Leave granted.\n<\/p>\n<p>     Notification under section 4(1) of the Land Acquisition<br \/>\nAct, 1894  [for short, the &#8216;Act&#8217;] was published on March 11,<br \/>\n1978 acquiring 55 acres 5 kanals 1 marla for construction of<br \/>\nnew Mandi  at Jalalabad.  The Collector\t in his\t award dated<br \/>\nMarch 13,  1978 determined the compensation at Rs.4500\/- per<br \/>\nacre. On  reference, the  Additional District  Judge by\t his<br \/>\naward  and   decree  dated   March  19,\t 1982  enhanced\t the<br \/>\ncompensation to Rs.25,000\/- per acre and R5.20,000\/-per acre<br \/>\non the\tbasis of  belting. The\tlearned single\tJudge by his<br \/>\njudgment and  decree dated December 2, 1988 further enhanced<br \/>\nthe compensation  to Rs.43,000\/- and Rs.34,000\/- per acre on<br \/>\nbelting basis,\tbut applied  the provisions of Amendment Act<br \/>\n68 of  1984. In\t this appeal, we are concerned only with the<br \/>\napplicability of  Sections 23 (2), 28 and 23(1-A) of the Act<br \/>\nas amended  by Act  68 of  1984. Since\tthe reference  Court<br \/>\ndetermined the\tcompensation on\t March 19, 1982, i.e., prior<br \/>\nto the\tintroduction of the Amendment Act, the claimants are<br \/>\nnot entitled  to the enhanced solatium and interest and also<br \/>\nthe additional\tamount under  section 23(2),  28 and 23(1-A)<br \/>\nrespectively of the Act.\n<\/p>\n<p>     It is  brought to our notice that dissatisfied with the<br \/>\nenhanced compensation  of Rs.43,000\/- per acre, the claimant<br \/>\nhas filed  Letters Patent  Appeal and that it is pending. If<br \/>\nthat is\t so, we\t need  not  go\tinto  the  question  whether<br \/>\ndetermination of  the compensation  by\tthe  learned  single<br \/>\nJudge at  Rs.43,000\/- per  acre is  justified  or  not.\t The<br \/>\nmatter is  left open.  The Division  Bench would  be free to<br \/>\ndecide the  matter according  to law.  But  as\tregards\t the<br \/>\napplicability of  the amended  provisions, in  view  of\t the<br \/>\nabove facts,  the learned  single Judge was clearly in error<br \/>\nin extending  the  additional  benefits\t under\tthe  amended<br \/>\nprovisions of the Act.\n<\/p>\n<p>      The  appeal is accordingly allowed. The order awarding<br \/>\n30% solatium, 9% interest from the date of taking possession<br \/>\nfor one\t year and  thereafter 15%   interest  and  also\t the<br \/>\nadditional amount  of 12%  per annum  under section  23(1-A)<br \/>\nstands set  aside. Instead,  the claimant is entitled to 15%<br \/>\nsolatium under\tsection 23 (2) and 6% interest under Section<br \/>\n28 as  unamended,  on enhanced compensation from the date of<br \/>\ntaking\t possession till  date of  deposit  into  Court.
