order\u00a0of\u00a0Magistrate\u00a0dated\u00a023.05.2009\u00a0in\u00a0G.R.\u00a0No.\u00a0138\u00a0of\u00a02008.\u00a0\n<\/p>\n<p>                    23 \u00a0 tonnes \u00a0 of \u00a0 coal \u00a0 were \u00a0 loaded \u00a0 in \u00a0 a \u00a0 truck \u00a0 bearing \u00a0 registration \u00a0 No. \u00a0 JH\u00ad11\u00ad<br \/>\n          A\u00ad4392.\u00a0The\u00a0allegation\u00a0is\u00a0at\u00a0the\u00a0time\u00a0of\u00a0seizure\u00a0of\u00a0the\u00a0truck\u00a0loaded\u00a0with\u00a0coal,\u00a0no\u00a0<br \/>\n          document\u00a0could\u00a0be\u00a0produced\u00a0at\u00a0the\u00a0behest\u00a0of\u00a0the\u00a0accused.\u00a0Subsequently,\u00a0during\u00a0the\u00a0<br \/>\n          continuation\u00a0of\u00a0the\u00a0investigation,\u00a0an\u00a0application\u00a0was\u00a0moved\u00a0for\u00a0release\u00a0of\u00a0the\u00a0coal\u00a0<br \/>\n          along \u00a0 with \u00a0 some \u00a0 certified \u00a0 documents \u00a0 to \u00a0 substantiate \u00a0 its \u00a0 ownership \u00a0 which \u00a0 was\u00a0<br \/>\n          rejected\u00a0by\u00a0the\u00a0Chief\u00a0Judicial\u00a0Magistrate,\u00a0vide\u00a0order\u00a0dated \u00a013.01.2009.\u00a0This\u00a0order\u00a0<br \/>\n          was\u00a0challenged\u00a0in\u00a0Cr.Rev.,\u00a0but\u00a0the\u00a0same \u00a0stood\u00a0dismissed\u00a0by\u00a0the\u00a0learned\u00a0Sessions\u00a0<br \/>\n          Judge\u00a0for\u00a0the\u00a0reason\u00a0that\u00a0investigation\u00a0was\u00a0in\u00a0continuation,\u00a0therefore,\u00a0the\u00a0court\u00a0was\u00a0<br \/>\n          not\u00a0inclined\u00a0to\u00a0release\u00a0the\u00a0coal\u00a0during\u00a0the\u00a0pendency\u00a0of\u00a0investigation.\u00a0However,\u00a0it\u00a0<br \/>\n          was\u00a0left\u00a0open\u00a0that\u00a0after\u00a0submission\u00a0of\u00a0chargesheet,\u00a0the\u00a0petitioner\u00a0will\u00a0be\u00a0at\u00a0liberty\u00a0to\u00a0<br \/>\n          approach\u00a0the\u00a0court\u00a0at\u00a0a\u00a0latter\u00a0date.\u00a0Hence,\u00a0another\u00a0application\u00a0was\u00a0moved\u00a0which\u00a0<br \/>\n          was\u00a0dismissed,\u00a0vide\u00a0order\u00a0dated\u00a023.05.2009.\u00a0The\u00a0order\u00a0was\u00a0challenged\u00a0in\u00a0Cr.Rev.\u00a0<br \/>\n          No.\u00a0174\u00a0of\u00a02009.\u00a0The\u00a0revisional\u00a0court\u00a0has\u00a0once\u00a0again\u00a0refused\u00a0the\u00a0prayer\u00a0for\u00a0release\u00a0<br \/>\n          of\u00a0the\u00a0coal\u00a0on\u00a0the\u00a0ground\u00a0that\u00a0the\u00a0accused\/petitioner\u00a0was\u00a0not\u00a0able\u00a0to\u00a0produce\u00a0any\u00a0<br \/>\n          document \u00a0 at \u00a0 the \u00a0 time \u00a0 of \u00a0 seizure. \u00a0 Chargesheet \u00a0 is \u00a0 submitted \u00a0 and \u00a0 a \u00a0 number \u00a0 of\u00a0<br \/>\n          witnesses\u00a0have\u00a0supported\u00a0the\u00a0prosecution\u00a0case\u00a0in\u00a0the\u00a0statement\u00a0under\u00a0Section\u00a0161\u00a0<br \/>\n          Cr.P.C.