      In this appeal under Section 173 of Motor Vehicles<\/p>\n
Act, the claimant in O.P. (MV) No.1004 of 2000 of Motor<\/p>\n
Accidents Claims Tribunal, Ernakulam challenges the<\/p>\n
judgment and award of the Tribunal dated June 25, 2007<\/p>\n
awarding a compensation of Rs.1,66,044\/-       for the loss<\/p>\n
caused to him on account of the injuries sustained by him in<\/p>\n
a motor accident.\n<\/p>\n
      2. The facts leading to this appeal, in brief, are<\/p>\n
these:- The claimant was aged 48       at the time of the<\/p>\n
accident and used to earn Rs.5,000\/- per month as a Mason.<\/p>\n
On December 10, 1999 at 6 p.m. the claimant was riding<\/p>\n
his motor cycle bearing registration No.KL-7\/C-5766, along<\/p>\n
with one Asokan as a pillion rider, along the National<\/p>\n
Highway. When they reached near Desom near Alwaye, a<\/p>\n
car bearing registration No.KL-8\/C-8605, driven by the<\/p>\n

second respondent, came at a high speed and dashed<\/p>\n
against the motor cycle of the claimant. The claimant as<\/p>\n
well as the pillion rider sustained serious injuries.<\/p>\n
According to the claimant, the accident occurred due to the<\/p>\n
rash and negligent driving of the offending car by the<\/p>\n
second respondent. First respondent as the owner, second<\/p>\n
respondent as the diver and third respondent as the insurer<\/p>\n
of the offending car are jointly and severally liable to pay<\/p>\n
compensation to the claimant. Fourth respondent who is the<\/p>\n
insurer of the motor cycle was subsequently impleaded.<\/p>\n
Fifth respondent is the registered owner of the car.<\/p>\n
       3. Respondents 1 and 2, the owner and driver of the<\/p>\n
offending car remained absent and were set ex parte by the<\/p>\n
Tribunal. The third respondent, the insurer of the offending<\/p>\n
ca filed a written statement, admitting the policy and<\/p>\n
further contended that the registered owner of the car is<\/p>\n
another person. Additional fourth respondent has filed a<\/p>\n
written statement, admitting the policy and contended that<\/p>\n
the accident occurred due to negligence of the second<\/p>\n

respondent. The additional fifth respondent filed a written<\/p>\n
statement, admitting the ownership of the car.<\/p>\n
      4. Exts.A1 to A10 were marked on the side of the<\/p>\n
claimant before the Tribunal. No evidence was adduced by<\/p>\n
the respondents. The Tribunal, on an appreciation of<\/p>\n
evidence, awarded a compensation of Rs.1,66,044\/- with<\/p>\n
interest at 7.5% p.a. from the date of petition till realization.<\/p>\n
The claimant has now come up in appeal challenging the<\/p>\n
quantum of compensation awarded by the Tribunal.<\/p>\n
      5. Heard learned counsel for the appellant and<\/p>\n
learned counsel for respondents 3 and 4.<\/p>\n
      6. The accident is not disputed. The finding of the<\/p>\n
Tribunal that the accident occurred due to the negligence<\/p>\n
on the part of the second respondent is not challenged in<\/p>\n
this appeal. Therefore, the only question which arises for<\/p>\n
consideration is whether the claimant is entitled to any<\/p>\n
enhanced compensation ?\n<\/p>\n
      7. The claimant sustained the following injuries as<\/p>\n
revealed from Ext.A8 copy of the wound certificate issued<\/p>\n

from the hospital, X-ray and C.T.scan:-<\/p>\n
       1) Multiple abrasion on the right side of
\n          forehead.\n<\/p><\/blockquote>\n
       2) Lacerated wound right eyebrow.<\/p>\n<\/blockquote>\n
       3) Abrasions on the right ear, right shoulder,
\n          dorsum of left hand, right hand and right
\n          knee.\n<\/p><\/blockquote>\n
       4) Lacerated wound on the right leg at lower
\n          third and right knee.\n<\/p><\/blockquote>\n
       5) Black eye – right.\n<\/p><\/blockquote>\n
       6) Fracture of both bones of right leg and right
\n          patella.\n<\/p><\/blockquote>\n
       7) Fractures of frontal bone, cribriform plate,
\n          roof and lateral wall of right orbit.<\/p>\n<\/blockquote>\n
There was thin extradural haematoma on right temporal<\/p>\n
convixity and bleed with right lateral ventricle. Ext.A7 series<\/p>\n
are discharge cards issued from the hospital. Ext.A10 is the<\/p>\n
certificate of disability issued by the Medical Board, which<\/p>\n
shows that the claimant has 39% permanent physical<\/p>\n
disability and 28% orthopaedic disability and 11% neuro-<\/p>\n
logic disability.\n<\/p>\n
       8. The Tribunal awarded a total compensation of<\/p>\n

