NO. 38676 OF 2010\n         = = = = = = = = = = = = = = =\n    Dated this the 28th day of December, 2010.\n\n                 J U D G M E N T\n<\/pre>\n<p>     The petitioner is a student undergoing the<\/p>\n<p>MCA Course in SCMS School of Engineering and<\/p>\n<p>Technology.  She was provisionally admitted for<\/p>\n<p>the MCA course subject to production of the<\/p>\n<p>original   mark   lists     of   the    qualifying<\/p>\n<p>examination and degree certificate.       The last<\/p>\n<p>date for submission of mark list and degree<\/p>\n<p>certificate is 31.1.2011.     The petitioner has<\/p>\n<p>passed all the exams of the BCA Course except<\/p>\n<p>paper 5 of the fourth semester for which she had<\/p>\n<p>appeared in the examinations held in April-May<\/p>\n<p>2010 as a supplementary candidate with Reg.<\/p>\n<p>No.18431.  The result of the said examination<\/p>\n<p>was published on 15.12.2010.       The petitioner<\/p>\n<p>again failed in the said examination.      She has<\/p>\n<p>W.P.C. 38676 OF 2010<br \/>\n<span class=\"hidden_text\">                        -:2:-<\/span><\/p>\n<p>therefore applied for revaluation of her answer<\/p>\n<p>script by submitting Ext.P4 application dated<\/p>\n<p>20th December, 2010. She has also applied for<\/p>\n<p>scrutiny of the answer script by submitting<\/p>\n<p>Ext.P5 application dated 20th December, 2010.<\/p>\n<p>It is stated that the prescribed fee has been<\/p>\n<p>paid, that she had done well in the examination<\/p>\n<p>and that if her answer script is revalued she is<\/p>\n<p>likely to secure a pass in the examination. She<\/p>\n<p>also submits that unless she produces the fourth<\/p>\n<p>semester mark list of the BCA course before the<\/p>\n<p>Principal of SCMS College of Engineering and<\/p>\n<p>Technology on or before 31.1.2011 her admission<\/p>\n<p>for the MCA course will be cancelled.  On these<\/p>\n<p>grounds she seeks expeditious revaluation of her<\/p>\n<p>answer script.\n<\/p>\n<p>W.P.C. 38676 OF 2010<br \/>\n<span class=\"hidden_text\">                             -:3:-<\/span><\/p>\n<p>      2.   Sri.T.A.Shaji, learned Standing Counsel<\/p>\n<p>for the Mahatma Gandhi University, submitted on<\/p>\n<p>instructions that applications for revaluation<\/p>\n<p>and    scrutiny     have   been    received from the<\/p>\n<p>petitioner,      that   scrutiny    will  be arranged<\/p>\n<p>within two weeks from today and the answer<\/p>\n<p>script revalued and the result communicated to<\/p>\n<p>the petitioner within eight weeks from today.<\/p>\n<p>In the light of the said submission I dispose of<\/p>\n<p>the writ petition with the following directions.<\/p>\n<p>      (1) The       2nd   respondent     shall  make<\/p>\n<p>arrangements for       scrutiny of the answer script<\/p>\n<p>referred to in Ext.P5 application within two<\/p>\n<p>weeks from today.\n<\/p>\n<p>      (2)    The    competent   authority  among the<\/p>\n<p>respondents       shall  take     steps to  have the<\/p>\n<p>petitioner&#8217;s answer script described in Ext.P4<\/p>\n<p>W.P.C. 38676 OF 2010<br \/>\n<span class=\"hidden_text\">                            -:4:-<\/span><\/p>\n<p>revalued and to communicate the result to her<\/p>\n<p>expeditiously and in any event within eight<\/p>\n<p>weeks from today.\n<\/p>\n<p>      (3)     It will be open to the petitioner to<\/p>\n<p>move the Principal, SCMS School of Engineering<\/p>\n<p>and Technology, Vidya Nagar, Pallissery along<\/p>\n<p>with a certified copy of the judgment seeking<\/p>\n<p>further time for the production of the mark<\/p>\n<p>lists.\n<\/p>\n<\/p>\n<p>                        P.N.
