JUSTICE GOPAL KRISHAN VYAS\n\n\nMr.Mukul Singhvi, for the appellant.\nMr.S.Saruparia, for the respondents.\n\n\n             This appeal was filed on 30th September, 1999\nagainst the judgment and decree dated 30th July, 1999\npassed by the Additional District Judge No.1, Udaipur\nin   Civil     Misc.   Case     No.23\/1996            (38),   whereby    the\nlearned   trial    court      has     awarded     Rs.67,320\/-       to   the\nrespondents alongwith interest at the rate of 9% per\nannum.\n\n\n             The brief facts of the case are that a piece\nof land bearing Khasra No.1485 measuring 0.600 hector\nin village Bedwas, district Udaipur was acquired and\nthe Land Acquisition Officer, Public Works Department,\nCircle-I, Udaipur passed an award for Rs.20,647\/- on\n07th August, 1992 towards compensation.\n\n\n             Being aggrieved by the said award passed by\nthe Land Acquisition Officer, the respondents preferred\nan application under Section 18 of the Rajasthan Land\nAcquisition     Act    before   the       Land    Acquisition       Officer\nstating that amount of compensation is not sufficient\non   various     grounds      enumerated         in     the   application,\ntherefore, it was prayed that compensation to the tune\nof   Rs.3,00,293\/-      with    18%      interest       may   be   granted.\nUpon the said application, a reference was presented\n                                 !! 2 !!\n\nbefore     the     District        Judge,        Udaipur        which    was\nsubsequently      transferred      to     the    Court     of   Additional\nDistrict Judge No.1, Udaipur for adjudication.\n\n\n       Before    Additional    District          Judge   No.1,      Udaipur\nrespondents filed their claim petition and appellant\nalso filed written statement.               Thereafter, issues were\nframed and after recording evidence and hearing both\nthe parties, vide judgment and decree dated 30th July,\n1999     the    learned    Additional       District        Judge       No.1,\nUdaipur    awarded    a    total    sum     of    Rs.67,320\/-       to   the\nrespondents alongwith 9% interest.\n\n\n           In this appeal appellant-State is challenging\nthe validity of the said judgment and decree passed by\nthe learned trial court on 30th July, 1999.\n\n\n           It is stated in the appeal that the judgment\nand decree passed by the learned trial court is totally\nwithout application of mind and without taking into\nconsideration the relevant provision of law. Therefore,\nthe judgment and decree passed by the learned trial\ncourt is liable to be quashed and set aside. Further,\nit is contended that learned trial court has committed\nan error while taking view that the land falls within\nthe Abadi area.           In fact the land in dispute is an\nagricultural land and no claim was presented by the\nrespondents at the time of acquisition.\n\n\n           In such circumstances, the award was passed on\nthe basis of location of land, potentiality and land-\nuse and upon the rate of land which has been soled\n                                          !! 3 !!\n\nprior to issuance of notice under Section 4 of the Land\nAcquisition Act. Hence, the award passed by the learned\ntrial court is illegal and deserves to be quashed and\nset aside.\n\n\n             It is further stated that learned trial court\nhas failed to look into the entire facts and evidence\nadduced by the appellant and illegally enhanced the\namount of compensation treating the said land as Abadi\nland though it is agricultural land.\n\n\n             As per appellant the oral evidence of power of\nattorney holder has been recorded.                        It is settled law\nthat evidence of third person shall not be taken into\nconsideration for the purpose of adjudication, so also,\nit should not be relied upon.                        It is also submitted\nthat no independent witness has been produced before\nthe    Court    by    the     respondents           and   all   the witnesses\nproduced by the respondents are interested witnesses as\nthey are either land owner or their power of attorney\nholder.      Therefore, judgment and decree under challenge\ndeserves to be quashed and set aside.\n\n\n             In para (f) of the ground, it is specifically\nstated that no assessment of the property in question\nfrom   the     side    of     the    respondents has            been produced\nbefore    the        Court,     therefore,           in    absence    of   any\nassessment from any private or authorised person, no\nfinding regarding quantum of compensation can be given\nby the learned trial court.                        The learned trial court\nhas    committed      an    error        while      enhancing     compensation\nmerely    on    the    basis        of     presumption      and   assumption.\n                                          !! 4 !!\n\nFurther, it is submitted that interest at the rate of\n9%     has      been       awarded       without        cogent       evidence      and\napplication of mind.                   The land has been acquired for\npublic purpose i.e. for construction of road and for\nsuch       pious     work,     therefore,          no    interest      was    to    be\nawarded         by   the    trial      court.           In    this   view    of    the\nmatter, it is prayed that judgment under challenge may\nkindly be quashed.\n\n\n                Per contra learned counsel appearing on behalf\nof respondents submits that no interference is required\nto    be     made    in     the    judgment under             challenge because\nlearned trial court has considered the entire evidence\nin right perspective. Admittedly, the land in question\nwas     acquired          by   the       appellant-department               for    the\npurpose of construction of road, therefore, at the time\nof deciding the quantum of compensation, it was to be\nascertained          whether       the    area     in        which   the    land    is\nsituated is potential or not.                       It s further submitted\nin para 9 of the award the learned trial court has\ndiscussed the entire evidence and gave finding that the\nland       in    question         is   potential         land    because      it   is\nsituated in locality where residential colony of the\nGovernment as well as industrial area is situated.\n\n\n                In   this      view      of   the       matter,       the    finding\narrived at by the learned trial court does not require\nany interference because the said finding is based upon\ncogent evidence and after taking into consideration the\nentire evidence of the locality of the area where land\nis situated.\n                                         !! 5 !!\n\n              Learned counsel for the appellant has invited\nattention of this Court towards the judgment reported\nin AIR 2002 SCW 4644, in which, the Hon'ble Apex Court\nhas    held       that    the   land     being      acquired    in    developed\narea, having potential of construction of residential\nand commercial buildings, not more than 20% ought to\nhave been deducted towards development.                        Therefore, the\ndeduction of 35% towards development is not justified.\n\n\n              I    have     considered        the    entire     evidence      and\npleadings of the case, so also, the finding arrived at\nby the trial court.\n\n\n              In     my     opinion,        admittedly        the     land    was\nacquired      for        the    purpose      of   construction        of     road.\nFurther, as per finding of learned trial court, the\nland is situated in the area where residential colony\nand industrial area is situated in Udaipur city.                              But\nlearned trial court while accepting the cost of other\nland    has       assessed      the    compensation      and        gave   cogent\nfinding.          Therefore, in view of the fact that land is\nsituated in urban area, so also, there is clear cut\nfinding that land is situated nearby area of industries\nand residential colony, as such, the learned Additional\nDistrict      Judge       No.1,       Udaipur     has   not    committed      any\nerror while enhancing the compensation for the land in\nquestion      from        Rs.20,647\/-        to   Rs.67,320\/-,        so     also,\nwhile considering the fact that compensation was not\npaid in time, granted interest at the rate of 9% per\nannum, in which there is no question to interfere with\nthe finding given by the trial court, which is, just\nand    proper.\n                                      !! 6 !!\n\n\n\n                    In this view of the matter, there is no force\n           in this appeal.