\u00a0\n<\/p>\n<p>                    After \u00a0 hearing \u00a0 the \u00a0 counsel \u00a0 on \u00a0 behalf \u00a0 of \u00a0 the \u00a0 petitioner \u00a0 as \u00a0 well \u00a0 as \u00a0 the \u00a0 State\u00a0<br \/>\n          counsel\u00a0at\u00a0length\u00a0and\u00a0on\u00a0consideration\u00a0of\u00a0the\u00a0fact\u00a0that\u00a0the\u00a0seized\u00a0article\u00a0is\u00a0lying\u00a0in\u00a0<br \/>\n          custody\u00a0since\u00a0a\u00a0longtime\u00a0and\u00a0is\u00a0a\u00a0perishable\u00a0item.\u00a0Evidently,\u00a0it\u00a0is\u00a0a\u00a0national\u00a0loss\u00a0and\u00a0<br \/>\n          cannot\u00a0be\u00a0put\u00a0to\u00a0use\u00a0by\u00a0anyone.\u00a0The\u00a0trial\u00a0is\u00a0still\u00a0continuing\u00a0and\u00a0it\u00a0is\u00a0not\u00a0known\u00a0as\u00a0to\u00a0<br \/>\n          how\u00a0long\u00a0the\u00a0trial\u00a0will\u00a0continue.\u00a0\n<\/p>\n<p>                    Taking\u00a0into\u00a0consideration\u00a0such\u00a0a\u00a0circumstance\u00a0where\u00a0articles\u00a0seized\u00a0by\u00a0the\u00a0<br \/>\n          police\u00a0and\u00a0are\u00a0subject\u00a0matter\u00a0of\u00a0criminal\u00a0case.\u00a0The\u00a0Apex\u00a0Court\u00a0adopted\u00a0a\u00a0view\u00a0and\u00a0<br \/>\n          directed\u00a0the\u00a0State\u00a0to\u00a0release\u00a0the\u00a0goods\u00a0in\u00a0case\u00a0there\u00a0is\u00a0no\u00a0other\u00a0claimant\u00a0and\u00a0the\u00a0<br \/>\n          applicant\u00a0is\u00a0able\u00a0to\u00a0satisfy\u00a0by\u00a0some\u00a0document\u00a0or\u00a0by\u00a0other\u00a0evidence\u00a0and\u00a0aspects\u00a0that\u00a0<br \/>\n          he \u00a0 is\u00a0 the \u00a0 rightful \u00a0 claimant. \u00a0 Apart \u00a0from \u00a0 it,\u00a0 if \u00a0 the \u00a0 item \u00a0 is \u00a0 perishable \u00a0and \u00a0 someone\u00a0<br \/>\n comes\u00a0forward\u00a0 \u00a0to\u00a0take\u00a0custody,\u00a0the\u00a0goods\u00a0may\u00a0be\u00a0released\u00a0after\u00a0adopting\u00a0safety\u00a0<br \/>\nmeasures\u00a0such\u00a0as\u00a0security,\u00a0indemnity\u00a0bonds,\u00a0undertaking\u00a0etc.\u00a0that\u00a0the\u00a0goods\u00a0will\u00a0be\u00a0<br \/>\nproduced\u00a0at\u00a0the\u00a0time\u00a0of\u00a0trial\u00a0as\u00a0and\u00a0when\u00a0required\u00a0or\u00a0alternatively\u00a0the\u00a0court\u00a0shall\u00a0<br \/>\ntake \u00a0 steps \u00a0 to \u00a0 get \u00a0 the \u00a0 articles \u00a0 photographed \u00a0 and \u00a0 record \u00a0 evidence \u00a0 about \u00a0 the \u00a0 &#8216;case\u00a0<br \/>\nproperty&#8217;\u00a0which\u00a0can\u00a0be\u00a0used\u00a0at\u00a0a\u00a0latter\u00a0date\u00a0during\u00a0the\u00a0trial.\u00a0These\u00a0directions\u00a0were\u00a0<br \/>\ngiven\u00a0by\u00a0the\u00a0Apex\u00a0Court\u00a0in\u00a0the\u00a0case\u00a0of\u00a0Sunderbhai\u00a0Ambalal\u00a0Desai\u00a0Vs.