Respondent herein had filed summary suit<br \/>\n seeking recovery of sum of Rs.2,86,979\/- plus interest  of<br \/>\nRs.51,656\/- from the defendant.  In the summary suit The petitioner<br \/>\nhad moved an application before the learned Civil Judge (S.D.),  on<br \/>\n12.12.01 contending, inter alia, that summons was not duly served as<br \/>\nper the provisions of the Code of Civil Procedure.  The summons<br \/>\nissued  was not served either to the Secretary of the Company or to<br \/>\nany responsible Director thereof.  It was, therefore, prayed that<br \/>\nthe plaintiff be directed to serve the summons on the defendant.<br \/>\nThis application came to be  rejected by the Trial Court by the order<br \/>\ndated 18.10.02 holding that there is no reason to discard the<br \/>\nendorsement   of  the bailiff that summons has been served on the<br \/>\nresponsible officer of the Company.  This   order was never<br \/>\nchallenged by the petitioner and achieved finality.\n<\/p>\n<p>\tIn<br \/>\nabsence of   appearance by the defendant within the time   permitted<br \/>\nunder Order 37, the Trial Court had no occasion to consider<br \/>\ngranting of conditional or unconditional leave to defend.<br \/>\nEventually, therefore, the Trial Court by the impugned order dated<br \/>\n29.9.03 decreed the suit in favour  of  the plaintiff  and permitted<br \/>\nthe plaintiff to recover Rs.2,86,979\/- from the defendant with<br \/>\ninterest at the rate of 6% per annum from 1.8.99 till realization.\n<\/p>\n<p>\tAt<br \/>\nthis stage, the petitioner approached this Court by way of present<br \/>\npetition.   It is not in dispute  that in absence interim order,<br \/>\nduring  the pendency of the petition, decree has been executed  and<br \/>\nthe amount  already paid over by the petitioner.\n<\/p>\n<p>\tCounsel<br \/>\nfor the petitioner submitted that in absence  of due service of<br \/>\nsummons, the decree be set aside and since the amount is already<br \/>\nlying with the defendant, no prejudice would be caused.  She<br \/>\ncontended that execution of the decree was subject to outcome of the<br \/>\npetition.\n<\/p>\n<p>\tOn<br \/>\nthe other hand, learned advocate Shri Hakim for the original<br \/>\nplaintiff opposed the petition contending, inter alia that admittedly<br \/>\nappearance was not filed on behalf of the defendant within the time<br \/>\npermitted under Order 37, recourse  to sub-rule 7 of rule 3 of Order<br \/>\n37, therefore, is not permissible in absence of any application for<br \/>\ncondonation of delay.\n<\/p>\n<p>\tHaving<br \/>\nthus heard the learned  advocates for the parties, I find that though<br \/>\nunder sub-rule 7 of rule 3 of Order 37 of the Code of Civil Procedure<br \/>\ndiscretion lies with the Trial Court to permit appearance of<br \/>\ndefendant beyond the prescribed period, in the present case,<br \/>\nadmittedly no application for   condoning the delay was  filed.  No<br \/>\norder obviously therefore was   passed.\n<\/p>\n<p>\tApart<br \/>\nfrom the above, the case of the petitioner original defendant appears<br \/>\nto be that summons  was not served at all.  However, this contention<br \/>\nhas been categorically turned down  by the Trial Court by its order<br \/>\ndated 18.10.02.  This order was never challenged and it achieved<br \/>\nfinality.  In face of this factor, there was no scope for the<br \/>\npetitioner to avoid decree.  The same was eventually passed in favour<br \/>\nof the plaintiffs.  In the circumstances, I see no reason to<br \/>\ninterfere. The petition is therefore  dismissed.
