The appellant was heard today, i.e. 6th May, 2009.\n<\/p>\n<p>2.      In the course of hearing, the appellant alleged irregularities in allotment of<br \/>\ndealership to an applicant who is identified in his application. He stated that the<br \/>\nperson who was allotted dealership has shown different amounts of deposit in his<br \/>\naccount at the time of application for distributorship and interviews, which is<br \/>\nillegal. This is also accepted by the respondent, even then, he alleged, the<br \/>\ndealership has been awarded. He therefore pleaded for providing access to the<br \/>\ndocuments submitted at the time of application for dealership and the interviews.<br \/>\nHe also alleged that the respondent had identified the deficiency in the<br \/>\nsubmission of documents, yet the dealership was allotted to the person, who<br \/>\nfurnished the mis-leading information to the respondent. The appellant presented<br \/>\nthe relevant documents to prove his points.\n<\/p>\n<p>Decision:\n<\/p>\n<p>3.     The appellant is already in possession of the documents which shows that<br \/>\nthe awardee of dealership had indicated different sums of money deposits in his<br \/>\naccount at the time of application for dealership and at the time of interviews. The<br \/>\nrespondent has replied that such act by any applicant constitute violation of<br \/>\nguidelines since an applicant is expected to reveal the same amount of deposit<br \/>\non both the occasions, as mentioned above.\n<\/p>\n<p>4.     In view of the above, the CPIO is directed to allow the appellant to inspect<br \/>\nthe relevant documents submitted by the awardee of dealership in question so as<\/p>\n<p>                             If you don&#8217;t ask, you don&#8217;t get &#8211; Mahatma Gandhi<\/p>\n<p><span class=\"hidden_text\">                                            1<\/span><br \/>\n to enable him to verify the facts as to whether or not there has been violation of<br \/>\nthe guidelines by the respondent.\n<\/p>\n<p>5.     Needless to mention, a public authority u\/s 4 (1) (b) (xiii) of the Act is<br \/>\nexpected to disclosed particulars of the recipient of concession, permits or<br \/>\nauthorization granted by it. Since, the dealership, in question, has been awarded<br \/>\nby allowing concessions in the physically handicapped category, the CPIO<br \/>\nshould provide access of all the necessary documents on the basis of which<br \/>\ndealership has been awarded.\n<\/p>\n<p>6.     Both the parties should mutually decide a convenient date and time for<br \/>\ninspection of relevant documents within one month from the date of issue of this<br \/>\ndecision. The identified documents should be provided as per the provisions of<br \/>\nthe Act.\n<\/p>\n<p>7.
