          In this writ petition filed under Article 227 of<\/p>\n
the Constitution of India the following relief is sought for:<\/p>\n
          “i) issue a direction to the Munsiff Court,<\/p>\n
     Muvattupuzha not to entertain the courter<\/p>\n
     claim of the respondent in O.S. 390 of 2001 as<\/p>\n
     the court is lacking pecuniary jurisdiction.”<\/p>\n<\/blockquote>\n
          2. Petitioner is the plaintiff in O.S. 390 of 2001<\/p>\n
before the Munsiff’s Court, Muvattupuzha. The suit was<\/p>\n
one for realisation of money and prohibitory injunction.<\/p>\n<\/blockquote>\n
There was a suit between the parties as O.S. 96 of 2001.<\/p>\n
In the said suit a compromise decree was passed and as<\/p>\n
per the compromise the plaintiff was bound to pay a sum<\/p>\n
of Rs.16008\/- to the defendant. As per the terms of the<\/p>\n
settlement the defendant was liable to clear the whole<\/p>\n
amount due to a Co-operative Bank.                                   Since the<\/p>\n

defendant did not pay the amount the plaintiff had to pay<\/p>\n
the amount. The plaintiff laid a suit for recovery of that<\/p>\n
amount.\n<\/p>\n
           3.  The defendant resisted the suit and filed a<\/p>\n
counter claim. It is stated that the counter claim exceeded<\/p>\n
the pecuniary jurisdiction of the Munsiff’s court and an issue<\/p>\n
regarding the pecuniary jurisdiction to entertain the counter<\/p>\n
claim was raised.\n<\/p>\n
           4.   After trial, the suit was decreed.        The<\/p>\n
respondent filed A.S.35 of 2008 before the Sub Court,<\/p>\n
Ernakulam. By judgment dated 21.2.2009 the decree and<\/p>\n
judgment of the trial court was set aside and the matter was<\/p>\n
remanded to the trial court for fresh disposal after accepting<\/p>\n
the written statement with counter claim.<\/p>\n
           5. Complaint of the petitioner is that even though<\/p>\n
the appellate court directed the Munsiff’s Court to accept the<\/p>\n
resubmitted written statement with       counter claim after<\/p>\n
affording an opportunity to the plaintiff to file written<\/p>\n
statement to the counter claim. It is therefore prayed that<\/p>\n
WPC.9966\/2010.                  3<\/span><\/p>\n
there may be a direction to the Munsiff’s Court not to admit<\/p>\n
the counter claim.\n<\/p>\n
           6. In the light of the order, that is proposed to be<\/p>\n
passed, it is unnecessary to issue notice to the respondent.<\/p>\n
           7. The remand order made in A.S. 35 of 2008 is<\/p>\n
explicit and clear. It reads as follows:<\/p>\n
           “1.  xxxx                 xxxx<\/p>\n
           2.  If the cost is paid as above, the court<\/p>\n
     below is directed to accept the re-submitted<\/p>\n
     written statement with counter claim, give the<\/p>\n
     respondent\/plaintiff an opportunity to file written<\/p>\n
     statement to it, give both parties an opportunity to<\/p>\n
     adduce further evidence, if any, and dispose of the<\/p>\n
     suit and counter claim on merit in accordance with<\/p>\n
     law.”\n<\/p>\n
Therefore the trial court is bound by the said direction.<\/p>\n
There is no reason to believe that the trial court while<\/p>\n
considering the counter claim will not give due respect to<\/p>\n
the direction issued by the appellate court.       At any rate,<\/p>\n
WPC.9966\/2010.                  4<\/span><\/p>\n
there will be a direction to the trial court to consider the<\/p>\n
counter claim strictly in accordance with the remand order<\/p>\n
passed by the appellate court .\n<\/p>\n
           The writ petition is disposed of as above.<\/p>\n
