APP (DB) No.1399 of 2010\n                                     RANJEET BIND\n                                         Versus\n                                 THE STATE OF BIHAR\n                                       -----------\n<\/pre>\n<p>3   09-02-2011             Heard learned counsels for the appellants in all<\/p>\n<p>                 these three appeals which arise out of a common<\/p>\n<p>                 judgement whereby the appellants have been convicted<\/p>\n<p>                 u\/s 302\/34 of the IPC and sentenced to R.I. for life and<\/p>\n<p>                 also u\/s 27 of the Arms Act for which they have been<\/p>\n<p>                 convicted R.I. for one year.\n<\/p>\n<p>                           Submissions were advanced that allegations of<\/p>\n<p>                 the witnesses make out only a case of general and<\/p>\n<p>                 omnibus firing by the accused persons and it was<\/p>\n<p>                 specifically argued on behalf of three appellants of Cr.<\/p>\n<p>                 Appeal no. 1346\/2010 that these appellants were not<\/p>\n<p>                 identified in court by the informant.\n<\/p>\n<p>                           According to prosecution case, indiscriminate<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>        firing led to death of four persons of the same family<\/p>\n<p>        inside the house and identification is by witnesses who<\/p>\n<p>        were inside the house as well as outside in the village.<\/p>\n<p>        There is more than two identification against the<\/p>\n<p>        appellants and in some cases the identification is by as<\/p>\n<p>        many as eight witnesses.\n<\/p>\n<p>                   Considering the nature of the occurrence and<\/p>\n<p>        identification available against the appellants, the prayer<\/p>\n<p>        for bail is rejected at this stage.<\/p>\n<pre>\n\n\n                                (Shiva Kirti Singh, J.)\n\n\nBKS\/-                           (Gopal Prasad, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ganga Vishun Bind And Anrs. vs The State Of Bihar on 9 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
