(Oral)\n<\/pre>\n<p>          Ramesh Chander Suden and others have filed a writ petition in<\/p>\n<p>this Court seeking quashing of notification dated 29.7.2003 (Annexure<\/p>\n<p>P2).\n<\/p>\n<p>          Civil Misc. No. 17996 of 2008 has been filed for seeking<\/p>\n<p>exemption from filing of certified copy of Annexure A which is a decision<\/p>\n<p>of Division Bench of this Court rendered in <a href=\"\/doc\/349007\/\">Gian Chand and others v.<\/p>\n<p>State of Punjab and Others (Civil Writ Petition No.<\/a> 15554 of 2007<\/p>\n<p>decided on 21.7.2008).\n<\/p>\n<p>          Learned counsel for the petitioners\/applicants and the<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 1221 of 2008                                    2<\/span><\/p>\n<p>respondents are in agreement that the case of the petitioner is covered<\/p>\n<p>by the ratio of the decision rendered by the Division Bench of this Court<\/p>\n<p>in Gian Chand&#8217;s case (supra).\n<\/p>\n<p>          Learned counsel for the respondents state that the above said<\/p>\n<p>decision of this Court in Gian Chand&#8217;s case (supra) is a subject matter<\/p>\n<p>of Special Leave to Appeal (Civil) No. 25856 of 2008, in which notice has<\/p>\n<p>been issued and it has been further ordered that contempt proceedings,<\/p>\n<p>if any, shall stand stayed.\n<\/p>\n<p>          Learned counsel for the petitioners has stated that since the<\/p>\n<p>case of the petitioners is covered by the Division Bench judgment of this<\/p>\n<p>Court rendered in Gian Chand&#8217;s case (supra), which is under challenge<\/p>\n<p>before Hon&#8217;ble the Apex Court, the petitioners are ready and willing to<\/p>\n<p>furnish an undertaking to their employer that they shall be bound by the<\/p>\n<p>decision of Special Leave to Appeal and they will not claim any benefit till<\/p>\n<p>the decision of the Special Leave to Appeal. Therefore, in order to save<\/p>\n<p>them from engaging a counsel in Hon&#8217;ble the Apex Court, the present<\/p>\n<p>writ petition is allowed in the same terms as in Gian Chand&#8217;s case<\/p>\n<p>(supra)<\/p>\n<p>          Learned counsel for the respondents has no objection to it.<\/p>\n<p>          The parties are in agreement that this will save both the sides<\/p>\n<p>from engaging a counsel in Hon&#8217;ble the Apex Court. It is, therefore,<\/p>\n<p>ordered that the present writ petition is allowed in same terms as in Gian<\/p>\n<p>Chand&#8217;s case (supra) subject to the condition that the petitioners herein<\/p>\n<p>shall furnish an undertaking to their employer that they shall remain<\/p>\n<p>bound by the outcome of the decision of Hon&#8217;ble the Apex Court in<\/p>\n<p>Special Leave to Appeal (Civil) No. 25856 of 2008 where the judgment<br \/>\n<span class=\"hidden_text\"> Civil Writ Petition No. 1221 of 2008                               3<\/span><\/p>\n<p>rendered in Gian Chand&#8217;s case (supra) has        been challenged.
