Heard learned counsel for the parties.\n<\/p>\n<p>2.   By this petition, the petitioner seeks to challenge<br \/>\nthe legality and validity of the order dated 9-7-2010<br \/>\n(Annexure &#8211; P\/1) by which the petitioner, who is working<br \/>\non the post of Deputy Director, Indravati Tiger Reserve,<br \/>\nBijapur, has been transferred to Pithora, Mahasamund.\n<\/p>\n<p>3.   Learned counsel appearing for the petitioner submits<br \/>\nthat the impugned order has been passed only to<br \/>\naccommodate the respondent No.3.  On perusal, the impugned<br \/>\norder would show that the respondent No.3 has been<br \/>\ntransferred on his own request from Pithora, Mahsamund to<br \/>\nIndravati Tiger Reserve, Bijapur, whereas the petitioner<br \/>\nhas been transferred on the ground of administrative<br \/>\nexigency.  Shri Sharma further submits that since 30-9-<br \/>\n2008, this is the 3rd transfer of the petitioner.  Thus,<br \/>\nthe petitioner suffers from frequent transfers.  The<br \/>\nimpugned order has been passed with mala fide intention<br \/>\nonly to accommodate the respondent No.3.\n<\/p>\n<p>4.   On the other hand, learned counsel appearing for the<br \/>\nState submits that the transfer order has been passed by<br \/>\nthe competent authority on the basis of administrative<br \/>\nexigency and there is no violation of statutory rules in<br \/>\npassing the order.  Shri Dubey further submits that the<br \/>\ntransfer affected on the own request of an employee is<br \/>\npermitted and the same cannot be challenged by another<br \/>\nemployee who has posted in his  place.\n<\/p>\n<p>5.   Learned counsel appearing for the respondent No.3<br \/>\nsubmits that the petitioner has suppressed the fact that<br \/>\nhe was posted at Bijapur since 2003 and he was transferred<br \/>\nat the instance of Election Commission in the light of the<br \/>\nfact that the petitioner was posted at Bilaspur for the<br \/>\nlast five years.  Thus, there is no illegality or<br \/>\nirregularity in the impugned order and the petition<br \/>\ndeserves to be dismissed.\n<\/p>\n<p>6.   I have heard learned counsel appearing for the<br \/>\nparties, perused the pleadings and the documents appended<br \/>\nthereto.\n<\/p>\n<p>7.   Two transfer orders, which are passed within a period<br \/>\nof nine months, cannot come within the purview of frequent<br \/>\ntransfers.  Frequent transfer means, an employee is<br \/>\ntransferred frequently on several occasions.  The<br \/>\ngrievance of the petitioner that the impugned order comes<br \/>\nwithin the ambit of a frequent transfer, is not well<br \/>\nestablished and not sustainable in law.  The petitioner<br \/>\nhas not alleged any mala fide against the persons who are<br \/>\ncompetent or have passed the transfer order except that he<br \/>\nhas been transferred only to accommodate the respondent<br \/>\nNo.3.\n<\/p>\n<p>8.   The above-stated allegation does not come within the<br \/>\npurview of mala fide, as the same has not been pleaded<br \/>\nagainst the person passing the order, but against the<br \/>\nperson who has been transferred in place of the<br \/>\npetitioner.  Thus, this is not a case of mala fide.\n<\/p>\n<p>9.   Next contention of the learned counsel appearing for<br \/>\nthe petitioner is that subsequently during pendency of<br \/>\nthis petition, the order dated              15-7-2010<br \/>\n(Annexure &#8211; P\/5) has been passed whereby the respondent<br \/>\nNo.3 was posted in place of the petitioner was neither<br \/>\nwith the approval of the State Government nor on the basis<br \/>\nof recommendation made by the Director, Wild Life, but on<br \/>\nthe basis of recommendation made by the Principal Chief<br \/>\nConservator of Forest, State of Chhattisgarh, Raipur.<br \/>\nAccordingly, the order posting the respondent No.3 in<br \/>\nplace of the petitioner is bad and vitiated.\n<\/p>\n<p>10.  I have perused the letter dated 6-1-2010 (Annexure &#8211;<br \/>\nR\/1) of the  Principal Chief Conservator of Forest, State<br \/>\nof Chhattisgarh, Raipur.  Thereafter, the order dated 19-<br \/>\n11-2009 (Annexure &#8211; P\/4) was passed by the Principal<br \/>\nSecretary to the Government of Chhattisgarh, Department of<br \/>\nForest.  In the letter dated 6-1-2010, it was clearly<br \/>\nstated that the petitioner was posted at Bijapur for a<br \/>\nlong period i.e. since 21-7-2003.  Thus, the petitioner<br \/>\nmay be considered for transfer to any other place.<br \/>\nAccordingly, the impugned order was passed that does not<br \/>\nchange the character of the transfer and, as such, the<br \/>\nposting of the respondent No.3 in place of the petitioner<br \/>\ncannot be faulted with.  In view of foregoing, the<br \/>\ncontention of the petitioner cannot be countenanced.\n<\/p>\n<p>11.  Be that as it may, it is a trite law that<br \/>\ntransfer\/posting is an incidence of service. The Court<br \/>\nshould not interfere with the transfer\/posting order<br \/>\nunless there is malice, infringement of statutory rules<br \/>\nand regulations. In the case on hand, the petitioner has<br \/>\nfailed to establish any of the aforestated grounds. The<br \/>\nemployee may be posted anywhere at the instance of the<br \/>\nemployer in public interest and administrative exigency.<br \/>\nFurther, it is for the Government to post another person<br \/>\nif any vacancy arises on account of transfer\/posting of an<br \/>\nemployee. Thus, the impugned order warrants no<br \/>\ninterference. <a href=\"\/doc\/1327287\/\">(See E.P.Royappa v. State of Tamil Nadu and<\/a><br \/>\nanother1, <a href=\"\/doc\/1260269\/\">Shilpi Bose (Mrs.) and others v. State of Bihar<br \/>\n&amp;<\/a> another2, State of M.P. and another v. S.S.Kourv and<br \/>\nothers3, <a href=\"\/doc\/1557293\/\">Mohd. Masood Ahmad v. State of U.P. &amp; Others4<br \/>\nChief Commercial Manager, South Central Railway,<br \/>\nSecunderabad &amp; Others<\/a> v. <a href=\"\/doc\/506541\/\">G. Ratnam &amp; Others5 and Airports<br \/>\nAuthority of India v. Rajeev Ratan Pandey &amp; Others6).<\/a>\n<\/p>\n<p>12.  Applying the well-settled principles of law to the<br \/>\nfacts of the case on hand and for the reasons mentioned<br \/>\nhereinabove; there is no merit in the case.\n<\/p>\n<p>13.  In the result, the writ petition is dismissed.