\u00a0State\u00a0of\u00a0Gujarat, \u00a0<br \/>\nAIR\u00a02003\u00a0SC\u00a0638.\u00a0Paragraphs\u00ad\u00a08,\u00a09\u00a0and\u00a010\u00a0of\u00a0the\u00a0said\u00a0judgment\u00a0is\u00a0quoted\u00a0below:\u00a0\u00ad<br \/>\n                         &#8220;8.\u00a0The\u00a0question\u00a0of\u00a0proper\u00a0custody\u00a0of\u00a0the\u00a0seized\u00a0article\u00a0<br \/>\n                is \u00a0 raised \u00a0 in \u00a0 number \u00a0 of \u00a0 matters. \u00a0 In \u00a0Smt. \u00a0 Basavva \u00a0 Kom \u00a0<br \/>\n                Dyamangouda\u00a0Patil\u00a0Vs.\u00a0State\u00a0of\u00a0Mysore\u00a0and\u00a0another,\u00a0(1977)\u00a04 \u00a0<br \/>\n                SCC\u00a0358,\u00a0this\u00a0Court\u00a0dealt\u00a0with\u00a0a\u00a0case\u00a0where\u00a0the\u00a0seized\u00a0articles\u00a0<br \/>\n                were\u00a0not\u00a0available\u00a0for\u00a0being\u00a0returned\u00a0to\u00a0the\u00a0complainant.\u00a0In\u00a0<br \/>\n                that\u00a0case,\u00a0the\u00a0recovered\u00a0ornaments\u00a0were\u00a0kept\u00a0in\u00a0a\u00a0trunk\u00a0in\u00a0the\u00a0<br \/>\n                police\u00a0station\u00a0and\u00a0later\u00a0it\u00a0was\u00a0found\u00a0missing,\u00a0the\u00a0question\u00a0was\u00a0<br \/>\n                with\u00a0regard\u00a0to\u00a0payment\u00a0of\u00a0those\u00a0articles.\u00a0In\u00a0that\u00a0context,\u00a0the\u00a0<br \/>\n                Court\u00a0observed\u00a0as\u00a0under\u00a0:\u00a0\u00ad<\/p>\n<p>                         &#8220;4.\u00a0The\u00a0object\u00a0and\u00a0scheme\u00a0of\u00a0the\u00a0various\u00a0provisions\u00a0of\u00a0<br \/>\n                the\u00a0Code\u00a0appear\u00a0to\u00a0be\u00a0that\u00a0where\u00a0the\u00a0property\u00a0which\u00a0has\u00a0been\u00a0<br \/>\n                the \u00a0 subject\u00admatter \u00a0 of \u00a0 an \u00a0 offence \u00a0 is \u00a0 seized \u00a0 by \u00a0 the \u00a0 police, \u00a0 it\u00a0<br \/>\n                ought\u00a0not\u00a0to\u00a0be\u00a0retained\u00a0in\u00a0the\u00a0custody\u00a0of\u00a0the\u00a0Court\u00a0or\u00a0of\u00a0the\u00a0<br \/>\n                police\u00a0for\u00a0any\u00a0time\u00a0longer\u00a0than\u00a0what\u00a0is\u00a0absolutely\u00a0necessary.\u00a0<br \/>\n                As\u00a0the\u00a0seizure\u00a0of\u00a0the\u00a0property\u00a0by\u00a0the\u00a0police\u00a0amounts\u00a0to\u00a0a\u00a0clear\u00a0<br \/>\n                entrustment\u00a0of\u00a0the\u00a0property\u00a0to\u00a0a\u00a0Government\u00a0servant,\u00a0the\u00a0idea\u00a0<br \/>\n                is\u00a0that\u00a0the\u00a0property\u00a0should\u00a0be\u00a0restored\u00a0to\u00a0the\u00a0original\u00a0owner\u00a0<br \/>\n                after\u00a0the\u00a0necessity\u00a0to\u00a0retain\u00a0it\u00a0ceases.