NO. 8431 OF 2010 D\n            ------------------------------------------------------\n           Dated this the 6th day of September, 2010\n\n\n                               JUDGMENT\n<\/pre>\n<p>      The case of the petitioner is the following: The petitioner was<\/p>\n<p>appointed as LPSA on 5.6.1984 in St.Joseph&#8217;s UP School,<\/p>\n<p>Pandippara.     With effect from 5.6.1995, she was transferred to<\/p>\n<p>SALPS, Anicadu under the same educational agency. Thereafter,<\/p>\n<p>she was transferred to SLT LPS, Vazhakulam with effect from<\/p>\n<p>2.6.2008.   The petitioner is presently continuing in Vazhakulam<\/p>\n<p>School. The Assistant Educational Officer, Kothamangalam withheld<\/p>\n<p>the salary of the petitioner from the month of June, 2009 stating that<\/p>\n<p>the transfer and posting of the petitioner to Vazhakulam School is<\/p>\n<p>against the existing orders of the Government and the order of the<\/p>\n<p>District Educational Officer. According to the petitioner, the vacancy<\/p>\n<p>to which she was transferred was the resultant vacancy due to the<\/p>\n<p>promotion of Smt.Betty George as H.S.A.(PS) in SMHS, Nakapuzha,<\/p>\n<p>of which, the sixth respondent is the educational agency and which is<\/p>\n<p>a newly opened school.          It would appear that the educational<\/p>\n<p>authorities directed that the appointment of Smt.Betty George as<\/p>\n<p>W.P.(C) NO.8431 OF 2010 D<\/p>\n<p>                                  :: 2 ::\n<\/p>\n<p>H.S.A. in SMHS, Nakapuzha would be recognized subject to the<\/p>\n<p>condition that the resultant vacancy at Vazhakulam School will be<\/p>\n<p>filled up by a protected teacher. On the ground that a protected<\/p>\n<p>teacher was not appointed at Vazhakulam School and instead the<\/p>\n<p>petitioner was transferred and posted, her transfer and posting were<\/p>\n<p>not approved by the educational authorities. The appointment of<\/p>\n<p>Smt.Betty George was approved.\n<\/p>\n<\/p>\n<p>       2.  The petitioner submitted representation to the Deputy<\/p>\n<p>Director of Education.     That was rejected as per Ext.P5 dated<\/p>\n<p>9.10.2009.    It is pointed out that against Ext.P2 order dated<\/p>\n<p>11.3.2009, passed by the Deputy Director of Education, Ernakulam,<\/p>\n<p>by which the Deputy Director of Education insisted that a protected<\/p>\n<p>teacher should be appointed in the resultant vacancy on the<\/p>\n<p>promotion of Smt.Betty George, the Manager has filed Ext.P6<\/p>\n<p>representation before the Director of Public Instructions. He has<\/p>\n<p>also challenged the consequential orders issued by the District<\/p>\n<p>Educational Officer and the Assistant Educational Officer. Ext.P6 is<\/p>\n<p>pending disposal. It is submitted that if Ext.P6 is disposed of after<\/p>\n<p>hearing the petitioner, the Manager and all other affected parties, the<\/p>\n<p>disputes involved in the case could be resolved.         In this Writ<\/p>\n<p>W.P.(C) NO.8431 OF 2010 D<\/p>\n<p>                                    :: 3 ::\n<\/p>\n<p>Petition, the petitioner has also challenged the orders which were<\/p>\n<p>challenged by the Manager before the Director of Public Instructions.<\/p>\n<p>       3. In these circumstances, it is only just and proper to direct<\/p>\n<p>the second respondent, Director of Public Instructions, to dispose of<\/p>\n<p>Ext.P6 representation dated 23.6.2009, submitted by the sixth<\/p>\n<p>respondent, as expeditiously as possible and, at any rate, within a<\/p>\n<p>period of two months from the date of receipt of a copy of the<\/p>\n<p>judgment, after affording an opportunity of being heard to the sixth<\/p>\n<p>respondent, the petitioner and any other affected party. I do so. In<\/p>\n<p>view of this direction, it is not necessary to consider the question<\/p>\n<p>whether the petitioner is entitled to any other relief claimed in the<\/p>\n<p>Writ Petition. All the contentions of the petitioner are left open.
