Kuriakose, J<\/p>\n<p>      This is an appeal by the Requisitioning Authority.\n<\/p>\n<p>We have heard the submissions of Sri.V.J.Joseph, the<\/p>\n<p>learned counsel for the appellant and those of<\/p>\n<p>Sri.Rasheed C. Nooranad, the counsel for the<\/p>\n<p>respondent\/claimant.        We         have       heard<\/p>\n<p>Smt.P.N.Sumangala, the learned Government Pleader<\/p>\n<p>also. We have made a re-appraisal of the evidence and<\/p>\n<p>we are of the view that the re-fixation of the land<\/p>\n<p>value at Rs.10,000\/- per Are is slightly excessive. On a<\/p>\n<p>better assessment of the market value based on<\/p>\n<p>evidence available on record, the market value can be<\/p>\n<p><span class=\"hidden_text\">L. A. A. No.56 of 2005             -2-<\/span><\/p>\n<p>      re-fixed at Rs.9,000\/- per Are. Accordingly, by setting<\/p>\n<p>      aside the judgment and decree under appeal, we re-fix<\/p>\n<p>      the market value of the land under acquisition at<\/p>\n<p>      Rs.9,000\/- per Are.\n<\/p>\n<p>            The appeal will stand allowed to the above<\/p>\n<p>      extent, but in the circumstances, without any order as<\/p>\n<p>      to costs. It is needless to mention that for the total<\/p>\n<p>      enhanced compensation to which the respondent\/<\/p>\n<p>      claimant becomes eligible by virtue of this re-fixation,<\/p>\n<p>      he will be entitled for all statutory benefits.\n<\/p>\n<p>                                          PIUS C.
