Arulmighu Malayala Thannasi Karuppanna Swamy Temple\n    Rep by its Executive Officer\n    Pattuthurai Post\n    Mottlanur (Via)\n    Erode District.                            \t\t..Respondents\n\n\n\n\nPrayer:   This  revision petition has been  preferred  under\nArticle  227  of  Constitution of India against  the  order,\ndated   26.7.2007,  in  CMA.No.8  of  2007  passed  by   the\nSubordinate  Judge,  Dharapuram, Erode District,  confirming\nthe  order  made in Nada Na.Ka.3047\/2007\/a3, dated 12.4.2007\non  the  file  of  the first respondent\/Joint  Commissioner,\nHindu Religious and Charitable Endowment Board, Coimbatore.\n\n\n\n      For Petitioner    : Mr.R.Karthikeyan,\n\n      For Respondents   : Mr.R.Revathy, Government Advocate (For R1)\n                          Mr.R.T.Duraisamy (for R2 &amp; R3)\n                          Mr.Mutharasu  (for R2)\n                              \n\n\n\n                           ORDER\n<\/pre>\n<p>     Under this revision, the revision petitioner challenges<\/p>\n<p>the  order  passed in CMA.No.8 of 2007 on the  file  of  the<\/p>\n<p>Court  of Subordinate Judge, Dharapuram, who has upheld  the<\/p>\n<p>order of the first respondent\/Joint Commissioner of HR &amp;  CE<\/p>\n<p>Board,  Coimbatore,  who  had  appointed  two  nonhereditary<\/p>\n<p>trustees under Section 47(2) of the HR &amp; CE Act, in addition<\/p>\n<p>to the revision petitioner, who is the hereditary trustee.<\/p>\n<p>      2.According  to  the learned counsel  Mr.R.Karthikeyan<\/p>\n<p>appearing   for   the   revision   petitioner,   the   Joint<\/p>\n<p>Commissioner on the basis of a complaint received had passed<\/p>\n<p>an  order  under  Section 47(2) of the HR &amp; CE  Act  without<\/p>\n<p>looking   into  the  explanation  offered  by  the  revision<\/p>\n<p>petitioner for the complaint alleged against him.  According<\/p>\n<p>to  the  learned counsel, even in the order  passed  by  the<\/p>\n<p>Joint    Commissioner    under    his    proceedings    Nada<\/p>\n<p>Na.Ka.No.2047\/2007\/a3,  dated 12.4.2007, only on  the  basis<\/p>\n<p>of  the  letters  produced at the time of  enquiry,  it  was<\/p>\n<p>brought  to  the  notice that  Hereditary  Trustees  of  the<\/p>\n<p>Temple  have  failed  to  discharge  their  duties  to   the<\/p>\n<p>satisfaction and they failed to provide necessary facilities<\/p>\n<p>to the devotees.  Under such circumstances, P.K.Ramasamy and<\/p>\n<p>Tmt.V.Valliyathal have been appointed as additional trustees<\/p>\n<p>to  administer the temple under Section 47(2) of HR &amp; CE Act<\/p>\n<p>for  one year.  The learned counsel would represent that the<\/p>\n<p>two  newly  appointed trustees have not  taken  charge  till<\/p>\n<p>today.  The revision petitioner aggrieved by the  orders  of<\/p>\n<p>the  Joint  Commissioner  of HR &amp;  CE  Board  had  preferred<\/p>\n<p>CMA.No.8  of  2007 before the Subordinate Judge, Dharapuram,<\/p>\n<p>who  had  confirmed  the orders of the  Joint  Commissioner.<\/p>\n<p>According  tot  he  learned counsel, the  learned  Appellate<\/p>\n<p>Authority  in  his  order has observed  that  there  was  an<\/p>\n<p>enquiry  conducted by the Inspector of the HR &amp; CE Board  on<\/p>\n<p>the  complaint made against the revision petitioner and  had<\/p>\n<p>submitted   his  report  dated  27.3.2007   to   the   Joint<\/p>\n<p>Commissioner  recommending  the  initiation  of  proceedings<\/p>\n<p>against  the president of the Hereditary Trustees  and  also<\/p>\n<p>recommended for the appointment of additional trustees.  But<\/p>\n<p>even  a copy of the report of the Inspector of HR &amp; CE Board<\/p>\n<p>was  not furnished to the revision petitioner to enable  him<\/p>\n<p>to  offer  his  explanation.  Even in the show cause  notice<\/p>\n<p>there  is absolutely no reference with regard to the enquiry<\/p>\n<p>conducted  by the Inspector of HR &amp; CE Board and also  about<\/p>\n<p>his  report dated 27.3.2007, which, according to the learned<\/p>\n<p>counsel,  is  against the principle of natural  justice  and<\/p>\n<p>requires interference from this Court.\n<\/p>\n<\/p>\n<p>      3.A perusal of the show cause notice except mentioning<\/p>\n<p>of  the  complaint received from P.K.Veluswamy  against  the<\/p>\n<p>revision petitioner there is no mentioning about the enquiry<\/p>\n<p>conducted by the Inspector of HR &amp; CE Board on the basis  of<\/p>\n<p>the  complaint preferred by P.K.Veluswamy and also about his<\/p>\n<p>report.  Under such circumstances, I am of the view that  an<\/p>\n<p>opportunity  must be given to the revision petitioner  after<\/p>\n<p>furnishing the copy of the report of the Inspector of  HR  &amp;<\/p>\n<p>CE   Board   dated  27.3.2007  and  after  considering   his<\/p>\n<p>explanation,  a  fresh  order is  to  be  passed  under  the<\/p>\n<p>relevant provision of law by the Joint Commissioner.<\/p>\n<\/p>\n<p>      4.In fine, the Civil Revision Petition is allowed  and<\/p>\n<p>the  order  passed by the learned Sub-Judge, Dharapuram,  in<\/p>\n<p>CMA.No.8 of 2007 is set aside and the matter is remanded  to<\/p>\n<p>the  Joint  Commissioner,  HR &amp; CE  Board,  Coimbatore,  for<\/p>\n<p>passing  a  fresh order after giving an opportunity  to  the<\/p>\n<p>revision petitioner to submit his explanation to the  report<\/p>\n<p>of  the  Inspector  of  HR &amp; CE Board, dated  27.3.2007.  No<\/p>\n<p>costs.
