Thereafter the petitioner  was given selection grade<br \/>\n\tof Rs. 325-400 from 22.3.1971. Pursuant to the order passed by the<br \/>\n\tTribunal in Appeal no. 102 of 1977 the petitioner came to be<br \/>\n\tpromoted  as Head Clerk from 9.1.1977.\n<\/p>\n<p>2.2<br \/>\n\t\tThe petitioner had completed nine years of services in the cadre of<br \/>\n\tHead Clerk . In view of Government resolution passed by the<br \/>\n\tGovernment dated 16.8.1994, the petitioner had become eligible to<br \/>\n\tget the benefit of higher pay scale of Taluka Development Officer.\n<\/p>\n<p>2.3<br \/>\n\t\tThe petitioner made representation for getting the higher pay<br \/>\n\tscale, but the same was not answered property by the respondent.<br \/>\n\tThereafter the petitioner preferred appeal bearing no. 139 of 2000<br \/>\n\tbefore the Gujarat Civil Services Tribunal on 29.3.2000.The said<br \/>\n\tappeal came to be rejected. Being aggrieved by the said order, the<br \/>\n\tpetitioner had preferred  review application,which also came to be<br \/>\n\trejected. Hence this petition.\n<\/p>\n<p>\t\tHeard learned advocates for<br \/>\n\tthe respective parties and perused the documents on record.\n<\/p>\n<p>\t\tFrom the record it revealed<br \/>\n\tthat the Government resolution dated 16.8.1994  provides through<br \/>\n\tpara 3[3] that the higher pay scale would mean that the pay scale of<br \/>\n\tthe immediate post of promotion. The petitioner who was working as<br \/>\n\tDeputy Chitnis\/ Head Clerk was eligible for the cadre of Deputy<br \/>\n\tTaluka Development Officer, having pay scale of Rs. 1640-2900 and he<br \/>\n\twas getting the said benefit of the higher pay scale with effect<br \/>\n\tfrom 1.6.1987. The authority has rightly decided the case of the<br \/>\n\tpetitioner, that he is not entitled for the post of Taluka<br \/>\n\tDevelopment Officer.  I am in complete agreement with the reasoning<br \/>\n\tgiven by the authority. No case is made out to cause interference.<br \/>\n\tPetition is therefore devoid of any merits and the same is dismissed<br \/>\n\taccordingly.
