Heard the parties.\n<\/p>\n<p>                                     In a criminal prosecution for offences under Sections<\/p>\n<p>                      25(1-B)(a)\/26 of the Arms Act as also under Section 414 of the<\/p>\n<p>                      Indian Penal Code, there is allegation of recovery of one country<\/p>\n<p>                      made pistol with five live cartridges and a mobile set from the<\/p>\n<p>                      possession of the petitioner.\n<\/p>\n<p>                                     It is submitted by the learned counsel for the petitioner<\/p>\n<p>                      that petitioner is in judicial custody since 31. 12. 2009 and has been<\/p>\n<p>                      sufficiently punished in this case. It is also submitted that as a<\/p>\n<p>                      matter of fact, it was not a case of conscious possession rather it was<\/p>\n<p>                      a case of transplantation.\n<\/p>\n<p>                                     Be that as it may, in the facts and circumstances of the<\/p>\n<p>                      case, the above named petitioner is directed to be released on bail in<\/p>\n<p>                      connection with Trial No. 1416 of 2010 arising out of Chanpatia<\/p>\n<p>                      P.S. Case No. 238 of 2009, on furnishing bail bond of Rs. 10,000\/-<\/p>\n<p>                      (Ten thousand) with two sureties of the like amount each to the<\/p>\n<p>                      satisfaction of Shri B. K. Pathak, Judicial Magistrate, Ist Class,<\/p>\n<p>                      Bettiah, District-West Champaran, subject to further conditions;<br \/>\n<span class=\"hidden_text\">        2<\/span><\/p>\n<p>           (a) that one of bailors must be Govt. servant<\/p>\n<p>               or close family member of the petitioner,<\/p>\n<p>               who will file an affidavit in the court<\/p>\n<p>               below showing his\/her relationship with<\/p>\n<p>               the petitioner.\n<\/p>\n<p>           (b) if the petitioner is found involved in<\/p>\n<p>               same and similar nature of cases in<\/p>\n<p>               future,    then      in    that      case      the<\/p>\n<p>               informant\/prosecution shall be at liberty<\/p>\n<p>               to file a petition for cancellation of the<\/p>\n<p>               bail of the petitioner, and if such a<\/p>\n<p>               petition is filed, the court below would<\/p>\n<p>               be obliged to dispose of the same in<\/p>\n<p>               accordance        with    law     after     giving<\/p>\n<p>               opportunity of hearing to all concerned.<\/p>\n<p>           ( c ) The petitioner shall make regular pairvi<\/p>\n<p>                in the court below in the present case<\/p>\n<p>                either by appearing himself in person<\/p>\n<p>                or through representation by his lawyer<\/p>\n<p>                on each and every dates, and if on two<\/p>\n<p>                consecutive dates petitioner fails to<\/p>\n<p>                make pairvi, then the court below shall<\/p>\n<p>                be at liberty to cancel the bail bond of<\/p>\n<p>                the petitioner.\n<\/p>\n<\/p>\n<pre>m.p.
