(Oral)\n<\/pre>\n<p>             This is husband&#8217;s appeal against the impugned part of the<\/p>\n<p>judgment and decree dated 3.1.2007 passed by the matrimonial Court vide<\/p>\n<p>which while accepting the petition filed by the petitioner-appellant under<\/p>\n<p>Section 13 (1) (a) and (b) of the Hindu Marriage Act for the grant of divorce,<\/p>\n<p>he has been directed to pay Rs.3 lacs as permanent alimony to the respondent-<\/p>\n<p>wife.\n<\/p>\n<p>             The appellant sought divorce on the ground of cruelty. The<\/p>\n<p>Court held that respondent had treated the appellant with cruelty and decreed<\/p>\n<p>the petition. The relief clause of the order passed by the Additional District<\/p>\n<p>Judge, Chandigarh reads as under:-\n<\/p>\n<blockquote><p>             &#8220;As a result of my findings returned above, the petition<br \/>\n             succeeds and is allowed with no order as to costs, and<br \/>\n             marriage solemnized between the parties on 23.7.2000 is<br \/>\n             ordered to be dissolved with effect from today subject<br \/>\n             however to the petitioner paying a sum of Rs.3 lacs as<br \/>\n             permanent alimony       to the respondent within 3 months<br \/>\n             from today. Decree sheet be drawn and file be consigned<br \/>\n             to the records after due compilation.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> FAO No.M-59 of 2007 (O&amp;M)                                                      2<\/span><\/p>\n<p>             Learned counsel for the appellant contends that grant of<\/p>\n<p>permanent alimony of Rs.3 lacs by the learned Additional District Judge,<\/p>\n<p>Chandigarh cannot be sustained in law and it is in violation of the provision<\/p>\n<p>of Section 25 of the Hindu Marriage Act.\n<\/p>\n<p>             Section 25 of the Act reads as under:-\n<\/p>\n<p>             &#8220;25. Permanent alimony and maintenance.\n<\/p>\n<p>             (1)Any court exercising jurisdiction under his Act may, at<br \/>\n             the time of passing any decree or at any time subsequent<br \/>\n             thereto, on application made to it for the purpose by either<br \/>\n             the wife or the husband, as the case may be, order that the<br \/>\n             respondent shall pay to the applicant for her or his<br \/>\n             maintenance and support such gross sum or such monthly<br \/>\n             or periodical sum for a term not exceeding the life of the<br \/>\n             applicant as, having regard to the respondent&#8217;s own income<br \/>\n             and other property, if any, the income and other property of<br \/>\n             the applicant, the conduct of the parties and other<br \/>\n             circumstances of the case, it may seem to the court to be<br \/>\n             just, and any such payment may be secured, if necessary,<br \/>\n             by a charge on the immovable property of the respondent.<br \/>\n             (2) If the court is satisfied that there is a change in the<br \/>\n             circumstances of either party at any time after it has made<br \/>\n             an order under sub-section (1), it may at the instance of<br \/>\n             either party, vary, modify or rescind any such order in such<br \/>\n             manner as the court may deem just.\n<\/p>\n<p>             (3) If the court is satisfied that the party in whose favour an<br \/>\n             order has been made under this section has re-married or, if<br \/>\n             such party is the wife, that she has not remained chaste, or,<br \/>\n             if such party is the husband, that he has had sexual<br \/>\n             intercourse with any woman outside wedlock, it may at the<br \/>\n             instance of the other party vary, modify or rescind any such<br \/>\n             order in such manner as the court may deem just.&#8221;<\/p>\n<p>             The contention of learned counsel for the appellant is, that in<\/p>\n<p>absence of the application, the Court is not competent to grant permanent<\/p>\n<p>alimony. This contention of the learned counsel for the appellant cannot be<br \/>\n<span class=\"hidden_text\"> FAO No.M-59 of 2007 (O&amp;M)                                                    3<\/span><\/p>\n<p>accepted.   A reading of Section 25 of the Hindu Marriage Act clearly<\/p>\n<p>stipulates that any Court exercising jurisdiction under the Act, at the time of<\/p>\n<p>passing of any decree, can grant permanent alimony to the party entitled<\/p>\n<p>thereto. The requirement of application would only arise in case after the<\/p>\n<p>decree, the alimony is claimed under Section 25 of the Act by either of the<\/p>\n<p>parties. Section 25 stipulates:-\n<\/p>\n<blockquote><p>              1)     Any Court exercising jurisdiction under this act, may, at<br \/>\n                     the time of passing any decree<br \/>\n                                         or<br \/>\n                     at any time subsequent thereto, an application made to it<br \/>\n                     for the purpose by either the wife or the husband, as the<br \/>\n                     case may be, order that the respondent shall pay to<br \/>\n                     applicant for her maintenance and support such gross sum<br \/>\n                     or such monthly or periodically sum for a term not<br \/>\n                     exceeding the life of the applicant as, having regard to<br \/>\n                     respondent&#8217;s own income and other property if any, the<br \/>\n                     income and other property of the applicant the conduct of<br \/>\n                     the parties and other circumstances, it may seem to Court<br \/>\n                     to by just, and any such payment may be received, if<br \/>\n                     necessary by a change on immovable property of the<br \/>\n                     respondent.\n<\/p><\/blockquote>\n<pre>              2)     ............\n              3)     ............\n\n\n<\/pre>\n<blockquote><p>              The first contention of learned counsel for the appellant that in<\/p>\n<p>absence of application, no alimony could be granted is therefore rejected.<\/p><\/blockquote>\n<p>              Learned counsel for the appellant also contends that while<\/p>\n<p>adjudicating the question of permanent alimony, the Court was required to<\/p>\n<p>take into consideration the income of the respondent. The contention of<\/p>\n<p>learned counsel for the appellant therefore, is that in this case, the application<\/p>\n<p>moved by the respondent-wife for grant of maintenance pendente lite under<\/p>\n<p>Section 24 of the Hindu Marriage Act during the pendency of the petition was<br \/>\n<span class=\"hidden_text\"> FAO No.M-59 of 2007 (O&amp;M)                                                  4<\/span><\/p>\n<p>rejected, as the respondent is employed as lecturer, though it is claimed by the<\/p>\n<p>respondent that she is employed as teacher.\n<\/p>\n<p>             There is force in this contention of learned counsel for the<\/p>\n<p>appellant. Section 25 of the Hindu Marriage Act stipulates that while granting<\/p>\n<p>permanent alimony, Court is required to take into consideration the income<\/p>\n<p>and property, if any, of the respondent.\n<\/p>\n<p>             The impugned part of the judgment and decree does not take<\/p>\n<p>note of the fact that respondent is employed nor the basis of assessment and<\/p>\n<p>alimony granted is disclosed.\n<\/p>\n<p>             This appeal is allowed. The impugned part of the judgment and<\/p>\n<p>decree granting permanent alimony to the respondent is ordered to be set<\/p>\n<p>aside. The decree of divorce is made absolute as it has not been challenged by<\/p>\n<p>the respondent.\n<\/p>\n<p>             However, this shall not bar the respondent to move an<\/p>\n<p>application under Section 25 of the Hindu Marriage Act for grant of<\/p>\n<p>permanent alimony, in case she is entitled to, in accordance with law.<\/p>\n<p>                                                        [ Vinod K.
