Kapadia has submitted that in view of the<br \/>\ndecision of the Hon&#8217;ble Supreme Court in the case of <a href=\"\/doc\/1364781\/\">State of<br \/>\nKarnataka and others v. Ameerbi and others<\/a>, (2007) 11 SCC 681,<br \/>\nthe writ petition filed by the respondent No.1 &#8211; original<br \/>\npetitioner is not maintainable.  He further submitted that as per the<br \/>\nabove judgment, the Hon&#8217;ble Supreme Court held that persons working<br \/>\nas anganwadi workers do not hold civil post.  The posts of anganwadi<br \/>\nworkers are not statutory posts and they are created under a scheme.<br \/>\nHence, he submitted that as the respondent No.1 was not holding a<br \/>\ncivil post, the writ petition filed by her under Article 226 is not<br \/>\nmaintainable.\n<\/p>\n<p>3.\t\tThe<br \/>\nCourt finds force in the submission made by learned counsel Mr.<br \/>\nKapadia.  Hence, the ad-interim relief granted by this Court vide<br \/>\norder dated 15.06.2011 stands confirmed till the final disposal of<br \/>\nLetters Patent Appeal.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe result, this Civil Application stands allowed.
