Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :26\/02\/2007\n\n O R D E R\n              THOTTATHIL B.RADHAKRISHNAN, J\n\n                      -------------------------------------------\n\n                         W.P(C).No.6298 OF 2007\n\n                      -------------------------------------------\n\n              Dated this the 26th  day of February, 2007\n\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The petitioner was a chronic defaulter after having availed<\/p>\n<p>financial   assistance   from   the   National   Small   Industries<\/p>\n<p>Corporation   Ltd.     Certain   cheques   issued   by   him   to   that<\/p>\n<p>organisation also bounced.  He faced prosecution.\n<\/p>\n<p>2.    Out   of   the   total   outstanding   of   Rs.43,398\/-,   an   amount   of<\/p>\n<p>Rs.5,000\/-   was   paid   by   him   and   a   further   amount   of   Rs.1,000\/-\n<\/p>\n<p>was paid towards expenses incurred by the lender in connection<\/p>\n<p>with the criminal case.  Ultimately, the default review committee<\/p>\n<p>of   the   lender   decided   to   write   off   the   remaining   portion   of<\/p>\n<p>Rs.38,398\/-   and   such   recommendation   was   accepted   by   the<\/p>\n<p>lender   on   compassionate   grounds.       Following   that   the   case   of<\/p>\n<p>the  petitioner  was  closed  and  transfer  of  ownership   was issued<\/p>\n<p>to the petitioner on 1.3.2006.\n<\/p>\n<p>WPC.6298\/07<\/p>\n<p>                                  Page numbers<\/p>\n<p>3.       This   writ   petition   is   filed   contending   that   the   second<\/p>\n<p>respondent   has   to   take   a   decision   de   novo   on   the   aforesaid<\/p>\n<p>matter.
