Therefore, the action is illegal and this Court may<br \/>\n\tinterfere.\n<\/p>\n<p>It<br \/>\n\tis alternatively submitted by the learned Counsel for the<br \/>\n\tpetitioners that in similar matter this Court had made observations<br \/>\n\tin Special Civil Application No. 19412 of 2007 and allied matters<br \/>\n\tand Special Civil Application No. 3890 of 1999 and others, copies<br \/>\n\twhereof are produced at page 97 and 101 of the petition, whereby the<br \/>\n\tliberty was given to the petitioners to apply for licence in the<br \/>\n\thawking zone and Corporation was directed to consider the same. It<br \/>\n\thas been submitted that in case, if this Court is not inclined to<br \/>\n\tconsider the right of the petitioners for occupying over the land,<br \/>\n\tor this Court is not inclined to interfere with the action of the<br \/>\n\tCorporation of removing the petitioners from the land in question,<br \/>\n\tsuch liberty may be given to the petitioners for applying to the<br \/>\n\tCorporation for other hawking zone, and preferably in the nearby<br \/>\n\tarea. It has been submitted that this Court may at least consider<br \/>\n\tthe matter to that extent.\n<\/p>\n<p>On<br \/>\n\tbehalf of the respondent Corporation learned Counsel by relying upon<br \/>\n\tthe affidavit in reply submitted that the petitioners had occupied<br \/>\n\tfootpath, and the road area. Therefore, there were complaints<br \/>\n\treceived from the residents of the nearby area. As the occupation by<br \/>\n\tthe petitioners was causing hindrance to the traffic, the action has<br \/>\n\tbeen taken by the Corporation, in order to show location over which<br \/>\n\tthe petitioners were occupying, learned Counsel has relied upon the<br \/>\n\tmap, produced at page 112 and it was submitted that the same is  TP<br \/>\n\troad, and it was not private land. It has also been submitted that<br \/>\n\tjust adjacent to that TP road, the area is reserved for garden and<br \/>\n\tplay ground and is owned by Corporation. Therefore, the contention<br \/>\n\tof the petitioners is not correct to the extent that they had<br \/>\n\toccupied over private land. It was therefore, submitted that the<br \/>\n\tpetitioners have no right to make encroachment over the land, and if<br \/>\n\tthe petitioners applies for licence for the hawking zone, as per the<br \/>\n\tpolicy of the Corporation, the mater shall be considered in<br \/>\n\taccordance with law.\n<\/p>\n<p>It<br \/>\n\tappears from the affidavit in reply and map produced at page 112<br \/>\n\tthat the place over which the petitioners were occupying is a part<br \/>\n\tof TP road. No authenticated documents or any material are produced<br \/>\n\tby the petitioners to show that the land is owned by any private<br \/>\n\tpersons or that such private persons have authorised the<br \/>\n\tpetitioners to occupy by larries or otherwise for doing business.<br \/>\n\tTherefore, if the petitioners have occupied over the land of TP<br \/>\n\troad, and if the Corporation has taken action for removal or<br \/>\n\teviction though on account of the traffic problem or otherwise, such<br \/>\n\taction cannot be said to be illegal or arbitrary on the part of the<br \/>\n\tCorporation. Therefore, the petitioners would not be entitled for<br \/>\n\trelief as prayed for challenging the action of the Corporation for<br \/>\n\tremoval and the consequential thereto.\n<\/p>\n<p>However,<br \/>\n\tit appears that it is an admitted position that the petitioners are<br \/>\n\talready removed from the road for the land in question. Therefore,<br \/>\n\tif the petitioners are desirous to hawk in the hawking zone area, it<br \/>\n\twill be required for the petitioners to apply and if such<br \/>\n\tapplication is made, it would be required for the Corporation to<br \/>\n\tconsider the same in accordance with law as per the policy<br \/>\n\tprevailing from time to time. Since up till now neither petitioners<br \/>\n\thad made any application nor there is consideration of the same by<br \/>\n\tthe Corporation, I find it proper to leave the matter at that stage,<br \/>\n\twithout observing further on the said aspect. Suffice to state that<br \/>\n\tif such application is made for hawking licence, and in the hawking<br \/>\n\tzone, the Corporation shall consider the same in accordance with<br \/>\n\tlaw.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tSuthar learned Counsel for the petitioners states that in view of<br \/>\n\tthe aforesaid observations, the petitioners shall make an<br \/>\n\tapplication within a period of 15 days.\n<\/p>\n<p>If<br \/>\n\tsuch application is made, the same shall be considered within a<br \/>\n\tperiod of four weeks from the receipt thereof by the Corporation in<br \/>\n\taccordance with law.\n<\/p>\n<p>Subject<br \/>\n\tto the aforesaid observations, no case is made out for interference,<br \/>\n\ttherefore, rejected.
