DAVE\n\t\t\n\t\n\n \n\nDate\n: 07\/10\/2011 ORAL ORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-88 of 2011 with Limkheda police station,Dist: Dahod for the<br \/>\noffences punishable under Sections 498-A, 306, 504 and 114 of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record and the charge<br \/>\nsheet filed in the case.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the applicants submits that the case of the prosecution<br \/>\nis based on two notes allegedly written by the deceased along with<br \/>\nsome other accusations, but, at the same time, the dispute pertaining<br \/>\nto the property between the parties was going on. It is further<br \/>\nsubmitted that the investigation is over and charge sheet is filed.<br \/>\nHe, therefore, submits that this application for bail may kindly be<br \/>\nconsidered.\n<\/p>\n<p>\tThe<br \/>\nlearned Additional Public Prosecutor has opposed grant of bail<br \/>\nlooking to the nature and gravity of offence.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the role<br \/>\nattributed to the applicants, and the notes alleged written by the<br \/>\ndeceased and other attending circumstances, and now investigation is<br \/>\nover and charge-sheet is filed  without discussing the evidence in<br \/>\ndetail, prima facie, this Court is of the opinion that this is a fit<br \/>\ncase to exercise the discretion to enlarge the applicants on bail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicants are ordered to be released on bail in connection<br \/>\nwith first information report registered at C.R.No.I-88 of 2011 with<br \/>\nLimkheda police station,Dist: Dahod  on their executing a bond of<br \/>\nRs.5,000\/- (Rupees five thousand only) each with one surety of the<br \/>\nlike amount to the satisfaction of the trial court and subject to the<br \/>\nconditions that they shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of their liberty or misuse their liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\ttheir passports, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\ttheir presence at the concerned police station on the first Sunday<br \/>\n\tof every month between 10 a.m. And 3 p.m for six months only.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of their residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicants only if they are not required<br \/>\nin connection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case. At the trial, the trial court shall not<br \/>\nbe influenced by the observations of preliminary nature, qua the<br \/>\nevidence at this stage, made by this Court while enlarging the<br \/>\napplicants on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
