bearing Nos.13 and 14, Kempegowda Road, Bangalorei,,.Vare<\/p>\n
required for immediate demolition and reconstr’u’ct–ior1.\u00a7 <\/p>\n
petitioner was a tenant on a monthly rent~io.fA4_:l?t.s,3C:0,\/– “and, <\/p>\n
had taken the premises initially fo.r,tsf;el’i-in’g.,.’<\/p>\n
changed the user subsequent.l_y. ‘It__i’s alleiged ‘t;:enar1:tj<\/p>\n
has, in violation of the termsHoif_V’\u00bbvleaVse,Vtic-hangzedllithe nature
\nof business. It is  ~alle’ged..,_’th’a\u00abt_theH’strlucture had
\nbecome unsafe__on being uprooted.\n<\/p>\n
The roots damage to the
\nbuilding angj ‘:’i’ai’ndV’l:ords proposed to build a
\n complex and have obtained
\nleave an.d,4’lice’nc\u00e9 Bengaluru Mahanagara Palike<\/p>\n
for doing so.  i_=o’u’r tenants namely, M\/s Filmstan Exhibiters,<\/p>\n
 l\\\/iE’;\u00a7hnui~.E.3havaln’,’i’M\/s KGN Stores and M\/s Udaya Stores<\/p>\n
1*~g(plfesejnt-.Jpetitliioner) were approached by the landlords.<\/p>\n
While ,___vthelA.1’~v’other tenants vacated, the present petitioner<\/p>\n
 regsisteeziih. It is averred that after taking possession from<\/p>\n
\u00abH_’ot–her tenants, demoiition has been done and the new<\/p>\n
 = ..structure is almost completed. The landlords averred that<\/p>\n

\nthe schedule premises is ideally suited for ingress and<\/p>\n
egress to the building, and therefore, eviction was sought.<\/p>\n
4. The tenant resisted the eviction proceedings.e.ri’t,hree<\/p>\n
counts: firstly that the landlords have entered;”‘i’ntoj_~ <\/p>\n
transaction with M\/s S.V.B.Enterprises for_.39. <\/p>\n
now in possession. Therefore, the landA.lford,s’:h.a’ve’lost ‘<\/p>\n
right to seek eviction. Secondly,  contended’. <\/p>\n
lease period of 30 years in  of the .5,ch’edu1le premises
\nhas not yet expired till j;hei’i.__’h\u00e9\u00ab.cannotHbe evicted.<\/p>\n
Lastly, it is contended….t.h’at.  not required by<\/p>\n
the landlords__for4l’th,eirV:’ov\\fn”useand ‘occupation.<\/p>\n
5. Thetrial co_urt,_ Fla}: examined these contentions in the<\/p>\n
ligiii: oftrre ev’iden_cevon record and reached the affirmative<\/p>\n
‘Vifindin-g_'<tha't"Vthe landlords have established the 'need'<\/p>\n
 ,6. z  this petition reiterating the defence made before<\/p>\n
  trial court, learned counsel for the petitioner submits<\/p>\n
_.;%there is severance of relationship of landlord and tenant<\/p>\n

\nbetween the parties as the respondents have transferred
\nthe property in favour of M\/s S.V.i3.Enterprises, developers,
\nwho have demolished the buiiding and the landlord-s___ have<\/p>\n
not been vested with the right to evict the tenant’L;–Vy:”‘v.He<\/p>\n
further submits that the lease period of 30 <\/p>\n
of the petitioner is interminabie.\n<\/p>\n
7. In negation of aii these con’tentions, i”earn.ed <\/p>\n
for the respondents submits th:a’tV.ythere is rod passin’g’ of title’<\/p>\n
by the iandlords in fayogr of’.M\/st.’S;\\\/;’B_..Enterprises. All that<\/p>\n
the Eandlords have done ;_is to.ier’1tri,isVtj’_\u00bbth’e._property to the<\/p>\n
said firn’ii”~by:’w.ay’:of.a’bi’p.artit’e-agreement to demoiish and
\nreconstruct complex and oniy for that<\/p>\n
purpose, bathe v.deyeiVorper\u00abs7have taken possession. In this<\/p>\n
 rega’\u00abrd,__iA’the ian'(iio.r_dsv have obtained permission from the<\/p>\n
 ‘  by this act the right of ownership does<\/p>\n

 8.  z  in mind what is urged by both sides, I have<\/p>\n
  examined the records made availabie. Tenancy is admitted.<\/p>\n
Aifherefore, vincuium juris of Eandlord and tenant is admitted<\/p>\n

\nbetween the parties. The fact that the old structure has<\/p>\n
since been demolished and that the new structuregvin its<\/p>\n
place has virtually come up is not in dispute. fl7h.e_,’te_rian’t’s<\/p>\n
grievance is that there is no need to as <\/p>\n
building is compieted and let out t0,rVdj,ri’o,us’A <\/p>\n
other words, his contentiong,is_ thatthle ‘nee.dT.projecte.di inn,<\/p>\n
the eviction petition is now loi’s.t”ior rendered’non-\u00abexistent.<\/p>\n
But the contention ot:t’i<1_e  portion in
\noccupation of the   building and
\nis required for 'iliigressiiand regresisl'~and._._t.herefore, demolition
\nof the   I do not find any ill-\n<\/p>\n
motiveylorv  sulchlvcontention. The evidence
\non reclord”  the entire property was a<\/p>\n
composite unit_e’a’rliexr and the new structure comprising a<\/p>\n
shVo”pVpih’g clonjplexvvllhlas come up. If the iandlords have felt<\/p>\n
the-_ to’-demolish the old structure and make it<\/p>\n
ac’cessi__bie.tollthe main complex, it merges with the original<\/p>\n
 need zavnd cannot be said to be lost. The finding of the trial<\/p>\n
W.c’ou.rt based on evidence, I feel, needs no interference. In<\/p>\n

\nthe result, the order of eviction passed by the trial court is<\/p>\n
affirmed. The petition, therefore, must faii.<\/p>\n
9. However, learned counsel for the petitiorilerlits-ub.mi_ts,_V<\/p>\n
that the respondent is a widow wVithtwo .u’nen?}pio”y:ed,Vso:nsii <\/p>\n
and is eking out her livelihood bv’\u00bb.,seii-in’g3  ‘iarid<\/p>\n

subsistence. Undoubtediy har’d\u00abs:hip.,_to a’  extent is
\ninevitably caused cons–ed”ueri.t  of eviction. But
\nhow far it can be mitigat-e’d:’iihas_to  seen”. Since the new<\/p>\n
structure ha’si…alr\u00abe’adyi.cornexup_,,_4lthe’rie’will be no hindrance to<\/p>\n
the  ‘schlediuiie\ufb01premises is said to be on
\nthe margin oflithe’~,bu\u00bbi,l,d’i~n\u00a7”. Being of this view, I feel the<\/p>\n
petitioner\u00e9enantlc_an._be.\u00a7ranted eighteen months time from<\/p>\n
 tor,_i:a\u00a7\u00a7.r  Quit Vaindvaczate the scheduie premises subject to<\/p>\n
 ‘ f.oi’idi,tivo’ns lvlielreunder stated.<\/p>\n
