The petitioner stated that the matter has already\n\nbeen settled and the settled amount has been paid. He also\n\nstated that the Board has yet to withdraw the Criminal case\n\nagainst him. KRISHNAN, J\n<\/p>\n<p>                       &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>                  M.A.C.A.No. 1738 OF 2008\n<\/p>\n<p>                  &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;<br \/>\n             Dated this the 4th day of December, 2008<\/p>\n<p>                            JUDGMENT<\/p>\n<p>     This appeal is preferred against the award of the Motor<\/p>\n<p>Accident Claims Tribunal, Pathanamthitta in O.P.(MV) No.403\/2007.<\/p>\n<p>One Mariamma Mathew died and her husband and children had<\/p>\n<p>moved an application under Section 140 of the Motor Vehicles Act<\/p>\n<p>for compensation. It is seen that at any rate there is a Personal<\/p>\n<p>Accident coverage and so that an amount of Rs. 50,000\/- is covered<\/p>\n<p>as per the terms of the policy. The question whether it covers a<\/p>\n<p>larger amount or what is the impact of the policy etc. are matters<\/p>\n<p>that requires consideration by the tribunal at the final stage of the<\/p>\n<p>case. So leaving open that contention to be decided and as the<\/p>\n<p>P.A. coverage is there for Rs. 50,000\/- , I do not want to interfere<\/p>\n<p>with the decision rendered by the tribunal regarding preliminary<\/p>\n<p>award.\n<\/p>\n<p>     The M.A.C.A lacks merit and accordingly it is dismissed.<\/p>\n<p>                                           M.N.
