This seeonci appeal is by the defendant <\/p>\n
trial court and he calls in question <\/p>\n
\ufb01ndings of facts of the courts below’ by  ‘suit \u00bb <\/p>\n
the pzamee for declaration in:  ‘am :”petti’1afient<\/p>\n
injunctiozz against the ‘-   to  L’<\/p>\n
decreed. and the lower _eotirt’ –r:o1i11:’im1ed the
\nsame by dismissing } by defendant.<\/p>\n
2. The  in   that the suit<\/p>\n
was ffie\u00e9  seeking the relief of
\ndeciaifation’  injune\ufb01on against the<\/p>\n
appe11aIit”” ~herei1’1  on the foundation that he<\/p>\n
   the  of the suit property foliowing the<\/p>\n
   “father and his father had purchased the<\/p>\n
 1:1t.<ie1'::e regstered sale deed dated 23.6.1969 and,<\/p>\n
 eversiiiee the plaintiffs possession of the suit property,<\/p>\n
 'hejfhas been in enjoyment of the same and when the<\/p>\n
   _ eppeilant herein tried to interfere with the possession of<\/p>\n
the suit property by the plamti\ufb01 by making a claim over
\nthe two eeeonut trees and one neem tree, the plaintiff<\/p>\n
had to \ufb01ie the present suit<\/p>\n

3. The appeiiant herein denied the above stand of the<\/p>\n
plaintiff’ and contended that the neem teas in<\/p>\n
existence in his iand but not in the    <\/p>\n
4. The trial court framed Vfenr issues: _a3:’te’r \\ <\/p>\n
eonsidezing the evidence on reco:jd,.. <\/p>\n
and 2 in favour of the   dee1’eedi._’i:heV  L’<\/p>\n
the plaintiff as prayed for.’u:The.._viou}er\u00abeppeilate court<\/p>\n
con\ufb01rmed the same  appeal preferred<\/p>\n
by the defendant.\n<\/p>\n
5. \u00a7__Th_e. 1  -the learned counsel for the
\napmlan\ufb01 &3hri.’15’\u00a7,’f\u00bb’;4(::i>e{;ii1g’\ufb01adharappa is that both the<\/p>\n
c91\u00a71’I’;’:sA. have ~  sight of the fact that the real<\/p>\n
 between the parties was as to the neem tree<\/p>\n
  owner of the said neem tree and, though<\/p>\n
  does not dispute the fact of the suit<\/p>\n
 ., ”  being the pmperty belonging to the plaintiztf,<\/p>\n
 it is the speci\ufb01c: ease of the defendant that the neem<\/p>\n
V  trm exists not in the pie-33\u00b031\ufb01’ff’s “land but, in the<\/p>\n
defendant’s land. Referring to Exs.P-1, [‘.>-1 and D-8,<\/p>\n
the submission made is that the neem tree is found in<\/p>\n

the land which was purchased by the defexxdarrt and,<\/p>\n
therefore, the courts below missed the real eoiifft\u00e9l\ufb01fersy<\/p>\n
between the parties but, on the other  4_<\/p>\n
suit property as the property    ‘ 1. <\/p>\n
regard to which the parties    <\/p>\n
the matter requires  “to; .  real<\/p>\n
controversy between-‘ ‘dle   this”eoI1eee\ufb01on, he

\nof the View that though the suit was \ufb01led by the ‘plaintiff<\/p>\n
seeking declaration of title and permanent <\/p>\n
against the defendant in respect of the 4, 4′<\/p>\n
yet, the res! controversy appears’ to toVIw’1.9io4.’_is the ‘ ; ii<\/p>\n

   because, the learned judge of the lower<\/p>\n
 eourt has clearly stated in paxagaph-13 of his<\/p>\n
2 ~ }1i1dog:ment that though no dispute is there between the<\/p>\n
“peieties with regard to the suit property Ming the<\/p>\n
V’ “absolute property of the plainti\ufb02’ and that the plaintiif is<\/p>\n
in possession of the same, yet, the dispute only pertains<\/p>\n
to the existence of eight coconut trees and one neem<\/p>\n