Rs.1,66,044\/-. Break up of the amount awarded is as<\/p>\n
under :-\n<\/p>\n
    Medical expenses               :   Rs. 57,164\/-\n    Transportation expense         :   Rs.      2,000\/-\n    and damage to cloth.\n    Attendant expenses             :   Rs.      4,000\/-\n    Extra-nourishment              :   Rs.      3,000\/-\n    Shock, pain and sufferings     :   Rs. 20,000\/-\n    Loss of permanent disability :     Rs. 74,880\/-\n    Loss of amenities and          :   Rs.      5,000\/-\n    convenience.\n                                       --------------------\n          Total                    :   Rs.1,66,044\/-\n                                       ========\n\n     9. The      learned   counsel  for   appellant        sought\n\n<\/pre>\n
enhancement of compensation towards the disability caused<\/p>\n
and for loss of amenities and enjoyment in life.<\/p>\n
     10. The Tribunal took the monthly income of the<\/p>\n
claimant as Rs.2,000\/-, adopted a multiplier of 8, as the<\/p>\n
claimant was aged 48 at the time of the accident, and took<\/p>\n
the percentage of disability as 39%, as shown in Ext.A10,<\/p>\n
and awarded Rs.74,880\/- for the disability caused.<\/p>\n
According to the claimant, he was a Mason and used to earn<\/p>\n
Rs.5,000\/- per month. Taking into consideration this aspect,<\/p>\n
we feel that his monthly income can reasonably be<\/p>\n

estimated at Rs.2,500\/-. The percentage of disability taken<\/p>\n
by the Tribunal as 39% and multiplier adopted by the<\/p>\n
Tribunal as 8 are not seriously challenged. Thus, for the<\/p>\n
disability caused, the claimant is entitled to a compensation<\/p>\n
of Rs.93,600\/- (Rs.2,500\/- x 12 x 8 x 39%). Thus, on this<\/p>\n
count,   the    claimant   is  entitled   to   an    additional<\/p>\n
compensation of Rs.18,720\/-.\n<\/p>\n
      11. The Tribunal awarded a compensation of<\/p>\n
Rs.5,000\/- for loss of amenities and for the inconvenience<\/p>\n
caused, which appears to be very low. Having regard to the<\/p>\n
nature    of the injuries     sustained,   we    feel that   a<\/p>\n
compensation of Rs.10,000\/- would be reasonable on this<\/p>\n
count.\n<\/p>\n
      12. There is another aspect in this case. The Tribunal<\/p>\n
did not award any amount for loss of earnings. The nature<\/p>\n
of the injuries sustained by the claimant shows that he must<\/p>\n
have been laid up for four months. As we have fixed monthly<\/p>\n
income of the claimant as Rs.2,500\/-, the claimant is entitled<\/p>\n
to a compensation of Rs.10,000\/- for loss of earnings for<\/p>\n

four months. As regards the compensation awarded under<\/p>\n
other heads, we find the same to be reasonable and<\/p>\n
therefore, we are not disturbing the same.<\/p>\n
      13. In the result, the claimant is found entitled to an<\/p>\n
additional compensation of Rs.33,720\/-. He is entitled to<\/p>\n
interest @ 7.5 % per annum from the date of petition till<\/p>\n
realization and proportionate cost. The third respondent<\/p>\n
being the insurer of the offending car shall deposit the<\/p>\n
amount before the Tribunal within two months from the<\/p>\n
date of receipt of a copy of this judgment with notice to the<\/p>\n
claimant.    The award of the Tribunal is modified to the<\/p>\n
above extent.\n<\/p>\n
      The appeal is disposed of as found above.<\/p>\n
