Justice S.S.SATHEESACHANDRAN\n\n Dated :22\/09\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n            W.P.(C).No.26541 OF 2009\n           --------------------------\n    Dated this the 22nd day of September 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>            The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<p>        i)   Call for the records leading to the<\/p>\n<p>issuance of Ext.P4 and quash the same by the<\/p>\n<p>issuance of writ of certiorari.\n<\/p>\n<p>        ii)  To direct the court below to expedite<\/p>\n<p>the trial in O.S No.150\/2009 pending before the<\/p>\n<p>Munsiff Court, Ernakulam.\n<\/p>\n<p>        iii)  To issue any other order, direction<\/p>\n<p>that this Hon&#8217;ble Court may deem fit in the facts<\/p>\n<p>and circumstances of the case.\n<\/p>\n<\/p>\n<p>        2.   Petitioner is the plaintiff in O.S<\/p>\n<p>No.150 of 2009 on the file of Munsiff Court,<\/p>\n<p>Ernakulam.  Petitioner continues in occupation of a<\/p>\n<p>room  in  the  building  belonging  to  the   first<\/p>\n<p>W.P.(C).No.26541 OF 2009     Page numbers<\/p>\n<p>respondent, Society on the basis of the terms and<\/p>\n<p>conditions covered by an agreement.           Petitioner<\/p>\n<p>moved for having additional electric connection to<\/p>\n<p>the    room     under   his   occupation    before   the<\/p>\n<p>Electricity     Board.     Such   additional  connection<\/p>\n<p>could be provided to the room in his occupation<\/p>\n<p>only if consent is given by the owner, the first<\/p>\n<p>respondent.        That  consent   being  declined,  the<\/p>\n<p>petitioner filed the above suit seeking a decree of<\/p>\n<p>mandatory       injunction    directing     the    first<\/p>\n<p>respondents,      Society,  and   also   its  president,<\/p>\n<p>impleaded as the second defendant, to grant such<\/p>\n<p>consent.    With the suit, an application for interim<\/p>\n<p>injunction as identical to the relief covered by<\/p>\n<p>the decree sought for was also urged for.          First<\/p>\n<p>and second respondents resisted that application<\/p>\n<p>contending that, without authority, the petitioner<\/p>\n<p>had bifurcated the room under his occupation with<\/p>\n<p>intend to lease out one portion of that room to<\/p>\n<p>another, and so much so, the consent sought for<\/p>\n<p>W.P.(C).No.26541 OF 2009     Page numbers<\/p>\n<p>additional electric connection cannot be granted.<\/p>\n<p>The   learned     Munsiff,  negativing   the  objections<\/p>\n<p>raised by the first and second respondents allowed<\/p>\n<p>the application for interim injunction, against<\/p>\n<p>which those respondents preferred an appeal.         The<\/p>\n<p>learned District Judge after hearing both sides<\/p>\n<p>allowed the appeal and vacated the order of interim<\/p>\n<p>injunction.        Propriety  and   correctness of   the<\/p>\n<p>judgment rendered by the learned District Judge in<\/p>\n<p>the appeal is challenged in the writ petition<\/p>\n<p>invoking the supervisory jurisdiction vested with<\/p>\n<p>this court under Article 227 of the Constitution of<\/p>\n<p>India.\n<\/p>\n<\/p>\n<p>          3.      The   third  respondent  has  entered<\/p>\n<p>appearance through counsel.         I heard the learned<\/p>\n<p>counsel for the petitioner and also the third<\/p>\n<p>respondent.      Having regard to the submissions made<\/p>\n<p>and taking note of the facts and circumstances<\/p>\n<p>presented, I find no notice to the 1st ,2nd      and 4th<\/p>\n<p>W.P.(C).No.26541 OF 2009    Page numbers<\/p>\n<p>respondents is necessary and hence it is dispensed<\/p>\n<p>with.    I do not want to express any opinion on the<\/p>\n<p>merits of the suit, nor of the interim injunction<\/p>\n<p>applied for by the plaintiff.           Perusing Ext.P4<\/p>\n<p>judgment of learned District Judge, I find no<\/p>\n<p>illegality or impropriety warranting interference<\/p>\n<p>in exercise of the visitorial jurisdiction of this<\/p>\n<p>court.     Having regard to the submissions made by<\/p>\n<p>the respective counsel and perusing Ext.P4 judgment<\/p>\n<p>of the learned District Judge, I find, it will not<\/p>\n<p>be proper and appropriate for this court to pass<\/p>\n<p>any order as requested for the petitioner so as to<\/p>\n<p>compel the first and second respondents to give<\/p>\n<p>consent for taking additional electric connection<\/p>\n<p>to the shop room under the occupation of the<\/p>\n<p>petitioner.      Without expressing any opinion on the<\/p>\n<p>merits of the orders passed by the learned Munsiff<\/p>\n<p>and also Ext.P4 judgment of the learned District<\/p>\n<p>Judge, I direct the trial court to dispose the suit<\/p>\n<p>giving it top priority in hearing as expeditiously<\/p>\n<p>W.P.(C).No.26541 OF 2009    Page numbers<\/p>\n<p>as possible, at any rate, within a period of six<\/p>\n<p>months from the date of receipt of a copy of this<\/p>\n<p>judgment.     Writ petition is disposed with the above<\/p>\n<p>directions.