\u00a0It\u00a0is\u00a0manifest\u00a0that\u00a0there\u00a0<br \/>\n                may\u00a0be\u00a0two\u00a0stages\u00a0when\u00a0the\u00a0property\u00a0may\u00a0be\u00a0returned\u00a0to\u00a0the\u00a0<br \/>\n                owner.\u00a0In\u00a0the\u00a0first\u00a0place\u00a0it\u00a0may\u00a0be\u00a0returned\u00a0during\u00a0any\u00a0inquiry\u00a0<br \/>\n                or\u00a0trial.\u00a0This\u00a0may\u00a0particularly\u00a0be\u00a0necessary\u00a0where\u00a0the\u00a0property\u00a0<br \/>\n                concerned\u00a0is\u00a0sought\u00a0to\u00a0speedy\u00a0or\u00a0natural\u00a0decay.\u00a0There\u00a0may\u00a0be\u00a0<br \/>\n                other\u00a0compelling\u00a0reasons\u00a0also\u00a0which\u00a0may\u00a0justify\u00a0the\u00a0disposal\u00a0<br \/>\n                of\u00a0the\u00a0property\u00a0to\u00a0the\u00a0owner\u00a0or\u00a0otherwise\u00a0in\u00a0the\u00a0interest\u00a0of\u00a0<br \/>\n                justice.\u00a0The\u00a0High\u00a0Court\u00a0and\u00a0the\u00a0Sessions\u00a0Judge\u00a0proceeded\u00a0on\u00a0<br \/>\n                the\u00a0footing\u00a0that\u00a0one\u00a0of\u00a0the\u00a0essential\u00a0requirements\u00a0of\u00a0the\u00a0Code\u00a0<br \/>\n                is \u00a0 that \u00a0 the \u00a0 articles \u00a0 concerned \u00a0 must \u00a0 be \u00a0 produced \u00a0 before \u00a0 the\u00a0<br \/>\n                Court \u00a0 or \u00a0 should \u00a0 be \u00a0 in \u00a0 its \u00a0 custody. \u00a0 The \u00a0 object \u00a0 of \u00a0 the \u00a0 Code\u00a0<br \/>\n                seems\u00a0to\u00a0be\u00a0that\u00a0any\u00a0property\u00a0which\u00a0is\u00a0in\u00a0the\u00a0control\u00a0of\u00a0the\u00a0<br \/>\n                Court\u00a0either\u00a0directly\u00a0or\u00a0indirectly\u00a0should\u00a0be\u00a0disposed\u00a0of\u00a0by\u00a0the\u00a0<br \/>\n                Court\u00a0and\u00a0a\u00a0just\u00a0and\u00a0proper\u00a0order\u00a0should\u00a0be\u00a0passed\u00a0by\u00a0the\u00a0<br \/>\n                Court \u00a0 regarding \u00a0 its \u00a0 disposal. \u00a0 In \u00a0 a \u00a0 criminal \u00a0 case, \u00a0 the \u00a0 police\u00a0<br \/>\n                always\u00a0acts\u00a0under\u00a0the\u00a0direct\u00a0control\u00a0of\u00a0the\u00a0Court\u00a0and\u00a0has\u00a0to\u00a0<br \/>\n                take\u00a0orders\u00a0from\u00a0it\u00a0at\u00a0every\u00a0stage\u00a0of\u00a0an\u00a0inquiry\u00a0or\u00a0trial.\u00a0In\u00a0this\u00a0<br \/>\n                broad\u00a0sense,\u00a0therefore,\u00a0the\u00a0Court\u00a0exercises\u00a0an\u00a0overall\u00a0control\u00a0<br \/>\n                on\u00a0the\u00a0actions\u00a0of\u00a0the\u00a0Police\u00a0Officers\u00a0in\u00a0every\u00a0case\u00a0where\u00a0it\u00a0has\u00a0<br \/>\n                taken\u00a0cognizance.&#8221;\n<\/p>\n<p>                        9.