No.3256 of 2009\n          ------------------------------------------------\n          Dated this the 30th day of January, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>     Heard the counsel for the petitioner.<\/p>\n<p>    2. The petitioner is the defendant in<\/p>\n<p>O.S.101\/07 on the file of the Sub Court, Pala<\/p>\n<p>instituted by the first respondent\/bank for<\/p>\n<p>recovery of money. The suit was decreed ex<\/p>\n<p>parte as the petitioner as also the other<\/p>\n<p>defendants in the suit did not appear when the<\/p>\n<p>suit stood posted for trial in the special<\/p>\n<p>list.  Thereafter,         the       petitioner           filed an<\/p>\n<p>application to set aside the ex parte decree<\/p>\n<p>and the court below vide Ext.P6 order impugned<\/p>\n<p>in  this  Writ       Petition,             allowed        the  said<\/p>\n<p>application on payment of cost of Rs.10,000\/-<\/p>\n<p>to the first respondent and producing receipt<\/p>\n<p>within ten days.\n<\/p>\n<p>    3. To order the defendant who seeks to<\/p>\n<p>get the ex parte decree set aside, to pay an<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.3256 of 2009          -2-<\/span><\/p>\n<p>        amount of Rs.10,000\/- within a period of ten<\/p>\n<p>        days tantamounts to disallowing the petition<\/p>\n<p>        filed under Order IX Rule 13 as a person who<\/p>\n<p>        is a debtor in the normal course will not be<\/p>\n<p>        able      to    raise  such  a  huge amount  of<\/p>\n<p>        Rs.10,000\/- within ten days and to pay by way<\/p>\n<p>        of cost to the first respondent\/plaintiff. The<\/p>\n<p>        cost so ordered is highly disproportionate and<\/p>\n<p>        unconscionable and Ext.P6 order to that extent<\/p>\n<p>        cannot be sustained.\n<\/p>\n<p>               4. In the result, even without notice to<\/p>\n<p>        the respondent\/decree holder\/bank, cost being<\/p>\n<p>        in the discretion of the court and the court<\/p>\n<p>        below        having   exercised the   discretion<\/p>\n<p>        illegally and without any propriety, I reduce<\/p>\n<p>        the     cost     imposed  vide Ext.P6 order   to<\/p>\n<p>        Rs.2,000\/-. The said Rs.2,000\/- shall be paid<\/p>\n<p>        to the first respondent\/Bank positively in ten<\/p>\n<p>        days from today. In case cost is not so paid<\/p>\n<p>        within ten days, the petitioner shall forfeit<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.3256 of 2009          -3-<\/span><\/p>\n<p>        the benefit of cost having been reduced and<\/p>\n<p>        the petition filed under Order IX Rule 13<\/p>\n<p>        shall stand dismissed.\n<\/p>\n<p>               5. With the above directions this Writ<\/p>\n<p>        Petition is disposed of. The petitioner is<\/p>\n<p>        directed to produce a copy of this judgment in<\/p>\n<p>        the     court    below forthwith with   notice  to<\/p>\n<p>        counsel for the plaintiff\/Bank as this Writ<\/p>\n<p>        Petition is being disposed of without notice<\/p>\n<p>        to the respondent\/plaintiff.
