BALAKRISHNA (J)\n\nCITATION:\n 1982 SCC  (1) 116\n\n\nACT:\n     Conservation of  Foreign  Exchange\t and  Prevention  of\nSmuggling Activities  Act  1974,  S.  3(1)-Detention  order-\noffences committed  by detenu  in February  1980-Prosecution\ninitiated under\t Penal Code-Detenu  on\tbail  and  appearing\nbefore Magistrate  from February  1980 to  July\t 1981-Detenu\ntaken into  custody only  in July 1981-Detention assailed in\nCourt-Detention whether illegal and invalid.\n\n\n\nHEADNOTE:\n     The brother  of the  petitioner had been detained under\nsub-section (1)\t of Section 3 of the Conservation of Foreign\nExchange and Prevention of Smuggling Activities Act 1974. In\nthe writ  petition to  this Court  under Article  32 it\t was\ncontended that\ta  case\t covering  offences  under  Sections\n307,411 and  414 of  the Indian\t Penal Code  was  registered\nagainst the  detenu, that  those offences were the only acts\nwhich formed the basis of the detention order and that there\nis consequently\t no  nexus  between  the  unlawful  activity\nattributed to the detenu and his incarceration.\n     Allowing the writ petition,\n^\n     HELD: 1.  The detention takes the character of punitive\nrather than  preventive action,\t and is\t therefore vitiated.\n[141 A]\n     2.\t  No reason  has been put forward for the detenu not\nbeing taken  into custody  in pursuance\t of detention  order\nright from  January 2,1981  till July  10, 1981\t although be\nappeared in  Court on  all the\tdays of hearing fixed by the\nMagistrate during that period. [140 H; 141 A]\n     3.\t  The offences which are said to have been committed\nby the\tdetenu as far back as February 27, 1980 could hardly\nform a\tground for  his detention  on a date as late as July\n10, 1981,  the gap  between the two being about a year and a\nhalf. No  explanation has  been furnished by the State as to\nwhy action  under the  Act was\tnot taken  at  the  earliest\npossible after\tthe alleged commission of the offences which\nare the foundation of the grounds for detention. Poddar  for\t the<br \/>\nRespondent.\n<\/p>\n<p>     The Judgment of the Court was delivered by:<br \/>\n     KOSHAL J.\tIn  this  petition  under  Art.\t 32  of\t the<br \/>\nConstitution of\t India seeking\tthe issuance  of a  writ  of<br \/>\nhabeas corpus, the prayer made by the petitioner is that his<br \/>\nbrother, Narinder  Singh, who has been detained in pursuance<br \/>\nof an  order dated  4th November, 1980 passed under sub-sec.<br \/>\n(I) of\tsec. 3\tof the\tConservation of Foreign Exchange and<br \/>\nPrevention of  Smuggling Activities  Act, 1974\tbe  released<br \/>\nfrom custody.  The main\t ground\t urged\tin  support  of\t the<br \/>\npetition is  that there\t is no\tnexus between  the  unlawful<br \/>\nactivities attributed  to the  detenu and his incarceration.<br \/>\nThat ground  we do  not find to be without substance. A case<br \/>\ncovering offences  under sections  307, 411  and 414  of the<br \/>\nIndian Penal  Code, amongst  others, was  registered against<br \/>\nthe detenu  at Police Station Lopoke in Amritsar district on<br \/>\n27th February,\t1980 and  those offences  are the  only acts<br \/>\nwhich form  the basis  of the  impugned order Those acts are<br \/>\nalso the  subject-matter of  a prosecution  launched against<br \/>\nthe detenu, proceedings in relation to which have been going<br \/>\non in  the Court  of an\t Amritsar Magistrate.  During  those<br \/>\nproceedings the\t detenu was  on bail  and was  appearing  in<br \/>\ncourt on  every hearing\t right from  January 2, 1981 till he<br \/>\nwas put\t behind the  bars on 10th July, 1981 in pursuance of<br \/>\nthe impugned  order. We\t are clearly  of  the  opinion\tthat<br \/>\noffences which are said to have been committed by the detenu<br \/>\nas far\tback as\t 27th February,\t 1980 could  hardly  form  a<br \/>\nground for  his detention  on a\t date as  late as 10th July,<br \/>\n1981, the  gap between\tthe two being well-nigh a year and a<br \/>\nhalf. No  explanation at all has been furnished on behalf of<br \/>\nthe State  as to  why action  under the Act was not taken at<br \/>\nthe earliest  possible after  the alleged  commission of the<br \/>\noffences  which\t are  the  foundation  of  the\tgrounds\t for<br \/>\ndetention. In  our  opinion,  the  charge  is  so  stale  in<br \/>\nrelation to the detention as not to have any real connection<br \/>\nwith it.  It is\t further noteworthy that no reason is put 11<br \/>\nforward for  the  detenu  not  being  taken  in\t custody  in<br \/>\npursuance of  the impugned  order (for\twhich the  detaining<br \/>\nauthority was  moved in\t the first  instance by\t the  Senior<br \/>\nSuperintendent of Police, Amritsar)<br \/>\n<span class=\"hidden_text\">141<\/span><br \/>\nright form  January 2,\t1981 till  July 10, 1981 although he<br \/>\nappeared in  Court on  all the dates of hearing fixed by the<br \/>\nMagistrate during  that period.\t In these  circumstances the<br \/>\ndetention  takes  the  character  of  punitive\trather\tthan<br \/>\npreventive action  and is therefore vitiated.
