th day of November,2008\n\n                                  O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections 406, 420 read<\/p>\n<p>with section 34 IPC. According to              prosecution, petitioners are<\/p>\n<p>President and Secretary of an Ex-Servicemen Welfare Co-<\/p>\n<p>operative Society. They received huge amount as Fixed Deposit<\/p>\n<p>from various persons by making some fraudulent representations<\/p>\n<p>and they deceived them by issuing receipts in the name of Ex-<\/p>\n<p>servicemen      Charitable       Society,     which      was      not    actually<\/p>\n<p>functioning. They did not return the money and thereby, cheated<\/p>\n<p>various persons and also committed misappropriation.<\/p>\n<p>       3.   Learned      counsel      for    petitioners      submitted     that<\/p>\n<p>petitioners were not the President and Secretary during the<\/p>\n<p>relevant time. The offences alleged will not be attracted,<\/p>\n<p>particularly since the money was not entrusted with the<\/p>\n<p>petitioners, it is submitted.\n<\/p>\n<p>       4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that as per the allegations, the petitioners received<\/p>\n<p>the amount and they have persuaded complainant to make<\/p>\n<p>deposits.    In the similar manner they have received various<\/p>\n<p>BA 7218\/08                           -2-\n<\/p>\n<p>deposits from various other persons also and many complaints<\/p>\n<p>are received against petitioners. In the nature of allegations<\/p>\n<p>made, it is not a fit case to grant anticipatory bail.<\/p>\n<p>       5. On hearing both sides, considering the nature of the<\/p>\n<p>allegations made, I do not think it fit to grant anticipatory bail.<\/p>\n<p>Petitioners&#8217; will be required for interrogation for ascertaining the<\/p>\n<p>matters which are within the exclusive knowledge regarding the<\/p>\n<p>transaction. Hence I am not inclined to grant anticipatory bail.<\/p>\n<p>              Petitioners are directed to surrender before<\/p>\n<p>       the Investigating Officer without any delay and co-<\/p>\n<p>       operate with the investigation.
