Sri Ashwani Kumar, the Superintendent of Excise,<br \/>\n                                   Jehanabad.                  &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>04.   13.9.2010                Having heard learned senior counsel for the petitioner<\/p>\n<p>                   and learned counsel for the State, this Court is not inclined to<\/p>\n<p>                   interfere with the order passed against the petitioner imposing<\/p>\n<p>                   certain punishment which stands substantially diluted       by the<\/p>\n<p>                   appellate authority. It cannot be said that no charge was being made<\/p>\n<p>                   out   against the petitioner   for being imposed punishment in<\/p>\n<p>                   question.\n<\/p>\n<p>                               Learned counsel for the petitioner    submits that the<\/p>\n<p>                   earlier imposition of punishment is coming in the way of<\/p>\n<p>                   petitioner&#8217;s promotion.\n<\/p>\n<p>                               This Court has reservation on such a submission<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>      because effect of such punishment can only occupy the field for<\/p>\n<p>      the period of three years since none of the punishment can be said<\/p>\n<p>      to   be major punishment as would be evident      from the order<\/p>\n<p>      passed by the appellate authority.\n<\/p>\n<p>                  The writ application is dismissed with observation as<\/p>\n<p>      above.\n<\/p>\n<\/p>\n<pre>rkp                            ( Ajay Kumar Tripathi, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
