JUSTICE D.N.UPADHYAY\n\nFor the petitioner (s): Mr.Prabir Chatterjee\nFor the Opposite Party : Addl.P.P.\n\n07.09.2011<\/pre>\n<p>           Heard the learned counsel for the petitioners and the learned<br \/>\ncounsel for the State.\n<\/p>\n<p>                     This is an application for grant of anticipatory bail filed by the<br \/>\npetitioners in connection with CP case No. 2136 of 2010               for the offence<br \/>\nregistered under sections 498A\/304B of the Indian Penal Code .\n<\/p>\n<p>                     It reveals from the complaint that Rina Devi, daughter of the<br \/>\ninformant,   was subjected to torture and treated with cruelty for want of more<br \/>\ndowry and she was admitted to PMCH, Dhanbad, and in course of treatment,<br \/>\nshe died on 7.11.2010.      When the Police did not take action, the informant<br \/>\nlodged this case.\n<\/p>\n<p>                     It is submitted that according to Hospital record and the<br \/>\ndeath certificate, the deceased died natural death due to cerebal malaria. Further<br \/>\nmore, the case has been lodged after about a month of the date of the death of<br \/>\nthe deceased, and the husband of the deceased has been granted regular bail<br \/>\nby the Sessions Judge vide B.P. No. 749 of 2011. Petitioners are father in law,<br \/>\nmother in law and brother in law of the deceased.\n<\/p>\n<p>                     Learned counsel for the State has opposed the prayer.<br \/>\n                     Considering the fact that the husband has been granted bail<br \/>\nand the deceased died due to cerebral malaria, I feel inclined to grant<br \/>\nanticipatory bail to the petitioners.
