Justice S.S.SATHEESACHANDRAN\n\n Dated :11\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n             W.P.(C).No.3974 OF 2009\n           --------------------------\n     Dated this the 11th day of August 2009\n     -------------------------------------\n\n\n                     JUDGMENT\n<\/pre>\n<p>        The writ petition is filed seeking the<\/p>\n<p>following reliefs.\n<\/p>\n<\/p>\n<p>        i)    Call for the records resulting in<\/p>\n<p>Ext.P5 order, set aside the same and allow Ext.P2<\/p>\n<p>application.\n<\/p>\n<\/p>\n<p>        ii)  Pass such other orders, interlocutory<\/p>\n<p>or otherwise, which are deemed fit and proper in<\/p>\n<p>the interest of justice.\n<\/p>\n<\/p>\n<p>        iii)  Allow this writ petition with costs.<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.3974 OF 2009       2<\/span><\/p>\n<p>          2.     Petitioner is the plaintiff in O.S<\/p>\n<p>No.38 of 2008 on the file of the Sub Court,<\/p>\n<p>Chengannur and the respondents are the defendants.<\/p>\n<p>Suit is one for partition and injunction, or in the<\/p>\n<p>alternative      for   recovery   of  money  from   the<\/p>\n<p>defendants.      The case of plaintiff is that on the<\/p>\n<p>basis of the power of attorney executed by him in<\/p>\n<p>favour of first defendant, the mother along with<\/p>\n<p>the   second    and    third defendants  that  is,  his<\/p>\n<p>brothers executed sale deeds in favour of the 4th<\/p>\n<p>and 5th defendants.       Conveyance of the property so<\/p>\n<p>made in favour of the 4th and 5th defendants is<\/p>\n<p>impeached      by    the   plaintiff  raising   various<\/p>\n<p>allegations set out in the plaint which need not be<\/p>\n<p>set   outfor     the   purpose   of  disposal of   this<\/p>\n<p>petition.      Among the reliefs claimed in the suit<\/p>\n<p>the main relief is partition of his share over the<\/p>\n<p>suit property ignoring the sale deeds executed in<\/p>\n<p>favour of the 4th and 5th defendants treating them as<\/p>\n<p>null and void and not binding on him.           In the<\/p>\n<p>alternative     petitioner    \/  plaintiff  sought  for<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.3974 OF 2009       3<\/span><\/p>\n<p>money, quantifying the sum due as his share       in the<\/p>\n<p>property in case a partition decree cannot be<\/p>\n<p>granted.       To    substantiate  the  claim  for  the<\/p>\n<p>quantified sum of money which was set up as an<\/p>\n<p>alternative relief in        the suit and to ascertain<\/p>\n<p>and determine the valuation of the property, the<\/p>\n<p>petitioner\/ plaintiff moved for appointment of an<\/p>\n<p>advocate commissioner which was objected to by the<\/p>\n<p>respondents \/ defendants.        The learned Sub Judge<\/p>\n<p>after hearing both sides dismissed that application<\/p>\n<p>by Ext.P5 order.       Propriety and correctness of that<\/p>\n<p>order is impeached in the writ petition invoking<\/p>\n<p>the supervisory jurisdiction vested with this court<\/p>\n<p>under Article 227 of the Constitution of India.<\/p>\n<p>          3.     I heard the learned counsel on both<\/p>\n<p>sides.    Having regard to the submissions made and<\/p>\n<p>taking    note     of   the   facts  and   circumstances<\/p>\n<p>presented with reference to Ext.P5 order, I find,<\/p>\n<p>in the nature of the main relief claimed in the<\/p>\n<p>suit for partition and division of the share of the<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.3974 OF 2009      4<\/span><\/p>\n<p>plaintiff in the suit property, the question as to<\/p>\n<p>whether he is entitled to the alternative relief<\/p>\n<p>will arise only if he has partitiable right and<\/p>\n<p>that need be gone into only in the final decree<\/p>\n<p>proceedings.        In  such  a  proceeding alone   the<\/p>\n<p>appointment of a commission to ascertain his share<\/p>\n<p>value will arise for consideration.      So much so, I<\/p>\n<p>do not find any impropriety or illegality in Ext.P5<\/p>\n<p>order passed by the court below.
