Advocate\n\nHon'ble Bala Krishna Narayana,J.\n<\/pre>\n<p>Heard learned counsel for the applicant and the learned AGA appearing on<br \/>\nbehalf of State.\n<\/p>\n<p>It is contended that the applicant is absolutely innocent and has been falsely<br \/>\nimplicated in the instant case.\n<\/p>\n<p>It has further been contended that general allegations of causing fire arm<br \/>\ninjuries to the injured have been made against both the co accused and the<br \/>\napplicant but the injuries allegedly received by the injured are on the non vital<br \/>\npart of his body and no case under Section 307 IPC is made out against the<br \/>\napplicant .\n<\/p>\n<p>It has lastly been contended that the applicant is in Jail since 22.2.2010.\n<\/p>\n<p>The prayer for bail has been vehemently opposed by the learned AGA on the<br \/>\nground that the applicant has been convicted in in a case under Section<br \/>\n366\/376 IPC in the year 1990.\n<\/p>\n<p>Learned counsel for the applicant replied that the order of conviction in said<br \/>\ncase has been challenged in appeal which is pending and in the said appeal<br \/>\nthe applicant has been enalrged on bail.\n<\/p>\n<p>Keeping\u00a0in\u00a0view\u00a0the\u00a0nature\u00a0of\u00a0the\u00a0offence,\u00a0evidence,\u00a0complicity\u00a0of\u00a0the\u00a0accused,\u00a0<br \/>\nseverity\u00a0of\u00a0punishment\u00a0and\u00a0submissions\u00a0of\u00a0the\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0parties,\u00a0I\u00a0<br \/>\nam\u00a0of\u00a0the\u00a0view\u00a0that\u00a0the\u00a0applicant\u00a0has\u00a0made\u00a0out\u00a0a\u00a0case\u00a0for\u00a0bail.<br \/>\nLet\u00a0the\u00a0applicant\u00a0Arwind\u00a0involved\u00a0in\u00a0Case\u00a0Crime\u00a0No.\u00a089\u00a0of\u00a02010\u00a0under\u00a0<br \/>\nSections\u00a0,\u00a0under\u00a0Section\u00a0307\/452\/506\/147\/148\/149\/\u00a0IPC\u00a0Police\u00a0Station\u00a0Modi\u00a0<br \/>\nNagar\u00a0Ghziabad,\u00a0,\u00a0be\u00a0released\u00a0on\u00a0bail\u00a0on\u00a0his\u00a0furnishing\u00a0a\u00a0personal\u00a0bond\u00a0and\u00a0<br \/>\ntwo\u00a0sureties\u00a0each\u00a0in\u00a0the\u00a0like\u00a0amount\u00a0to\u00a0the\u00a0satisfaction\u00a0of\u00a0the\u00a0court\u00a0concerned\u00a0<br \/>\nwith\u00a0the\u00a0following\u00a0conditions:\u00ad\n<\/p>\n<p>(i)The\u00a0applicant\u00a0will\u00a0not\u00a0tamper\u00a0with\u00a0the\u00a0evidence\u00a0during\u00a0the\u00a0trial.\n<\/p>\n<p>(ii)\u00a0The\u00a0applicant\u00a0will\u00a0not\u00a0pressurise\/\u00a0intimidate\u00a0the\u00a0prosecution\u00a0witness.\n<\/p>\n<p>(iii)The\u00a0applicant\u00a0will\u00a0appear\u00a0before\u00a0the\u00a0trial\u00a0court\u00a0on\u00a0the\u00a0date\u00a0fixed.\n<\/p>\n<p>(iv)The\u00a0applicant\u00a0shall\u00a0report\u00a0to\u00a0the\u00a0police\u00a0station\u00a0concerned\u00a0in\u00a0the\u00a0first\u00a0week\u00a0of\u00a0<br \/>\neach\u00a0month\u00a0to\u00a0show\u00a0his\u00a0good\u00a0conduct\u00a0and\u00a0behaviour.<br \/>\nIn\u00a0case\u00a0of\u00a0breach\u00a0of\u00a0any\u00a0of\u00a0the\u00a0above\u00a0conditions\u00a0,\u00a0the\u00a0court\u00a0below\u00a0shall\u00a0be\u00a0at<br \/>\nliberty\u00a0to\u00a0cancel\u00a0the\u00a0bail.\n<\/p>\n<p>cps<br \/>\n26.7.2010\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Arwind vs State Of U.P. on 26 July, 2010 Court No. &#8211; 49 Case :- CRIMINAL MISC.