\u00a0The\u00a0Court\u00a0further\u00a0observed\u00a0that\u00a0where\u00a0the\u00a0property\u00a0<br \/>\n                is\u00a0stolen,\u00a0lost\u00a0or\u00a0destroyed\u00a0and\u00a0there\u00a0is\u00a0no\u00a0prima\u00a0facie\u00a0defence\u00a0<br \/>\n                made\u00a0out\u00a0that\u00a0the\u00a0State\u00a0or\u00a0its\u00a0officers\u00a0had\u00a0taken\u00a0due\u00a0care\u00a0and\u00a0<br \/>\n                caution \u00a0 to \u00a0 protect \u00a0 the \u00a0 property, \u00a0 the \u00a0 Magistrate \u00a0 may, \u00a0 in \u00a0 an\u00a0<br \/>\n                appropriate\u00a0case,\u00a0where\u00a0the\u00a0ends\u00a0of\u00a0justice\u00a0so\u00a0require,\u00a0order\u00a0<br \/>\n                payment\u00a0of\u00a0the\u00a0value\u00a0of\u00a0the\u00a0property.\u00a0\n<\/p>\n<p>                       10. \u00a0 To \u00a0 avoid \u00a0 such \u00a0 a \u00a0 situation, \u00a0 in \u00a0 our \u00a0 view, \u00a0 powers\u00a0<br \/>\n                under\u00a0Section\u00a0451,\u00a0Cr.P.C.\u00a0should\u00a0be\u00a0exercised\u00a0promptly\u00a0and\u00a0<br \/>\n                at\u00a0the\u00a0earliest.&#8221;\u00a0\u00a0\n<\/p>\n<p>                  In\u00a0view\u00a0of\u00a0the\u00a0directions\u00a0of\u00a0the\u00a0Apex\u00a0Court,\u00a0I\u00a0am\u00a0of\u00a0the\u00a0considered\u00a0view\u00a0that\u00a0<br \/>\n         the\u00a0Chief\u00a0Judicial\u00a0Magistrate,\u00a0Dhanbad\u00a0shall\u00a0release\u00a023\u00a0tonnes\u00a0of\u00a0coal\u00a0in\u00a0favour\u00a0of\u00a0<br \/>\n         the\u00a0petitioner\u00a0after\u00a0taking\u00a0indemnity\u00a0bonds\u00a0and\u00a0also\u00a0taking\u00a0steps\u00a0to\u00a0ensure\u00a0that\u00a0the\u00a0<br \/>\n         trial \u00a0 is \u00a0 not \u00a0 hampered \u00a0 on \u00a0 account \u00a0 of \u00a0 the \u00a0 release. \u00a0 The \u00a0 counsel \u00a0 on \u00a0 behalf \u00a0 of \u00a0 the\u00a0<br \/>\n         petitioner \u00a0 undertakes \u00a0 to \u00a0 furnish \u00a0 bonds \u00a0 equivalent \u00a0 to \u00a0 the \u00a0 property \u00a0 sought \u00a0 to \u00a0 be\u00a0<br \/>\n         released.\u00a0The\u00a0documents\u00a0shall\u00a0be\u00a0kept\u00a0on\u00a0record\u00a0to\u00a0be\u00a0used\u00a0at\u00a0a\u00a0latter\u00a0date.\u00a0The\u00a0<br \/>\n         entire\u00a0exercise\u00a0is\u00a0to\u00a0be\u00a0carried\u00a0out\u00a0by\u00a0the\u00a0Chief\u00a0Judicial\u00a0Magistrate,\u00a0Dhanbad,\u00a0within\u00a0<br \/>\n         a\u00a0period\u00a0of\u00a0four\u00a0weeks\u00a0from\u00a0the\u00a0date\u00a0an\u00a0application\u00a0along\u00a0with\u00a0a\u00a0certified\u00a0copy\u00a0of\u00a0<br \/>\n         this\u00a0order\u00a0is\u00a0produced\u00a0before\u00a0him.\u00a0\n<\/p>\n<p>                 With \u00a0 the \u00a0 aforesaid \u00a0 observations\/directions, \u00a0 the \u00a0 writ \u00a0 petition
