Learned  ~..\u00a7:oun&#8217;sel&#8217;  for the&#8221; appellant<\/p>\n<p>firstly contends that.i_&#8217;Athe&#8217;E&#8217; vcommitted an<\/p>\n<p>erroriin.  on the appellant.\n<\/p>\n<p>It is heldilthat  contributory negligence.<\/p>\n<p>The4.{&#8220;i&#8217;ribuna&#8221;l~ appreciation of the oral and<\/p>\n<p> evidence noticed the fact that the<\/p>\n<p> result of composite negligence<\/p>\n<p>of&#8221;&#8216;4.the__v&#8217;dri~yer of the lorry and the driver of the<\/p>\n<p>bus. &#8220;By: following the law laid down by this Court<\/p>\n<p>OpIn_ILR 2004 KAR 109, the Tribunal refrained from<\/p>\n<p>  apportioning the compensation in the absence of<\/p>\n<p>the driver and owner of the lorry in question.<br \/>\nThis finding of the Tribunal is in accordance<\/p>\n<p>with the law declared by this Court.<\/p>\n<p><span class=\"hidden_text\">-3-<\/span><\/p>\n<p>3. Secondly, it is contended that the<br \/>\nTribunal comitted a mistake in taking the income<\/p>\n<p>of the deceased at Rs.l20\/&#8211; per day. The evidence<\/p>\n<p>on record discloses that the deceased was&#8221;\ufb01crking<\/p>\n<p>as a Mesthri (Supervisor). This Court&#8221; and &#8220;the &#8216;<\/p>\n<p>Apex Court consistently held that s cocliehearnsux<\/p>\n<p>a minimum of Rs.100\/~ per day, In that euente\ufb01the<\/p>\n<p>deceased. Mesthri&#8217;s (Supervisor)\u00bb income \ufb01wasm more&#8211;.&#8221;<\/p>\n<p>than Rs.100\/m per day. In the circumstances, the<br \/>\nfinding of the Trib\ufb01nal that vthe_ deceased was<br \/>\nearning Rs.12Q\/w per day is just and proper. The<\/p>\n<p>Tribunal by relieving \u00a3he&#8221;ia&amp;*1eid down by the<\/p>\n<p>Apex ceurt.ih the eeee er SARLA VERMA (sum) AND<br \/>\nOTHERS *vs;V &#8216;DE\u00a3HI\u00bbd*\u00a2RANsPoRs CORPORATION AND<\/p>\n<p>ANo:HER.repee;ed in (2009) 6 sec 121 applied the<\/p>\n<p>\ufb01properrimaltiplier and proper deduction.
